This years goal is

By Carol Ballard Warren County Report The Methodist Mission Quilting ladies are busy with fine sharp needles, stitching delicate patterns onto this years quilt, which will be won by a fortunate someone who has participated in the ticket donation fundraiser. And theyve been sewing on it since about March. This years quilt, Grannys Stars is composed of 1930s retro print fabric, is 94 by 105 inches and is all hand-quilted and appliqued. Quilters met for a tasty and colorful potluck lunch, complete with flowers and table-settings in the churchs spacious fellowship hall early this summer and were eager to talk about their ongoing project. We cover all expenses for making the quilt so we can donate all the money received to local missions. Its a gift from us, said Eleanor Chadwell, spokesperson for the group. Every year for the past five years, theyve carefully and lovingly created a fabric work of art which became useful to the community as a result of a drawing. The quilt will be shown at Festival of the Leaves on Saturday, October 13 from 9 a.m. - 6 p.m. During the festival, donations will be taken in exchange for tickets to be drawn at their 56th annual United Methodist Womens Bazaar at the church on Friday and Saturday, November -3. Tickets to win the colorful, pretty quilt can also be purchased from now until then by calling the church. Theyre hoping to have it

BENJAMIN RICE LACY, IV


Benjamin Rice Lacy, IV, 61, of Richmond, passed away Monday, July 16, 2012. Born in Roanoke, Va., he was the son of Benjamin Rice Lacy III and the late Carolyn West Lacy. He graduated from Davidson College in 1972 and from the T.C. Williams School of Law in 1975. Mr. Lacy was a practicing attorney with the law firm of Sands Anderson. He was an Elder of River Road Presbyterian Church, a former Board member of the Commonwealth Club, the Greater Richmond Bar Foundation, a Board member of the Central Virginia Chapter of the Juvenile Diabetes Research Foundation and a member of the Country Club of Virginia. Mr. Lacy was a past President of No, Inc. Investment Club. He is survived by his wife, Sandra Schute Lacy; his son, Benjamin Rice Lacy V; his daughter, Carolyn Lacy Brackett and her husband, Alex; three grandchildren, Abigail Lacy, Jones and Ben Brackett; his father, Benjamin Rice Lacy III; and sister, Emma Lee Nashner of Philadelphia; a step brother George Lee McIntyre, Jr. and two stepsisters Debra McIntyre Hunter and Elizabeth McIntyre Quarles. A memorial service was held 11 a.m. Wednesday, July 18, at River Road Presbyterian Church. In lieu of flowers, contributions may be made to the Benjamin R. salacious article about The exorcist Priest by Roger Branchini. At least, for the second time around, there was a warning about the X rated content. It makes one wonder about the editorial oversight of your columnists, and one can not help but speculate as to Mr. Branchinis prurient fascination with the downfall of a man of the cloth. The titillating descriptions of the events suggest that Mr. Branchinis interest is either a morbid obsession with erotica or a great dislike of religion. Neither option is appropriate material for your kind of widely diffused, family-friendly publication. If one wants to read about erring clerics, there are plenty of Edwardian time semi pornographic novels, and modern literature, needless to say, is quite abundant on the subject of sex. Since Mr. Branchini is so fascinated by the subject, perhaps he should consider expanding his talents and write a sequel to Shades of Grey from the masculine point of view. Respectfully, Roxolana Armstrong Warren County (Managing editors note: the second follow up story on the exorcist priest referenced by Ms. Armstrong from our Late July edition, was a completely different story than appeared in our previous issue, and the only one of the two stories with a warning about the graphic nature of the content to follow. The initial story focused on the filing of the lawsuit, the history and sequence of events and public statements made regarding Father Thomas Euteneuers departure as president of Human Life International and his subsequent admission five months later to acts of a sexual nature during his spiritual ministries of a troubled adult female client. The second storys focus was on the detail of allegations in the Jane Doe lawsuit of specific acts of the priests in the practice of his spiritual ministry of Jane Doe and later efforts to cover those acts up, break off, then resume his so-called spiritual ministry of Jane Doe. A portion of one quote from the lawsuit referencing full mouth kisses being described by the priest as blowing the holy spirit into his client followed by additional detail not included in the first story was the only direct redundancy from the initial story. As for a fascination with the lawsuit subject matter leading to a male-authored sequel to the Shades of Grey book, we suggest that Father Euteneuer would be a much more apt candidate for such a writing endeavor.)

When the police become the victim EDITOR: The recent assault on police officer Sgt Bryan Courtney in Front Royal has made my stomach turn and at the same time made me realize something about myself. Officer Courtney came within inches of being killed the other night and for what? All because someone called 911 and reported a man exposing himself to cars. We pay officer Courtney to serve and protect no matter how simple or how dangerous the call might be, everyday we see the black and white cruisers running up and down the streets with sirens wailing and blue lights streaking as we stand there oblivious to where they might be heading. I wish I could go back in time months prior to the vicious assault. Its a beautiful summer day in Front Royal and everyone is out enjoying the sun, Im in line to get a cup of coffee at the Daily Grind when I notice a police officer standing behind me, Im next in line to order my coffee and I tell the clerk Id also like to buy the officers coffee. At that moment the officer who up to now I have never met thanks me for buying his coffee as he introduces

Ernest Borgnine (1917- 01)
By Nick Thomas For years I had been trying to snag an interview with veteran actor, Ernest Borgnine. But each time I nagged his long-time publicist, Harry Flynn, Harry always had good excuses: Ernies away filming. Hes overseas on holiday. Hes out of state on business. Hes off doing a book tour Ask me again in a few months. My hopes for a chat with the aging Borgnine began to dim. But then, in December of 011, our paths crossed in the middle of the Gulf of Mexico. I was sailing on the first Turner Classic Movies film cruise with some ,000 other passengers, along with several celebrity shipmates, including Borgnine. We got our first glimpse while boarding the ship. As we stood in line to proceed through security, my wife noticed a motorized scooter pulling alongside us, inching its way to the head of the line. But I didnt give it much thought. Look, my observant wife said to me, its Ernest Borgnine! Everywhere you go now you have to wait, said a very cheerful Borgnine. He was wearing a baseball cap and glasses, which I offered as a somewhat feeble explanation for failing to recognize the then 94-year-old Hollywood legend. In his characteristic booming, gravelly, voice, he added with a broad grin, except when they want to take your money! See you all aboard!

And see him we did, many times. Just a few hours later, there was a compulsory safety drill. But the folks demonstrating the emergency procedures had to compete for the crowds attention when Borgnine came in and was mobbed by well-wishers. Had the signal to man the lifeboats come through then, I suspect many passengers would have gone down with the ship, still straining to get a glimpse of Ernie (he always preferred fans to call him Ernie). Hardly a day went by when we didnt see him moving through the ship, smiling and waving at passengers, pausing for a handshake, posing for a photograph, or giving an autograph or hug to a fan. I cant imagine too many of todays self-absorbed stars being so gracious. During the cruise, TCM arranged for me to sit down one-on-one with Borgnine for a 0 minute interview. He was just a delight such a gentleman, so graceful, and down to earth. Although he was clearly a showman and enjoyed interacting with the fans, their admiration seemed to overwhelm him a bit. Its one thing to like an actor, but the kind of love people have shown me is amazing. I dont know why, because I certainly dont deserve it, he said humbly. I naturally suggested he was being too modest. I dont see it that way, he said. To me, acting is just a job I do for a living. Im just a working stiff and want to get along with everyone. I dont go in for all that adulation stuff. At the same time, Borgnine admitted that recognition is also a measure of an actors success. He recounted an earlier time in his life as a struggling young actor when he emerged from a LA restaurant one day, wondering if people would

