INTRODUCTION
What is RA 9165?
• It is the policy of the State to safeguard the integrity of its
territory and the well-being of its citizenry particularly the youth,
from the harmful effects of dangerous drugs on their physical
and mental well-being, and to defend the same against acts or
omissions detrimental to their development and preservation.
OBJECTIVES OR
POLICIES OF RA 9165
Republic Act No. 9165 or the Comprehensive Dangerous Drugs Act
of 2002 mandates the DDB to be the policy-making and strategy-
formulating body on drug prevention and control. It shall develop and
adopt a comprehensive, integrated, unified and balanced national
drug abuse prevention and control strategy.
On May 30, 2002, and May 29, 2002, respectively, the Philippine
Senate and House of Representatives passed and enacted the
legislation. On June 7, 2002, President Gloria Macapagal Arroyo
signed it into law. Fifteen days after it was signed, on June 22, 2002,
the law became operative. The Philippine Drug Enforcement Agency
is in charge of carrying it out. The PDEA, the Department of Health,
or any interested person may file a petition with the DDB to amend
the list of prohibited substances.
UNLAWFUL
ACTS
SECTION 5. SALE, TRADING, ADMINISTRATION,
DISPENSATION, DELIVERY, DISTRIBUTION AND
TRANSPORTATION OF DANGEROUS DRUGS AND/OR
CONTROLLED PRECURSORS AND ESSENTIAL
CHEMICALS.
• Any person who, without legal authorization, sells, trades, administers, dispenses,
delivers, gives away to another, distributes dispatch in transit, or transports any
dangerous drug—including any and all species of opium poppy, the penalty of life
imprisonment to death and a fine ranging from five hundred thousand pesos
(P500,000.00) to ten million pesos (P10,000,000.00) or acts as a broker in any of
these transactions.
SECTION 6. MAINTENANCE OF
A DEN, DIVE OR RESORT
• Any individual or group that maintains a den, dive, or resort where any controlled
precursor and essential chemical is used or sold in any form faces a penalty that ranges
from twelve (12) years and one (1) day to twenty (20) years in prison and a fine that
ranges from one hundred thousand pesos (P100,000.00) to five hundred thousand pesos
(P500,000.00).
• When a dangerous substance is given, supplied, or sold to a minor who is permitted to
use it in such a location, the maximum punishment specified by this section will be
applied.

SECTION 7. EMPLOYEES AND
VISITORS OF A DEN, DIVE OR
RESORT
Imprisonment: 12y 1d - 20y + Fine: P100k - P500k
(a) Any employee of a den, dive or resort, who is aware of
the nature of the place as such;
and (b) Any person who, not being included in the
provisions of the next preceding,
paragraph, is aware of the nature of the place as such and
shall knowingly visit the same.

Any person, who, unless authorized by law, shall possess * any
dangerous drug in the
following quantities, regardless of the degree of purity:

Person is in possession which is identified to be a prohibited drug
Such possession is not authorized by law
Person freely & consciously possessed the said prohibited drug
1) 10 grams or more of opium;
(2) 10 grams or more of morphine;
(3) 10 grams or more of heroin;
(4) 10 grams or more of cocaine or cocaine hydrochloride;
(5) 50 grams or more of methamphetamine hydrochloride

(6) 10 grams or more of marijuana resin or marijuana resin oil;
(7) 500 grams or more of marijuana; and
(8) 10 grams or more of other dangerous drugs such as, but not limited to,
methylenedioxymethamphetamine (MDA) or "ecstasy",
paramethoxyamphetamine (PMA), trimethoxyamphetamine (TMA), lysergic acid
diethylamine (LSD), gamma hydroxyamphetamine (GHB), and those similarly designed or
newly introduced drugs and their derivatives, without having any therapeutic value or if the
quantity possessed is far beyond therapeutic requirements, as determined and promulgated by
the Board in accordance to Section 93, Article XI of this Act. Unlawful Acts and Penalties

