Cause and Condition Test:
If the defendant has created only a
passive, static condition which made the
damage possible, he is said not to be
liable.

• It is no longer practicable to distinguish
between cause and condition.
• The defendant may be liable even if only
created conditions, if the conditions resulted in
harm to either person or property.

• Those that are inherently dangerous


• Those where a person places a thing which is not
dangerous in itself in a dangerous position.
• Those involving products and other things which are
dangerous because they are defective.