ever recognize him. He got his answer, he told me, years later when traveling on another, smaller boat, this time around Easter Island. I put my head up out of the boat to look for the statues on the island and a woman on the dock nearby saw me. Oh my God, Ernest Borgnine! she yelled. And I said to myself, Youve made it! Theres no doubt that he made it. Along these lines in the past decade alone, Borgnine appeared in almost 30 films and many TV shows, a number that could be considered a career for some actors. I suspect many of us classic movie fans hoped that Borgnine would live and continue to work forever. But nature is uncompromising on that subject. He passed away in July, quite unexpectedly, after a lifetime of good health. Borgnine could play the heavy, as in From Here to Eternity or 1973s Emperor of the North. But he was also a great good guy on film (Escape From New York), TV (McHales Navy), and in real life (unwavering support for our military). TCM presented a 4-hour memorial tribute on July 6, including 1955s Marty, for which Borgnine won the Best Actor Oscar playing a good-natured but shy butcher. Clearly, he was proud of his success. Wow, if mom could see me now! he told me towards the end of our interview. Now she can, Ernie. Herring announces for Virginia AG Citizens of the commonwealth, Its time to get politics out of the Attorney Generals office and return its focus to doing whats right for the people of Virginia. Over the last three years, weve watched Attorney General Cuccinelli pursue an ideological crusade that is out of step with the mainstream. Time after time, the Attorney General has abused the powers of his office and twisted the law to advance his personal political agenda, which has been costly to taxpayers and costly to the credibility of the office. Its hurt Virginians and damaged our states reputation. Its time to get politics out of the Attorney Generals office and return its focus to doing whats right for the people of Virginia. Virginia cannot afford another Attorney General like Ken Cuccinelli. Unfortunately, thats exactly what those on the Republican side jockeying to take his place are offering. But what Virginians are looking for is an Attorney General who will restore the peoples trust in the office. So after talking with Virginians across the Commonwealth, and with much thought and careful consideration, I have decided to run to be Virginias next Attorney General. I want to be the Attorney General for all of the people in our state. Virginians deserve the respect and the protection of the law, regardless of the Attorney Generals personal politics. And thats the kind of Attorney General I will be. As I have done in the Senate, I will work to keep Virginias families and seniors safe. I will fight to protect consumers, defend civil rights and ensure state agencies are accountable to the people. And I will stand up for the right of women to make their own healthcare decisions without government interference. As the only Democrat from Loudoun County in the General Assembly, Ive stood up to Ken Cuccinelli and his allies in Richmond on the front lines of the legislative fights over their socially divisive agenda. I have won tough races in a swing district in the outer-suburbs of Northern Virginia and I know what it takes to win. I look forward to campaigning in every corner of the Commonwealth and introducing Virginia to a new vision for the office of Attorney General. In the letter, they make the claim that Right to Work laws somehow undermine the wages of all working class citizens and that we would all be better off unionized. They try to justify this position by using abstract terms like suitable wages and a comfortable standard of living. Of course if you ask 1,000 different people about

what constitutes a suitable wage or a comfortable standard of living, you are likely to get 1,000 different answers. They, along with the managing editor, try to make the claim that it is the presence of labor unions that have made for shorter work weeks, more benefits, and increases to our standard of living. As is usual in these pages, this is the exact opposite of the truth. REAL wages rose at about % per year before the advent of unions and at a similar rate afterward. Private-sector unions reached their peak in terms of membership in the 1950s when they accounted for about 1/3 of the work force. Today, private-sector unions represent roughly 10% of the private-sector workforce. All during this time of DECLINING union membership, power, and influence, wages and living standards have RISEN quite substantially (M-ed note: no doubt accounting for the HUGE increase in poverty and unprecedented economic separation between the rich and everyone else in America over the past decades of de-regulation and tax cuts for the wealthiest of our society). It is comforting to know that Mr. and Mrs. Adams are concerned for their fellow citizens welfare, but it is not the ability to collectively bargain that creates wealth and increases ones standard of living. What, exactly, does do this important job in the economy? It is saving, investment, and the accumulation of capital resources (i.e. capitalism). In a free market economy, businesses invest the vast bulk of their profits in capital goods that make labor more productive The amount of goods the economy is capable of producing rises, at times even explodes. This is how wealth is created: we can produce more goods with the same (or lesser) amount of labor. As a result of capital investment, firms can now produce many, many times more goods than before, and at a considerably lower cost. Thanks to the pressures of market competition, firms pass on these cost cuts to consumers in the form of lower prices, better quality merchandise, or a combination of both. They also pass on these cost cuts to their employees in the form of higher wages, better benefits, and better working conditions. The ordinary persons standard of living increases, therefore, not because government takes from the rich to give to him or because labor unions struggle with employers to win him concessions. His standard of living increases because business firms can invest in machinery that makes it possible for more and more goods to be produced with fewer and fewer hands, thereby increasing the overall amount of material goods available and rendering them less and less expensive. Unionized labor on the other hand, with its artificially high wages, inflated benefits packages, and expensive pensions, only serves to hinder the wonderful advancements to human civilization that have been made possible by the free market. It is easy to see the failure of the pro-union argument when we apply it to an underdeveloped economy. For example, what if we took all of the demands and concessions of unionized workers and forced them upon companies in Bangladesh? Would that mean the suddenly everyone in Bangladesh would enjoy air conditioned workplaces, three weeks of paid vacation every year, overtime pay, free health and dental benefits, and pensions? Would they find themselves able to get by on only 8-hour work days, 5 days per week? Would we need only to introduce our labor unions into Bangladesh and suddenly its sunshine and lollipops for everybody? No, to the contrary, everybody would be instantly unemployable because those workers at that state of capital intensiveness are not productive enough to justify those demands. Fortunately for us, by the time unions came onto the scene, our economy was productive enough to absorb the extra costs and burdens that labor unions forced onto companies. The only non-coercive, non-arbitrary way to introduce improvements in monetary compensation and in working conditions is through the free market. In sum, it is the free market that has been responsible for the growth of our overall economy and for the standard of living increases for the individual laborers working within the economy. Real wage rates have risen not because of, but in spite of, unionized labor. And the idea of public employee unions is too absurd to even comment about. Ronald McDonald House is a facility that allows families to stay close to their children when they are hospitalized Grandma Sharon Kindall explains, Our target was to gather needed items for them rather than unusable gifts to Eric. I called the Ronald McDonald House people and was instructed to go to their website. There was a wish list I used to give people ideas. My goal was simply to gather as much as possible for them. I chose Charlottesville it may be the closest Ronald McDonald House to us and because Eric spent the first 10 months of his life in Charlottesville and we utilized their facility many times. The contributions in Erics name sounds like a great idea to us. Grandma Kindall explains that Eric was born with multiple birth defects and transferred to Charlottesvilles medical center 1 days after he was born. He was diagnosed with VACTERAL and after many surgeries in attempts to correct the defects, Eric was left with CP from seizing during the heart surgery. Louisa failed to score in the top 6th, setting up FRs winning rally. Good Kd, Clingerman walked, Wyatt Gill pinch running for him. Matt Rutherford then lined a -strike pitch to right; Conner McCollum walked on 4 pitches; Jacob Dodson battled to a full count and sent a slow roller to the left of the pitcher that bounced over his glove with Gill scoring the winning run for FR. This was the final Pool Play game and forced a 3-way tie in Pool 1. The first tie breaker was least runs allowed between the 3 teams, which Louisa only allowed 11 runs in their 3 games. The nd tie breaker involved BSG and FR, which meant that head to head play was the deciding factor. Since BSG beat FR 10-9, they became the other team to advance out of Pool 1. This eliminated FR from further play despite the fact they finished with a winning record, as they did at each level of all-star play. West Springfield eventually defeated Vienna 7-6 in 8 innings for the State Championship Front Royal finished their tourney play for the year with a 7 win,  loss record. They had a winning record at all 3 levels of play: 3-1 in area play; 0 in District 3 Championship play; and -1 in State Championship play. Congratulations for an outstanding post season run.

Council debates moving on temporary Kendrick-Kerfoot connector road
velopment Partnership to help with the engineering study of the property. McDonald said PHRNA had been contracted to do the study, which was scheduled to begin within 15 to 0 days and slated for completed within six months. That schedule should coincide with an expected letter of no further interest from the U.S. Environmental Protection Agency (EPA) that will release the 160 acres earmarked for commercial development on the 467acre site. McDonald said the EPA is still forecasting issuance of that letter by the end of 01. Referencing  years of redevelopment and many projected and passed release dates, McDonald was careful to add, Thats what EPA is saying, that is not what Jennifer McDonald is saying, regarding a drop-dead release date for the projected business park area. That rayon and synthetic fibers manufacturing plant was built as American Viscose in 1940 and closed as Avtex Fibers by state officials for water emissions violations in 1989. In the intervening -plus years the site has been described as the nations largest Superfund site and a model for local, state and federal cooperation on the reclamation of such environmental disaster sites. But the bulk of redevelopment and the potential commercial tax revenue and jobs such redevelopment is anticipated to bring, has been a long time coming. In addition to the former Administration Building complex off Kendrick Lane where the EDA and other offices are located, early development at the site has included the county soccerplex and skateboard parks on largely unused portions at the southeastern corner of the old plant. Why temporary And it was the subject of foot and smaller wheel skateboard transportation between the developed skate and soccer park areas to the south of the property and neighborhoods on its north side that segued into work session discussion of what would initially be a temporary northsouth connector road. McDonald explained that EPA will only allow a temporary road to be constructed at this point because there is still on and off-site truck traffic from the Superfund site. She also said the EDA didnt want to marry a potential developer to a road it may

