Heritage Trust The Jamaica National Heritage Trust Development: The alteration, removal, repair, restoration or demolition of or addition to, any national monument; The carrying out of building, engineering or other operations in, on, over or under any national monument or making of any material change in the structure, appearance or use of any such national monument. Maintenance Includes the fencing, repairing and covering of a national monument and the doing of any other act or thing which may be required for the purpose of repairing the national monument or protecting it from decay or injury, and the expression “maintain” shall be construed accordingly. National Monument Any building, structure, object or other work of man or of nature or any part or remains thereof whether above or below the surface of the land or the floor of the sea within the territorial waters of the Island or within the exclusive economic zone; Any site, cave or excavation, or any part or remains thereof, declared by the Trust to be a national monument. Protected National Heritage Any place name; Any species of animal or plant life; Any place or object (not declared by the Trust to be a national monument), designated by the Trust to be a protected national heritage JAMAICA NATIONAL HERITAGE TRUST The Trust shall consist of fifteen members: The Government Town Planner, the Commissioner of Lands, Chief Executive Officer of the Trust (ex-officio) members. The Institute of Jamaica The Jamaica Historical Society The Jamaica Archaeological Society The University of the West Indies The Jamaica Institute of Architects Seven other appointed members. FUNCTION OF THE TRUST To promote the preservation of national monuments and anything designated as protected national heritage for the benefit of the Island; To conduct such research as it thinks necessary or desirable for the purposes of the performance of its functions under the Act; FUNCTION OF THE TRUST To carry out such development as it considers necessary for the preservation of any national monument or anything designated as protected national heritage; To record any precious objects or works of art to be preserved and to identify and record any species of botanical or animal life to be protected. Protection of National Monuments & National Heritage The Trust may declare to be a national monument any structure the preservation of which is, in the opinion of the Trust, a matter of public interest by reason of the historic, architectural, traditional, artistic, aesthetic, scientific or archaeological interest Protection of National Monuments & National Heritage The Trust shall, in each year, cause to be published in the Gazette a list of all national monuments in the Island for the time being declared by the Trust The Trust shall cause to be placed on a conspicuous pat of each national monument included in the list a mark identifying the monument Protection of National Monuments & National Heritage Where any structure is declared a monument the trust shall notify the Registrar of Titles (ROT) of any registered titles known to the Trust to be affected by the declaration. The ROT shall forthwith note on those titles the fact of the declaration Protection of National Monuments & National Heritage The Trust shall notify the Deputy Keeper of the Records of any monument the title of which is not under the Register of Titles Act Compensation Where the owner of a declared national monument or a designated national heritage suffers financial loss as a result of the declaration or designation, the owner shall be entitled to receive compensation as may be appropriate Protection from Disrepair Where the Trust is of the opinion that action should be taken to prevent a national monument or protected national heritage from falling into disrepair, it shall be lawful for the Trust: To notify the person in possession of the need of repair To provide assistance as may be necessary To maintain the heritage or monument Owner of Monument or Protected Heritage Person in possession of: A monument shall not demolish, remove or alter any monument or carryout development without prior written approval of the Trust A protected heritage demolish, remove or alter it without the prior written approval of the Trust Owner of Monument or Protected Heritage Any one who contravenes Section 16(1) shall be guilty of an offence and shall be liable on conviction to a fine or imprisonment or both.
