Rules of the Court Rule 112 section 7
• All offenses covered under the Revised Penal Code and special laws, rules and
regulations.
• Where respondent is a minor, the inquest investigation shall cover only
offenses punishable by imprisonment of not less than six (6) years and one (1)
day, provided that no inquest investigation shall be conducted unless the child
respondent shall have first undergone the requisite proceedings before the
Local Social Welfare Development Officer pursuant to the Rules on Inquest
With Respect to Children In Conflict With Law.
Date and Time of the Conduct of Inquest
Proceedings
• In Inquest proceedings may be conducted at any time of the week. However,
where inquest falls on a non-working day, Saturday, Sunday, or holiday, and a
prosecutor is not available, the inquest proceedings shall be conducted on the
first day following the arrest (Medina vs. Orozco, Jr. 18 SCRA 1168).
Purpose
• It is issued by the court to determining whether or not the said persons should
remain under custody and correspondingly be charged in court.
COMPLAINT IN CRIMINAL CASES
• A complaint is a sworn written statement charging a person with an offense, subscribed by
the offended party, any peace officer, or other public officer charged with the enforcement of
the law violated.
Importance
• It is important that those who will be writing the police report will be familiar
with the forms of complaints in criminal cases, its format, and the standard
headings and captions of cases. The familiarization of all these will help him in
his reports, and in any court proceedings. These standard headings and
captions are used in the Supreme Court, Court of Appeals, and
Municipal Courts