not want prior to marketing the site for sale. For one former public works official and engineer present the notion of a temporary and non-permanent road created a problem. Recently reelected Gene Tewalt, a former director of the town public works department, said the notion of temporary roads anticipated to be heavily used was problematic. You dont ever build a temporary road, it tends to become permanent, Tewalt said, adding, If you try to take it out you have a monster on your hands. Tewalt also wondered at spending money on a temporary road that a future developer might want to relocate. In response to a question, Town Manager Steve Burke pointed out that any site developer will have to have a connector road included in their plan. McDonald concurred and said while a developer had the right to relocate the road, since a KendrickKerfoot connector road was mandated as part of the sites permanent development it seemed unlikely they would want to relocate an established path for that road. The combination of significant initial use and a mandated permanent road between Kendrick and Kerfoot seemed to ease Tewalts mind about wasting town money on a road that might be abandoned shortly after it is built. Hollis Tharpe also urged movement on the temporary road as soon as the EPA will allow. He pointed out that if the past was a barometer, the town could continue to wait indefinitely for a non-midtown connector between the north and south sides of town if it held its breath for the total release of the property, a private developers purchase of the site, and that developers movement on a permanent connector road. Safety issues FRPD Chief Richard Furr commented that a lack of lighting along the road could lead to safety issues for foot traffic on a narrower, nonVDOT-standard temporary road, as well as an increase in criminal activity under cover of darkness. Like a dog with a bone he has become exceptionally fond of, Councilman Sayre seemed mostly concerned that temporary or not, the road have bike paths included in its design. Hopping on safety questions, new Councilman Daryl Funk reiterated concerns he has brought to council prior to his May election and July taking of office. Funk worried over an increase in vehicular traffic through the residential Kerfoot area. He noted his and other family members homes along Kerfoot, saying, The only reason I can vote on it is it affects a lot

and others also suggested speed concerns could be addressed with a lower speed limit and intermittently posted Stop signs as are currently positioned on Virginia Avenue, a residential street that currently sees some of the thru-town traffic avoiding the towns two main north-south thoroughfares, Royal and Commerce Avenues. However, Funk suggested it might also be advisable to wait for a developer to move on a permanent road, saving the town the expense of developing the temporary connector. From here to there I say get the process started, Bret Hrbek countered of the connector road the town has put $150,000 aside for over the past two years. Of waiting for a full release of the property by the EPA, Hrbek joked, My kids might see it I was in high school when Avtex closed. Mayor Darr then summarized the apparent consensus, scheduling one more work session before scheduling approval of a resolution by council on the majority desire of how to proceed. That consensus appears to include Tewalts idea to bypass (pun intended) a traffic flow study suggested by the town manager in favor of mapping the roads path out. That seemed to make sense after EDA Director McDonald told council the EPA appeared ready to release the land for the road as soon as it received a design and meeting minutes indicating the town had approved the temporary road project. Postscript: draft resolution The connector road was revisited at councils July 30 work session. A draft resolution was presented that endeavored to show the town was committed to maintaining safety through the Kerfoot Avenue neighborhood despite the anticipated increase in traffic. The resolution begins by acknowledging that a connector road between Kendrick Lane and Kerfoot Avenue is mandated for development of the Royal Phoenix Business Park and the immediate need to facilitate a safer traffic path for pedestrians, bicyclists and pedestrians (they might add skateboards) from Royal Village to the north and the skatepark-Soccerplex area to the south of the future business park. Whereas the Town recognizes the connector road will result in increased traffic on Kerfoot Avenue the Town will make every effort to maintain the integrity and safety of the surrounding neighborhoods, the resolution states. Vice-Mayor Parker suggested adding increased traffic on Kendrick Lane as well. The resolution concludes by directing staff to proceed with the design and construction of the temporary connector road and directs staff to conduct a traffic safety audit to identify improvements to the Kerfoot Avenue Corridor. Town Manager Burke explained he had been informed by the EDA that the existing draft path design for the road would be sufficient for the design submission to the EPA. So, the safety audit, which he said consultant Anderson & Associates said should only take a couple weeks will become the first outstanding priority undertaken in order to move forward. And while the resolution states construction of the connector road has [councils] full support, it was far from clear that construction of a temporary connector road had such unanimous support. Burke acknowledged that Councilman Funk had submitted a list of 11 specific safety issues he would like addressed prior to a vote of approval. And it appeared that Councilman Tewalt may have tilted back toward his initial opposition of funding a temporary road. However, pending an early letter of no further interest from the EPA and an EDA announcement a developer had a purchase and development contract poised for signing upon the EPA release, it seems moving on the temporary road has a slim 4- or

mayoral tiebreaking vote of support if necessary. The split appears to be Parker, Hrbek, Tharpe and Sayre for; Funk and Tewalt against. Though there is always a chance the mercurial Sayre might shift to a vote against were bike paths excluded from the design, as it seems likely they would be in the narrow-lane design of the temporary road. In fact, one safety measure suggested to slow traffic down was a narrowing of the 15-foot lanes to 11 feet at some residential intersections along Kerfoot. While some might question the advisability of intentionally making the road more dangerous in order to make it safer, it was commented that motorists instinct was to slow down when presented with a driving situation that would be more dangerous to maintain higher speeds in. It was observed that each sheriff s office would be responsible for maintaining a local lockup and for the transport of inmates back and forth. But this has been known from early in the process, so comes as no surprise. As for staffing transitions, both of local personnel and newly hired RSW staff, the importance of hiring, training and certification prior to the scheduled July 014 RSW Jail opening was stressed. Transition Committee Chairman and Warren County Sheriff Danny McEathron said it would be each sheriff that determines which members of their staffs would be transferred to the regional jail. It was commented that Shenandoah has a different training academy than Rappahannock and Warren, so assurances of similar standards would be one issue to overcome. We dont want to reinvent the wheel. We want to find out whats worked elsewhere and not make the same mistakes that may have been made there, McEathron said. Shenandoah County Sheriff Tim Carter noted that each sheriff had full plates and that the additional responsibility for transitioning should be minimized by the timely hiring of the regional jail superintendent. I think it is important the superintendent is hired sooner than later, Carter said. Asked what the timeline for that key hire was, McEathron replied the rough timeline had the superintendent hired a year prior to the opening (July 013). It is a daunting task for the superintendent to see the transition is smooth. We dont want to set them up for failure, Carter said in suggesting an earlier hire.

By Roger Bianchini Warren County Report On July 6 members of the RSW Regional Jail Authority met twice, in subcommittee and full authority, to discuss the coming 014 transition from three county jails to one regional facility to handle not only the participating counties inmates, but bed space permitting, rental inmates from the state or other jurisdictions facing their own overcrowding issues. First the Transition Committee comprised of the three involved sheriffs and one member of the Rappahannock, Shenandoah and Warren County Boards of Supervisors. The major issues facing the three law enforcement agencies and their inmate housing departments is facilitating a smooth shift to a single inmate housing facility. ning, so we will spare you that detail (for those wishing that detail, the full financial report is available through the RSW Authority or the county board representatives to the authority. Again, while the costs are significant, for Warren County at least, it has been repeatedly asserted that had the county proceeded alone to build a new jail to deal with existing inmate overcrowding issues the costs to county taxpayers would have been even greater an estimated $31 million, or $1-million per year over the 30-year life of a bond issue. However, it appears that calculation was made on construction of a new jail that would totally replace the countys existing facility, rather than just expand its existing housing capacity. And it is such variables, as well as Shenandoah County Sheriff Tim Carters stated belief throughout the study process that the regional concept was not the most cost efficient for his department and county, that is fueling the ongoing opposition to the RSW Jail approval and financing processes.