INSTRUMENT, APPARATUS AND OTHER
PARAPHERNALIA

Any person, who, unless authorized by law, shall possess or have
under his/her control any
equipment, instrument, apparatus and other paraphernalia fit or
intended for smoking,

INSTRUMENT, APPARATUS AND OTHER
PARAPHERNALIA

consuming, administering, injecting, ingesting, or
introducing any dangerous drug into the
body : xxx The possession of such xxx shall be prima facie
evidence that the possessor has
smoked, consumed, administered to himself/herself,
injected, ingested or used a dangerous
drug and shall be presumed to have violated Section 15 of
this Act.
SECTION 15. USE OF
DANGEROUS DRUGS

A person apprehended or arrested, who is found to be positive for use of


any dangerous drug,
after a confirmatory test, shall be imposed a penalty of a minimum of 6
months
REHABILITATION in a government center for the first offense

If apprehended using any dangerous drug for the second time , he/she
shall suffer the penalty
of Imprisonment 6 years & 1 day to 12 years + Fine P50k to P200k
Provided, That this Section shall not be applicable where the person
tested is also found to
have in his/her possession such quantity of any dangerous drug provided
for under Section 11
of this Act, in which case the provisions stated therein shall apply.
ILLEGAL
DRUGS
CANNABIS OR COMMONLY KNOWN AS
“MARIJUANA” OR “INDIAN HEMP”
Cannabis, weed, pot, and marijuana all refer to the
same group of plants known for their relaxing and calming
effects. Marijuana refers to the dried leaves, flowers, stems,
and seeds from the Cannabis sativa or Cannabis indica plant.
The plant contains the mind-altering chemical THC and
other similar compounds. Cannabis is commonly used as a
recreational drug. People also commonly use cannabis for
multiple sclerosis (MS) and nerve pain. It is also used for
nausea, vomiting, migraine, and many other conditions, but
there is no good scientific evidence to support these uses.
Marijuana over-activates parts of the brain that contain the
highest number of these receptors. This causes the "high"
that people feel. Other effects include:

• altered senses (for example, seeing brighter colors)


• altered sense of time
• changes in mood
• impaired body movement
• difficulty with thinking and problem-solving
• impaired memory
• hallucinations (when taken in high doses)
• delusions (when taken in high doses)
• psychosis (risk is highest with regular use of high potency marijuana)
METHYLENEDIOXYMETHAMPHETAMINE
(MDMA) OR COMMONLY KNOWN AS “ECSTASY”

Ecstasy is often used to refer to MDMA in the tablet or capsule form, which is the
most common way people take the drug. MDMA is a synthetic drug that acts as a stimulant
and hallucinogen. It produces an energizing effect, distortions in time and perception, and
enhanced enjoyment from sensory experiences. It has also been described as an entactogen
—a drug that can increase self-awareness and empathy.
Negative side effects of ecstasy use can come about
while the user is still under the influence or after they
have come down from their high. Some of these common
side effects also include:
• Impaired judgment
• Anxiety
• Depression
• Trouble sleeping
• Confusion
• Paranoia
• Muscle tension
• Blurred vision
• Teeth clenching or grinding
METHAMPHETAMINE HYDROCHLORIDE OR
COMMONLY KNOWN AS “SHABU”, “ICE”, AND
“METH”
Methamphetamine is a powerful, highly addictive
stimulant that affects the central nervous system. It takes the
form of a white, odorless, bitter-tasting crystalline powder that
easily dissolves in water or alcohol. It was developed from its
parent drug, amphetamine, and was used originally in nasal
decongestants and bronchial inhalers.

It causes increased activity and talkativeness, decreased appetite, and a


pleasurable sense of well-being or euphoria. However, methamphetamine differs
from amphetamine in that, at comparable doses, much greater amounts of the drug
get into the brain, making it a more potent stimulant.
People take methamphetamine
for its pleasurable Trusted Source effects. These

include:
• higher levels of physical activity
• Decreased appetite
• a sense of well-being or euphoria

A person may also experience:


• faster breathing
• a fast or irregular heart rate
• higher blood pressure
• Increased body temperature
