The Hon. Rep. Lois Capps 301 E. Carrillo St., Suite A Santa Barbara, Calif. 93101

Congresswoman Capps: ! Please consider this letter of opposition to H.R. 3261, the so-called Stop Online Piracy Act under consideration in the House Judiciary Committee. ! To get right to the point: SOPA would be catastrophic for my company and our employees. Under this legislation, Noozhawk and other independent, professional online-only news sites would be placed at extreme risk for nancial retribution, economic ruin and criminal charges even if we unwittingly stumble into copyright infringement, regardless of the validity of the claim. ! I believe this bill is needless and unconstitutional, and it attempts to legislate a remedy to a problem that can be best addressed and is by the marketplace of ideas and creativity. ! For a more comprehensive case against this legislation, please allow me to include my column on SOPA, which was posted today on Noozhawk. (http://www.noozhawk.com/article/122511_bill_macfadyen_why_noozhawk_opposes_sopa_an d_why_you_should_care/) ! ! Please call me with any specic questions you may have. Thank you. ! ! ! ! ! Cordially,