Nice deign or not, Shenandoah Countys Mark Prince announced a lawsuit challenging the county financing process for the RSW Regional Jail during full authority meeting of July 26.
Discussion indicated a possible recommendation of a superintendent hire as early as 18 months out by the committee to the full authority, which has the decision-making power. McEathron agreed with Carters overview and acknowledged the hiring process, including RFPs for candidates should be quickly determined to facilitate a possible hire as early as January-February 013, just six or seven months away. Challenges The 1 p.m. RSW Transition Committee meeting was followed by a 3 p.m. meeting of the full RSW Authority, also at the Warren County Government Center where the authority generally meets (I guess everyone is gearing up for those drives to WC). That meeting opened with public comments from two Shenandoah County citizens deeply involved in ongoing opposition to the regional jail. That opposition is centered on challenges of the local approval processes of individual county funding contributions to the jail. First, Cindy Bailey of Woodstock reiterated questions about the timing and detail of the funding processes of the three involved counties. Bailey pointed to what she termed rising costs and county officials agreeing to commit large sums of taxpayer money over the 30-year life of the bond issue paying the local shares of construction of the jail. Bailey blasted the RSW Authority for published remarks attributed to various county officials raising the possibility of lawsuits against citizens involved in a threatened legal challenge of the regional jail bond issue. There has been no dialogue on any of this, Bailey said of county interactions with citizens. She also claimed a majority of Shenandoah County taxpayers dont want to pay for these capital improvements period! Next up was Mark W. Prince, who introduced himself as the person who had filed a lawsuit against the jail bond issue and local funding. Prince said his suit was based on the fact no county had a voter referendum on the long-term funding of this capital improvement, as he believes is required by state law (see follow up story on legal dynamics of legal challenge in next issue). Financing Perhaps appropriately, Davenport & Associates bond consultant Vice President Ted Cole followed the public comments with a Financial Report update on funding of the jail. What led to comments about potential lawsuits being filed by either counties or the authority against citizens involved in legal threats against the jail, was a $1.3 million increase in the RSW bond issue from a higher interest rate due to a one-week delay when the state issuing agency VRA separated the RSW issue from a block issue of all state bond issues it was participating in. That separation was made due to concerns over the threatened litigation. RSW Authority Chairman and Warren County Administrator Doug Stanley told us Warren Countys additional cost from that higher interest rate is $750,000.

Despite the higher costs due to the delay from the separation of the RSW bond, as we understood his presentation Coles new figures reflect significant savings from the planning model used over the past year due to a favorable overall downturn in interest rates in the struggling U.S. economy. An initially forecast gross debt service of $153.79 million has been reduced to an actual gross debt service of $1.75 million, a $3-million savings. The corresponding net debt service was reduced from $105.07 million to 79 million, a savings of $6.07 million. The state contribution, calculated at up to 50 percent of the actual construction cost of about $68 million, increased slightly from the planning model number of $3.63 million to $3.84 million. That the state contribution through the Department of Corrections (DOC) isnt actually 50 percent of either actual costs or bond issue and interest payments is but one sticking point for the Shenandoah-based opposition. While there were myriad other variables, including access to interest for investment, maximum allowable interest income, administrative fee payments, and Treasury bond investment options on portions of the bond issue, those left our heads spin-

Baird acquitted of attempted capital murder and wounding


Jury decides truck ramming of deputy vehicle part of drunken suicide gone wrong
jail before being released April 17 to the custody of his parents due to speedy trial statutes, Baird was credited with time served and released after a mandated DNA test following his convictions. Baird faced a possible maximum five years in prison on the eluding charge or the maximum fine with which he was hit, and up to 1 months in jail, which would have left him with two weeks to serve had the jury gone that way. Baird was accompanied by four family members, his parents and a younger and older man. His family declined comment following the verdicts. Asked if his son would comment, Bairds father said, I would recommend against it, but he is a grown man perfectly capable of making his own decisions. After a thoughtful pause, Baird told us, Im just happy with the verdict and look forward to starting my life over. Where that new life will center was unclear. However, it was apparent from defense attorney comments in the courtroom that, that life will be without his wife, though defense attorney Scott C. Hook told the court Baird hoped to reestablish a relationship with his children. By court order, Baird has lived with his parents in Arizona after his speedy trial statute release from Warren County Jail on April 17. Bairds legal troubles evolved out of apparent marital and emotional difficulties. At the time, a WCSO press release stated, on May 4, 011, at approximately 1:39 a.m. an attempt to locate bulletin was received from Fauquier County for a suicidal subject operating a blue GMC pick-up truck. According to WC Sheriff McEathron, deputies searched for the vehicle and located it at approximately 3:06 a.m. parked in a pull-off in the area

By Roger Bianchini Warren County Report After a two-day trial, a 46-yearold Fauquier man was acquitted on charges of attempted capital murder and attempted malicious wounding of two Warren County Sheriff s Office deputies, Joshua Noland and Robert Mummau. However, Tony L. Baird was convicted on July 31 of felony destruction of property and felony eluding of police officers. A seven-woman, five-man jury took just 90 minutes to return the verdicts and then another 1 minutes to return with sentences on the two convictions. Those sentences were a maximum $500 fine on the felony destruction of property damage to a WCSO vehicle Baird rammed with his truck on May 4, 011 and a maximum $,500 fine on the felony eluding conviction. Baird was also sentenced to 90 days in jail on the eluding charge. However, having spent 11 months and two weeks in

of Highway 340 south and Chapman Farm Road. Deputies made contact with the subject who was non-compliant. The subject proceeded to put his vehicle in reverse and ram one of the officers cruisers as the deputy was partially out of the vehicle. The subject then refused to stop and proceeded toward the second department vehicle as the deputy stood beside it. The deputy discharged his weapon at the individual and the subject proceeded to flee before his vehicle came to rest approximately 00 yards south after striking a large rock formation. Deputies, assisted by Virginia State Police and Front Royal Police, were able to remove the subject from the vehicle without further incident. Rescue personnel were called and transported the subject to Winchester Medical Center with a gunshot wound to the area of his right arm. He was later transported to UVA Hospital in Charlottesville. Suicide by cop Assistant Commonwealths Attorney Nick Manthos argued that unable to follow through on his second known suicide threat Manthos described an earlier incident in which Baird put a gun to his head and threatened to shoot himself in his home, in front of his wife Baird plotted to draw officers into a confrontation in which he hoped to be shot and killed. During closing arguments Manthos recounted Baird telling his wife he was going to commit suicide the night of May 3-4, that he was going to fly that night by jumping off a bridge that turned out to be the Gooney Creek Bridge in Warren County, some 40 minutes from his Fauquier home. Manthos pointed to subsequent phone conversations with his wife after he left her home, saying where he was and where he was going. Manthos asserted that Baird knew police were in contact with his wife and would be listening in on those calls. or James Bond fiction However, lead defense attorney Hook called the prosecution theory a James Bond scenario They dont know what his intent was, so they throw everything in there: he was going to kill himself; he was going to kill the cops; he was going to get them to kill him. Tonys intent was to jump off that bridge and kill himself. Why would he have a long, elaborate plan, drive up to Front Royal and leave subtle clues over the phone to his wife it doesnt make sense. Manthos and Hook argued over Bairds level of intoxication and how it might have impacted his actions that night. There seemed agreement that Baird appeared to have bought a fifth of Makers Mark whiskey and said he drank half of it after not having drank in two years. His BAC (bloodalcohol-content) was later measured at .163, about twice the legal limit for driving. Hook said his clients ramming of Deputy Joshua Nolands vehicle where literally the actions of a blind drunk blind not only by his heavy alcohol consumption, but by the lights of the deputies vehicles shining at him on a dark, rainy night in a remote, rural location. Hook pointed to his clients words as deputies approached Baird after he was shot and wrecked his truck at the scene Let me die, Baird was reported to have said after his violent encounter with the two WCSO deputies. Manthos countered that Bairds memory lapses about the night were all convenient to what was best for his defense. Pooooor Tony, Manthos said in mimicking the defense closing argument that Bairds actions were those of a desperate and religious man driven to a suicidal brink by a loss of control of his life and his family. In the end the jury seemed to agree with the defense, even asking if they could recommend mandated psychological counseling as part their sentencing recommendation. Unfortunately, as Judge Dennis L. Hupp explained after the jury completed its deliberations, that was not an option in these criminal cases. Hook said he was not sure if Baird had been getting psychological counseling since released to the custody of his parents in Arizona. During discussion of a 30-day suspension of his Virginias drivers license as part of his sentence, Judge Hupp asked Baird if he planned going back out west. Bairds reply, I had not planned on it, sir, was somewhat vague as to where he hopes to pick up the pieces of his life and move forward. Hook told reporters he did not know his clients post-release plans, but observed that Baird no longer has a home in this area.

Baird appeared emotionally overcome at times during recesses in the proceedings, sighing deeply at times and seeming near tears at others. But he seemed to be getting strong emotional support from his four-person family support group, including his Arizona-based parents. When Judge Hupp calculated the total amount of Bairds fines and court costs at $5,71, Bairds father stated he was immediately prepared to pay that total. But with the hour after 5 p.m. and the clerks office closed for business, it was determined the payment would be made to Bairds attorney, who would forward it to the court. An additional $5 calculated for the DNA test didnt seem a deterrent to his parents plan to quickly pay and end their sons legal experience. And with that payment, a troubling episode in several peoples lives will come to a legal end. That it is hoped from a variety of directions that it will also come to a positive emotional end was illustrated in Virginia State Police Officer Eric Deels comment to Baird as the defendant reflected head down, alone on a gallery bench after the verdicts came in and the jury had retired for sentencing deliberations. Good luck, pal, Deel said as he patted Baird sympathetically on the back.

