Present Position
No change now for EU citizens and their families in the UK

Right to enter UK until 29th March 2018 if No Deal

Clients wanting to remain must apply for (Pre)Settled Status by 31st


December 2020

Nothing to do if you are Irish, or you have Indefinite Leave to Remain


(granted pre-2006) but you can apply for Settled Status
Settled Status: Who can apply?
All EU citizens and their families resident in UK before 30th March 2019
can apply from that date
EU citizens with a valid biometric passport and family members with a
valid biometric residence card can apply from 21st January 2019

If you have Permanent Right of Residence, you will still have to apply for
Settled Status

If you have Indefinite Leave to Remain you can apply for Settled Status
but do not have to
Requirements for Settled Status
Continuously resident in UK for 5 years

Some exemptions eg can be absent for 6 months a year or up to 12 months for


important reasons eg family illness

If not immediately eligible, will get Pre-Settled Status for 5 years

Non-EU citizen family member (except children under 21) must themselves be
continuously resident for 5 years as family member
Application for Settled Status 1

Fee of £65 or £32.50 for children under 16 if applying before 30th March
2019 which the government will return

No fee for applications after 30th March 2019

Same rules will also apply to citizens of Norway, Iceland, Lichtenstein


and Switzerland from 30th March 2019
Application for Settled Status 2
You can apply now if you are an EU citizen and you have a biometric
passport (not an ID card). If you are a non-EU family member, you will
need a biometric residence card. Otherwise, you can apply from 30th
March 2019

You will need an Android phone (such as a Samsung, Google or Sony


phone). It must have NFC (this means you can use your Android phone
for contactless payments).
Application for Settled Status 3
Automated checks by HMRC (tax and National Insurance) and DWP
(benefits)

Can submit documentary evidence

Criminal checks

Repeat applications allowed and right to review


Effect of Settled Status

Settled Status is only lost by 5 years absence from UK (2 years for Indefinite
Leave to Remain or Permanent Right of Residence)

Subject to other requirements, unless married to a British citizen you can apply
for naturalisation one year after Settled Status (or grant of Indefinite Leave to
Remain or Permanent Residence Document).
Entry after 30th March 2019

EU citizens entering before 31st December 2020 can apply within 3


months to work for up to 3 years

No separate checks by employers:

”we will not ask employers or other third parties, such as landlords, to
start distinguishing between EU citizens who were resident before exit
and post-exit arrivals” (Home Office 28th January 2019)
After 2020

Same rules intended for EU and non-EU citizens

December 2018 White Paper proposes minimum salary of £30,000 in a job


requiring at least A-level qualifications to be sponsored for a UK work visa.
