What is Freedom of Movement in
Australia?

 That every lawful Australian citizen can change residence and


leave the country if they wish

Bounds of the Law

 The right can be removed because of national security, public


health, criminal offences, to protect the rights and morals of the
public, private premises, restricted environmental areas and
quarantine zones
z
How is this freedom protected?

 Through the Australian constitution

 In section 92 it states that, ‘Everyone lawfully within the territory


of a State shall, within that territory, have the right to liberty of
movement and freedom to choose his residence’
z
When was the freedom of movement
tested?

 In 1901 - 1967 aboriginal children were forcibly removed from


their families and homes

 This was in violation of the freedom of movement