AT Community awards first Questing Prizes


Committee, Questing was launched at the communitys designation day festival on April 1. Five-year-old Alex Ichiuji, a student at Mountain Laurel Montessori completed the Quests with his parents Melissa and Doug. When asked about his favorite, Alex says, The one where we walked all the way through the woods to the swimming holes. (Thompson Hollow Quest, designed by Girl Scout troop 40333). Alex, who plans to put his patch on his daypack, adds, I saw waterbugs and tadpoles! And the highlight of any hike: bear poop! Alex also liked the Battle of Front Royal Quest designed by the Warren Heritage Society: The big cannon at the Confederate museum was huge! I saw it and said, Whoa! About the Downtown Architecture Quest designed by Maggie Sill of the Heaven Sent Shoppe for Downtown Front Royal, Melissa Ichiuji adds, I was amazed to learn so much about the historical buildings right downtown. Structures that I pass everyday are so rich with history. Cindy Courtney and her children, Nathan and Madison not only completed the five Quests but also designed a new one, the Hemlock Hollow Trail Quest at Shenandoah River Raymond R. Andy Guest State Park. Well be launching the Courtneys quest at RiverFest on August 11, says Appalachian Trail Community steering committee member Jennifer Keck, also an event organizer. It was just a lucky coincidence that their Quest is located at Andy Guest, where Riverfest will take place. The Appalachian Trail Community Committee will have a booth where people can buy passports and make stamps of their own. By designing the first new Quest beyond the inaugural five, the Courtneys have also won a one-night stay at Skyland Lodge in the Shenandoah National Park, courtesy of ARAMARK and the Front Royal/Warren County Appalachian Trail Community program. To earn their patches, the Questers purchased Questing passports for one dollar at the Front Royal/Warren County Visitors Center and downloaded the Quests from www. discoverfrontroyal.com. To win the patches, Questers completed all five of the qualifying Quests by finding the hidden treasure box at the end of each walk. As proof of completion, Questers stamp their passports with the stamps found in each treasure box (and leave their own unique stamp behind in the log book). By Kevin S. Engle Warren County Report When someone gives you a check, what do you do with it? This is not a trick question. Do you cash it? Maybe you deposit it into your account? Its what I do. I think its what most people do. But not the people who get checks from me. They obviously arent most people. For some reason, they hang on to them like its a collectors item. Why? Im not sure. Maybe they like my handwriting? Maybe they forgot I gave it to them? Maybe they lost it? Maybe they think its going to bounce? Maybe they dont know where their bank or ATM is? Maybe they dont need it? Maybe they want to get under my skin, like a tick? Whatever the answer is, I cant figure it out. I currently have five outstanding checks. Ones from a month ago, two are two months old, one is from 11 months ago and one is from several years ago, but that one doesnt count. I gave it to a nephew when he graduated from high school. I made it out for a penny. It was a joke. He liked it and decided to hang on to it. Thats fine. My account balance will always be a penny off, and I know why. The ones that are a month and two months old, I can let slide. For now. The one that bothers me the most is the check from eleven months ago. Last year, the recipient of this check celebrated the birth of a child. My wife and I sent the new parents money for the baby. That baby just celebrated his first birthday, yet neither mom or dad have made it to the bank. Three months after I sent it, when I saw that it still hadnt been cashed, I reminded dad about it. He assured me he or the Mrs. would take care of it. At this point, I dont know if my bank will even honor it. I asked recently and the teller said they typically wont cash checks that are more than six months old. If they wont cash this one, and a part of me is hoping thats the case, I wont be writing another one to replace it. And that one month old check? Guess who it went to? Same guy. I had no choice. I had some family business to take care of. I shouldnt let it bother me, but it does. Its one of those little things that irritates you, like getting blackberry seeds stuck between your teeth. At least with those, a piece of floss takes care of the problem. I wish that were the case here. My wife says to forget about it. She says Ill feel better if I do. Of course shes right, and Im trying. But every month, when my bank statement arrives, Im reminded about it again. And now that Im thinking about it, I just checked my account on line. Guess what? They STILL havent cashed it! Amazing! Incredible! I only have one thing to say. CASH THE DAMN CHECK! Ahhhhhhhhhhhhhh! That felt good to get off my chest. Im a new man. At least until the next bank statement gets here. $$$$$$$$$$$$$$$$$$$$$$$$$$$ If theres another baby, there wont be another check. And you can take that to the bank. kevinengle456@comcast.net

Romney appraisal: Underprepared Not quite & that is unfortunate
By Dave Zirin Reprinted by permission So much for that shared Anglo Saxon heritage. Mitt Romney is getting roasted across the British press and political establishment for arriving on the shores of the United Kingdom armed with a critique of Londons capacity to host the 01 Olympic Games. In a moment displaying a political ear made of the finest tin, Romney told NBCs Brian Williams, Its hard to know just how well it will turn out. There are a few things that were disconcerting: the stories about the private security firm not having enough people, supposed strike of the immigration and customs officials, that obviously is not something which is encouraging. Now newspapers and politicians from across the political spectrum are making Mitt Romney look less presidential and more like a wellcoiffed punching bag. The last time an American has been beaten so badly by Brits, Bob Fitzsimmons was knocking the stuffing out of Jack Dempsey. Of all the insults he endured in the press, none is quite as memorable as the Daily Mail headline, Devoid of charm, offensive and a wazzock: Romneys disastrous day in London after saying he didnt know if Olympics would be a success. (A wazzock is an idiot or a daft person in Brit-speak.) Even Tory Prime Minister David Cameron got into the act, smacking down Romneys experience organizing the Salt Lake City 00 Winter Games by saying tartly, We are holding an Olympic Games in one of the busiest, most active, bustling cities anywhere in the world. Of course its easier if you hold an Olympic Games in the middle of nowhere. The biggest issue is neither the gaffe nor the demonstrable fact that Romney is in fact a wazzock. Its that he is dead wrong about the UKs preparedness, and this is actually unfortunate. The UK is not under-prepared but over-prepared. I was in London in May and want to share what over-prepared means. Over-prepared means that cameras are absolutely everywhere. Over-prepared means more troops on the ground than the UK has ever had in Afghanistan. Overprepared means a gunship in the Thames, efforts to attach missiles to the roofs of residential apartment buildings, and the use of unarmed surveillance drones. Over-prepared means hundreds of members of the brand-police making sure that no one is using the symbol of the Olympic rings unlawfully or drinking the wrong soft-drink or wearing something with a Nike swoosh (Adidas is the official sponsor after all). Over-prepared also means the harassment of peaceful protests. As Jules Boykoff wrote, [Scotland Yard] highlighted four key risks to the Gamesterrorism, protest, organized crime, and natural disasters. Singling out protest as a threat and then sandwiching it between terrorism and organized crime was revealing. For political activists it was ominous. Security officials should most assuredly do their best to prevent acts of terrorismthats their jobbut this does not give them carte blanche to conflate activism with terrorism and criminality. Keeping the Games safe from terrorism is one thinggreen lighting the squelching of individual freedoms and human rights is another entirely. Yes, Mitt Romney humiliated himself by suggesting that the UK is under-prepared. He also showed that he doesnt realize or care that the over-preparedness on naked display comes at the cost of civil liberties and personal freedom and the expansion of militarism of our daily lives, three issues that are clearly very low on his personal priority list. For the people of the UK, these issues matter. Which is why protesters gathered on July 8, at Mile End Park in defense of the very human rights the presence of the Olympics disrupts. I think all the cameras missed that event. Heres also wishing best of luck to the Romney familys personal Olympic Dressage Horse Rafalca, in her quest for gold. Not prepared!?! Londons Olympic Police State


Welcome to the London Olympics Drones, Missiles, and Gunships, Oh My!
By Dave Zirin Reprinted by permission As many as 48,000 security forces. 13,500 troops. Surface to air missiles stationed on top of residential apartment buildings. A sonic weapon that disperses crowds by creating head splitting pain. Unmanned drones peering down from the skies. A safezone, cordoned off by an 11 mile, electrified fence, ringed with trained agents and 55 teams of attack dogs. One would be forgiven for thinking that these were the counter-insurgency tactics used by U.S. army bases in Iraq and Afghanistan, or perhaps the military methods taught to third world despots at the School of the Americas in Ft. Benning Georgia. But instead of being used in a war zone or the theater of occupation, they in fact make up the very visible security apparatus in London for the 01 Summer Olympics. London, which has the most street cameras per capita of any city on earth, has for the last seven years since the terror attacks of 7/7/05, been a city whose political leaders would spare no expense to monitor its own citizens. But the Olympic operation goes above and beyond anything weve ever seen when a Western democracy hosts the games. Not even China in 008 used drone planes or ringed the proceedings with a massive, high-voltage fence. But here is London, preparing a counter insurgency, and parking an aircraft carrier right in the Thames. Here is London adding scanners, biometric ID cards, number-plate and facial-recognition CCTV systems, disease tracking systems, new police control centers and checkpoints. Stephen Graham at the Guardian refers to the entire state of affairs as Lockdown London as well as the UKs biggest mobilization of military and security forces since the second world war. He is not exaggerating in the slightest. The number of troops will ex-ceed the forces the UK has had in Afghanistan. Its not just the costs or the incredible invasion into peoples privacy. Its the powers being given to police under the 006 London Olympic Games Act which empowers not only the army and police, but also private security forces to deal with security issues using physical force. These security issues have been broadly defined to include everything from terrorism to peaceful protesters, to labor unions, to people selling boot-leg Olympic products on the streets, to taking down any corporate presence that doesnt have the Olympic seal of approval. To help them with the last part, there will be brand protection teams set loose around the city. These teams will also operate inside Olympic venues to make sure no one wears clothes or accessories with commercial messages other than the manufacturers who are official sponsors. Olympics sponsorship has become a full-throttle, corporate cornucopia. London Games sponsors include icons of health and fair play like McDonalds, British Petroleum and Dow Chemical. In the name of good health, McDonalds is handing out activity toys for kids to play with after munching down their Happy Meals. BP is - no joke - an official sustainability partner. Dow Chemicals prominent presence is a slap in the face to Londons large South Asian population, given the notorious gas disaster in Bhopal, India, that killed more than 0,000 people and left hundreds of thousands more suffering in its wake. In 1999, Dow Chemical merged with Union Carbide, the US firm responsible for the Bhopal nightmare. The security operation also means the kind of street harassment of working class youth that will sound familiar here in the United States. As the Guardian reported, Officers have powers to move on anyone considered to be engaged in antisocial behaviour, whether they are hanging around the train station, begging, soliciting, loitering in hoodies or deemed in any way to be causing a nuisance. Not to shock anyone, but there are no signs that any of the security apparatus will be dismantled once the Olympics are over. Local police forces have just been given an inor-dinate number of new toys and the boxes have been opened, the receipts tossed away. London will be left with a high tech police force, terrible debt, high-

The only people who will leave this party enriched will be the private security industry who will tout the peace as their personal accomplishment, en-couraging more of the global 1% to get more guards, more walls, and more separation from the great unwashed masses. There is no reason that the Olympics have to be this way. There is no reason that an international celebration of sports particularly sports more diverse than our typical high-carb diet of football, baseball, basketball, and more football cant take place without drones and aircraft carriers. There is no reason athletes from across the globe cant join together and showcase their physical potential. But the Olympics arent about sport any more than the Iraq War was about democracy. The Olympics are not about athletes. And theyre definitely not about bringing together the community of Nations. They are a neo-liberal Trojan Horse aimed at bringing in business and rolling back the most basic civil liberties. In many ways, this is what the games have always been. From Hitlers Berlin Olympics in 1936, to the slaughter of students in 1968 in Mexico City, to the Gang Sweeps in Los Angeles in 1984, to Beijings mass displacement of citizens in 008, the crackdown has always been a part of the Olympic games. But in the post 9/11 world, the

stakes are even higher to expose this for what it is. The Olympics have become the spoonful of sugar to help the medicine down, and the medicine is that our elected leaders have seen the enemy, and it is all of us. (Managing editors note: and Mitt thought London wasnt prepared one can only wonder (and worry) at what his idea of preparedness is? As for the IOCs branding police, since this column on the run up to the London Olympics was written their actions included demands a London butcher shop remove the 5 sausages hung in the shape of the Olympic rings from its window and that a London restaurant remove a flaming Olympic torch breakfast special from its menu. Failure to comply would result in 0,000 pound (about $31,500 in U.S. dollars) fines being levied against the offending businesses for copyright infringement of Olympic symbols. So much for getting into the spirit of the games.)

Burrell motions hearings set for Aug. 7 and Sept. 19


Officer attacker was on probation for earlier scuffle with law enforcement
charge that was nul prossed; the 011 assault on an officer conviction; and the new revocation request filed July 31. Burrell told the court during questioning about his ability to pay for legal council that he received $00 a month in assistance, though he did not elaborate on the source of that assistance (see related story). During his July 31 court appearance, Burrell Jr. was restrained, answering questions briefly and quietly. A toxicology report on Burrell Jr. the night of his assault on Sgt. Courtney is pending. However, we have learned the initial report Courtney and Lethcoe were responding to of a man exposing himself to passing motorists near the North Shenandoah Avenue-14th Street intersection included the observation the man appeared to be intoxicated. Not likely to get bond Asked if he wanted to proceed immediately to argue probable cause in the motion to revoke, newly-appointed defense counsel Olien told the court he would first like time to familiarize himself with the new charges against his client before arguing revocation due to them. Judge Hupp commented to Olien, Considering the nature of the new charges it is unlikely he will get bond. As reported elsewhere in this issue, Burrell is charged with attempted capital murder in the attack on Sgt. Courtney in the early evening hours of Saturday, July 8, as well as malicious wounding of Courtney and two counts of assault and battery, one on Courtney and one on FRPD Detective Jason Lethcoe who was the second officer on the scene during the attack on Courtney. We did find out from FRPD Chief Richard Furr that Boone, Courtneys K-9 partner, was in the back of the departments K-9 officers car at the time of the July 8 attack. Unfortunately, due to training parameters the FRPD K-9 unit is not issued an auto-release button for that vehicle that allows remote opening of the rear door where K-9 dogs travel with their human partners. We asked the chief, who is retiring at the end of this month, if Boone had torn the back of the car up in anger and frustration while witnessing his partner being attacked by the 5-11, 88-pound Burrell. He was pretty excited, Furr replied succinctly of Boones reaction to the scene.

By Roger Bianchini Warren County Report After the jury in the Tony Baird trail went into deliberations at :50 p.m. on July 31, the man charged in the July 8 attack on Front Royal Police Sgt. Bryan Courtney was in Warren County Circuit Court on a probation revocation hearing. Commonwealths Attorney Brian Madden asked Judge Dennis L. Hupp to revoke Clyde Eugene Burrell Jr.s probation on a 011 charge, perhaps ironically, also involving an assault on a law enforcement officer. After establishing that Burrell qualified for a court-appointed attorney and recruiting William Olien of the Winchester Public Defenders office who was present in the courtroom, a hearing date of Aug. 7 on the 9 a.m. docket was set to hear arguments on the commonwealths revocation motion. A September 19 date in Warren County General District Court is set for a bond and motions hearing on the new charges stemming from the July 8 attack on the FRPD officer. The most recent and most serious charges Burrell has ever faced are making their way through lower court at this point. The revocation request due to the new charges and the April 19, 011, assault-on-an-officer conviction for which he is now on probation, are the most recent incidents in what is now a 11-count rap sheet Burrell has in Warren County Circuit Court. Other charges include: four 1999 convictions and revocations: Petit Larceny, Attempted Grand Larceny, Violation of Probation/Attempted Grand Larceny, and Attempted Grand Larceny; a 001 Grand Larceny conviction; three 003 Grand Larceny/probation violation revocations; a July 6, 010 public intoxication

A familys perspective cries for help rejected by system


Sister says request for emergency custody order denied by magistrate on June 5
County Jail in an effort to get her brother detained for a psychological evaluation. Hes been getting worse. I begged her to give me an emergency custody order and she would not, Burrells sister said of her June 5 visit to the magistrates office. His mental state has been getting worse. I told her I was afraid he would have an episode and someone is going to get hurt, either him or someone else. You just dont know when hes going to have I call it a rage and just flip out. For 14 years he has been back and forth between the law and Northwestern [Community Services], she said of her brother. She said as early as February 1998, when his legal troubles began, Clyde Burrell Jr. was diagnosed as schizophrenic/ bipolar with multiple personalities. He had a mental evaluation by court order when we were living in Westminster, Md., and thats what they said. People dont know what its like to hear a family member have a conversation with himself in the living room in different voices. You dont know the impact on the family of that it is frightening, she said. I have begged and cried and pleaded for the kind of help he needs, she says. This could have all been avoided if someone would have helped. We cant be with him 4 hours a day to make sure he is taking his medication, she added. A small percentage of him knows he shouldnt be on the street, she says. To illustrate that point, she said one of his arrests occurred when he stole a candy bar from a store and then sat on the curb waiting to get arrested. Im not trying to make excuses for him. And my heart aches for that officer. I dont think I want to know the details of what happened to him, she said, trailing off.

Burrell Jr., a woman saying she was Burrells aunt told us outside the courtroom that her nephew has mental problems and has been a patient at Northwestern Community Services. She added that the family has felt Burrell Jr. hasnt gotten the degree of psychological and counseling help he needs and that the family has feared something like this could eventually happen. She also said despite Clyde Burrell Jr. giving a West 11th Street address of relatives, he is essentially indigent and homeless. Burrells sister agreed. Asking for a degree of anonymity due to publicity surrounding her brothers July 8 assault on Front Royal Police Sgt. Bryan Courtney, Burrells sister said her brother has been living on the street since around May 0. She also said as recently as June 5 she had attempted to get legal help to get her brother off the street. She said she went to the magistrates office at the Warren

was attacked by what was described as a white male in his mid 30s. A second FRPD officer, Jason Lethcoe, responded to the scene as the attack was underway and was able to pull the assailant off his fellow officer. The suspect was apprehended at the scene and is being held at Warren County Jail. According to Capt. Werner officers received some assistance at the scene from citizens passing by. Additional detail on the circumstance of the assault and the identity of the suspect is expected from FRPD later Saturday night or early Sunday. This report will be updated as information becomes available. FRPD Chief Richard Furr texted a response to our initial inquiries from Warren Memorial Hospital, where he was with his injured officer late Saturday evening. Caring, compassionate individuals needed to assist seniors in their homes. We will work with the right applicant to establish a mutually agreeable schedule that includes every other weekend. FRPD officers collect forensics evidence at scene of July 28 attack


By Roger Bianchini Warren County Report (Managing editors note: the public began learning details of the brutal attack on Sgt Bryan Courtney with this post on the Warren County Report website www.warrencountyreport.com shortly before midnight the evening of the July 28 attack.) A Front Royal Police officer is hospitalized with what are described as non-life threatening but serious injuries after being assaulted while responding to a call at 140 North Shenandoah Avenue around 7 p.m., Saturday night, July 8. According to FRPD Captain Mark Werner, Sgt. Bryan Courtney was investigating reports of a male subject walking in the area of 14th Street and North Shenandoah Avenue exposing himself in the vicinity of nearby motels. Officer assault

Cop assailant charged with attempted capital murder


Officer was responding to report of white male exposing himself to motorists
on the scene and was able to tackle Burrell getting him off of Sergeant Courtney. Lethcoe then found himself engaged in an all-out struggle with Burrell. During the struggle a citizen came to the aid of Detective Lethcoe and helped in gaining control of Burrell, which allowed Detective Lethcoe to get Burrell into handcuffs. Two other citizens then came to the aid of Sergeant Courtney rendering first aid. Corporal David Fogle arrived on scene and immediately transported Sergeant Courtney to Warren Memorial Hospital. Sergeant Bryan Courtney was hospitalized for his injuries and Detective Lethcoe was treated and released. Clyde E. Burrell Jr. was held with no bond a court date has not been set in this matter at the time of this release. Anyone with additional formation about this case is asked to contact Detective Sergeant Jason Ryman at the Criminal Investigation Division of the Front Royal Police Department at (540) 636-08 or the Front Royal Police Department Dispatch Center at (540) 635-111. We at Warren County Report wish Sgt. Courtney a speedy and complete recovery and thank Det. Lethcoe and those citizens who became involved in subduing the subject and first offering the officer medical assistance on site, as well as Cpl. Fogle for his quick reaction in getting Sgt. By Roger Bianchini Warren County Report About 1 p.m., Sunday, July 9, the Front Royal Police Department issued a press release detailing the attack on Sgt. Bryan Courtney 19 hours earlier near the intersection of 14th Street and North Shenandoah Avenue. Captain Mark Werner said that despite the severity of Sgt. Courtneys injuries, it was hoped he could be released from Warren Memorial Hospital later on Sunday (Courtney was released on Monday, July 30), just a day after what could have been a fatal attack but for the arrival of a second officer and the assistance of citizens in subduing the suspect and aiding Officer Courtney at the scene. According to FRPD the suspect, 33-year-old Clyde Eugene Burrell Jr. is 5-foot-11, 88 pounds with an extensive criminal rap sheet. The press release states: Chief Richard H. Furr has announced the arrest of Clyde Eugene Burrell Jr., white male, 33 years of age, of what was reported as a West 11th Street address in Front Royal, Virginia. Burrell has been charged with one count of Attempted Capital Murder of Front Royal Police Sergeant Bryan Courtney; one count of maliciously causing bodily injury to Front Royal Police Sergeant Bryan Courtney; and two counts of assault and battery to Sergeant Bryan Courtney and Detective Jason Lethcoe, knowing that such persons were law enforcement officers. On July 8, at 6:36 p.m. the Front Royal Police Department received a call from a citizen that a white male subject was in the area of North Shenandoah Avenue exposing himself to passing motorists. Officers responded to the area and began a search for this subject. At 6:4 p.m. Sergeant Courtney radioed that he may have the subject in the area of 140 N. Shenandoah Ave. As Sergeant Courtney exited his vehicle Clyde E. Burrell Jr. viciously attacked Sergeant Courtney, during the attack Burrell slammed Sergeant Courtneys head into the pavement multiple times and raked his fingers through Sergeant Courtneys eyes. As Sergeant Courtney continued to fight for his life Burrell gained control of Sergeant Courtneys expandable baton and commenced to beat Sergeant Courtney, striking him in his face, arms and the back of his head. Sergeant Courtney was able to get on his back with Burrell on his chest and grab the expandable baton, as he and Burrell were struggling for control of the baton Burrell ripped the baton from Sergeant Courtneys hands. As Burrell drew back the baton to again strike Sergeant Courtney, Detective Jason Lethcoe arrived

Fire & Rescue and Community Room signs, I circled like a rat lost in a rather impressive, if stark maze. I was finally rescued by a passing worker who pointed out a wall phone by the large Sheriff s Office window. Ah, just like the now largely abandoned Jackson Street WCSO facility I was finally in automated contact with real staff. I announced my  p.m. with the sheriff and shortly was passing the Dailys Joe Beck on the way out as Sheriff McEathron greeted me. Hi Joe, bye Joe. Geez Danny, youre running us in and out of here on a tight schedule, I joked. Your turn you want the full tour? There is a lot to see, the sheriff offered. Boy, he wasnt kidding. But rather than try and describe it, well just let the photos do the talking. Obviously were very, very pleased with what weve been provided, the sheriff said of the new facility. I want to thank the board of supervisors and county administrator, but most importantly the citizens of Warren County. We dont lose sight of the fact it is the citizens and taxpayers of the county that are providing this for us. As I asked the sheriff for a final shot out front and he asked if I wanted him to get the fire chief. Well I saw a couple fire trucks out front but I only saw boxes on their side are they up here too? I asked. The sheriff assured me Chief Richard Mabie and his gang were also aboard, and returned shortly with the emergency services chief in tow. After a photo or two, Chief Mabie assure me he and his department are pretty happy as well. The public safety building accommodates two county administrative departments that were bursting at

By Roger Bianchini Warren County Report Having received a July 31 press release announcing the relocation of the Warren County Sheriff s Office administrative offices, including civil, investigations and patrol divisions, to the new county Public Safety Building at 00 Skyline Vista Drive, directly across from Skyline High School, I wandered over after scheduling a visit with Sheriff McEathron the following afternoon. I correctly took a guess that the main public entrance was up the hill at the south entrance near the main Skyline High building and parked to discover reserved favored parking spaces for both energy efficient and car pool vehicles all of which were unoccupied around  p.m. that Tuesday afternoon. I then wandered toward the closest door, carefully skirting a worker on a ladder cleaning the opposite side of tall glass inside doors. Seeing no people behind Sheriff Office, County

Center, the sheriff estimated around 38,000 s.f. for his department. The sheriff s office will maintain a presence at its old location at 3 East Jackson Street to facilitate supervision of the county jail across Jackson Street. The old administrative building will also be used for storage by WCSO. A low-bid construction contract of $10,549,000 was awarded to Nielsen Builders of the Harrisonburg area in August 010. A bond issue of $7.5 million was used to complete financing. A significant portion of an estimated $7-million so-called windfall from the first June tax payments after the county adopted twice-a-year tax billing was earmarked to the project, to reduce the necessary bond issue. The county also had set aside $981,000 for the project prior to its final 010 approval. While the county-contractor relationship was often strained due to issues with adhering to design standards both outside and inside the building, all involved appear relieved that despite delays and redoes on some work, the project is finally completed. The administrative and departmental staff move is phase one of a major shift in housing and operations for county law enforcement. Despite ongoing opposition largely based in Shenandoah County, including a lawsuit filed claiming irregularities in how funding appropriations were made by participating county governments, the RSW Regional Jail is

under construction and expected to open in July 014. The regional jail in the countys northside off Route 5, will then house inmates from Warren, Shenandoah and Rappahannock Counties. After the RSW Jail opens, the old jail is initially forecast for use primarily as a holding facility for inmates headed to court next door.

Thinking out of the box Darr, Funk explain proposals


Considered: landed gentry and potential turnovers of entire councils at once
the pair of public servants were having dissociative moments, perhaps brought on by a sudden drop in blood sugar levels. OR -- wondering First Mayor Darr dropped the idea that a charter change might limit runs for elected public office in the town to those who pay taxes. With the type of taxes yet specified, Vice-Mayor Shae Parker asked if a Winchester resident came to Front Royal, bought a meal here and paid the town meals tax, would they be eligible to run for office? The mayor explained that he was speaking of less point-specific taxes than that, gradually seeming to land at real estate taxes. Another reporter present leaned over to me and quipped, Well, it used to be like that only the rich, white land owners could vote, in the early days of America. As the bad kids in the back row of class, or actually the front row in this case, absorbed this potential return to a much more conservative America though that would seem hardly possible in the current national political climate a veritable uproar from the meeting table erupted. The consensus of that uproar was that such a restrictive criteria of eligibility to run for town office was certainly not legal at least not yet. Im not saying its legal I was just throwing it out for discussion. If its not legal, fine, its done, Darr said, tactically retreating. Rolling 7 lucky or not? As the room recovered from that proposal, Funk threw out a second heady proposal that the town abandon staggered elections and go to a system in which all six councilman and the mayor all faced re-election at

the same time. A reaction similar to the one the mayor had just faced then erupted. Easing into the discussion, it was pointed out that with the mayor being elected to two-year terms, the strategy of putting the entire town government up for election every four years wouldnt work. Funk quickly countered by suggesting the mayor also be elected to a four-year term. Eugene Tewalt, who has both won and lost elections for both mayor and council here, seemed to sum up the council consensus that the potential of losing all elective experience at once was too great a risk. The county used to do it that way and they went the other way to avoid losing all that experience at one time, Tewalt told his colleagues. Funk seemed unconvinced, stating that one way or the other the town needed to pursue improving its voter turnout. Granted, but why trying to accomplish that by rolling the electoral dice on an entire elected body, risking the increasingly mercurial and often fickle mood of the electorate on any given Tuesday, would be a better plan than changing the existing system from May to November, is still not clear to this observer. We later called Funk to discuss his proposal. He explained his proposal would be tied to November elections held only in presidential election years. The rationale is that then you have all town officials elected in cycles with the highest voter turnout, in Warren County usually 60 to 70 percent in presidential years. Otherwise half your council would be elected in maximum turnout years and half in cycles with about half that turnout, Funk explained. Well, even half in the off years recently 35 to 40 percent here is twice what town May elections have seen since 000 an average 15 to 0 percent voter turnout, we offered. As for the potential of a complete turnover of elected officials, Funk asked, Why not? Thats how democracy is, if your goal is to have a true

democratic process, why not? he reiterated. We countered again, this time that America is, after all not a true democratic system. It was made a Republic with elected officials separated from ebbs and flows in the public mood by the distance between elections. I see validity on both sides of the argument. But if your goal is to get closer to a maximum turnout for everybody, again I ask, why not? Funk concluded. Okay, November, presidential years, that makes more sense; if still

Darr said yes, he was talking about restricting runs for office to property owners paying real estate taxes in town. The mayor pointed out that appointed planning commission members currently were required to be property owners in town to qualify for that appointment. His rationale, Darr said, was that since council, and the mayor in the event of tie votes, were required to consider tax hikes in the budget process, real estate being the largest source of personal tax payments and municipal revenue gathered from the public; would someone who does not pay those taxes have the same discretion in pondering large real estate tax increases that would not effect them personally. Im just saying that you should have a vested interest in taxpayers interests to make tax decisions, Darr explained. I was just throwing out suggestions. The Belle Boyd Cottage, originally located behind the Fishback Hotel (currently the Second Chance store) on Main Street was preserved by moving it to Chester Street. Belle was a Confederate spy during the Civil War for Stonewall Jackson at the age of 17. Located behind the Belle Boyd Cottage is the Laura Virginia Hale Archives which allows individuals to research an expansive collection of historical buildings, maps, documents, photos, and genealogy. By Ken Thurman Warren County Report Caretakers for 5 years of Front Royal history dating back to 1787 and over 175 years of Warren County history, the Warren Heritage Society (WHS) plays a vital role in preserving our past for future generations. I spoke with Susan Jeffery, the business manager for the Society, on my path to this weeks discovery. Founded in 1971, the Societys mission is to create and enhance an awareness of Warren County heritage through preservation and education. Today, the society offers a variety of facilities and capabilities including a museum, a gift shop, an archive, the Belle Boyd Cottage, and the Balthis House. The WHS is headquartered at 101 Chester Street in Front Royal at the Ivy lodge which also houses the museum and the gift shop. The museum features permanent exhib-

History

Civil War 150th Committee launches Wapping Heights initiative


What began at Gettysburg ended at Front Royal! The Battle of Manassas Gap or Wapping Heights, as it was known locally, will be the subject of a new interpretive Virginia Civil War Trails sign to be erected in Linden during the 150th anniversary commemoration of the Gettysburg Campaign in 013. Fought during the return trek from Gettysburg by Robert E. Lees Army of Northern Virginia on July 3, 1863 this battle has come to be known as the Blackberry Affair. The Front RoyalWarren County Civil War Sesquicentennial (150th) Committee is sponsoring the fundraising kick-off for Virginia Civil War Trails interpretive markers and signs commemorating the Battle of Wapping Heights, AKA Manassas Gap. The committees mission is to partner with local tourism industry and businesses to promote the observance of the 150th Anniversary of the American Civil War in the Northern Shenandoah Valley of Virginia and specifically events that took place locally in Front Royal and Warren County. The Wapping Heights/Manassas Gap effort is the latest of those efforts. These endeavors are meant to establish a lasting tribute to the people of Warren County and the Town of Front Royal, whose stories tell of the suffering, turmoil and sacrifices made during that momentous period of our history. Wapping Heights history The Union commander of the Army of the Potomac, General George G. Meades strategy was to penetrate the principle route of retreat of Lees tired and beleaguered troops and split it in two. He may have underestimated their obstinacy and resilience to press on with the fight. Meanwhile, General Lee and his staff were in Front Royal on July nd, visiting the Buck family at Bel-Air after being invited to stretch their limbs and drink fresh buttermilk. While the Confederate Corps of Generals James Longstreet, A. P. Hill and Richard S. Ewell moved their artillery and wagon trains of wounded soldiers down the Valley from the north into the Town and through Chester Gap and the turnpike to Luray. The Union Cavalry under General Wesley Merritt and the a badly beaten Third Corp Infantry under General William H. French, known to his troops as Old Blinky, were commanded by General Meade to move up through the Manassas Gap and, if practicable, attack the Confederates. The day of the battle was hot and dry and the Third Corps, 1st and nd Division of Berdans U. S. Sharpshooters were observed by an officer of Meades Army eating the blackberries that grew wild on the rocky hills and crags of Manassas Gap east of Linden Station. The officer who was foreign and most likely of German origin stated, Mein Gott! Vat kind of men have we got up dere to pick blackberries on dere skirmich line?! And so started the battle that became known, not so much for its scale and intensity of combat, as for the characters and stories of its impact on the citizens of the hamlets of Linden Station and Wapping; and for the final escape of the Army of Northern Virginia during the retreat from Gettysburg through the village of Front Royal. root systems of nearby trees. The feeder roots of many trees are not far below the ground surface, even for big established trees, and go out laterally well beyond the drip line of the canopy. They can be severed, crushed, or critically compressed by the heavy machinery. Since construction, your trees are probably responding to this disruption to their root systems. It might take a couple years to see how this will play out on your big, older trees, depending on the extent of the root disturbance. There are a variety of options in this situation. First, you can do nothing and just let nature take its course if you judge that the trees are far enough from the house and only moderate damage was done to the roots. Like your human body, trees have a remarkable ability to heal themselves when subjected to many types of damage. A more proactive approach would be taking special care to encourage regrowth of the feeder roots. Keep them watered during dry spells. Remove all grass and groundcovers from under the canopy so the tree does not have to compete for water and nutrients. This will promote root regrowth in the upper soil layers. Add -4 inches of mulch under the canopy to add organic matter to the soil, encouraging earthworms and other beneficial soil mechanisms. Dont pile mulch against the base of the trunk. Begin the mulch layer a couple inches out from the trunk to avoid harboring small animals and other organisms detrimental to the tree. Good luck, Harry. Im with you on your efforts!
