AN ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE


TOWNSHIP OF EWING, COUNTY OF MERCER, STATE OF NEW JERSEY, AMENDING,
CHAPTER 15, THE LAND DEVELOPMENT ORDINANCE TO INCLUDE THE
RECOMMENDATIONS OF THE PLANNING BOARD PURSUANT TO THE LAND USE
ELEMENT OF THE MASTER PLAN ADOPTED FEBRUARY 22, 2006

WHEREAS, on February 22, 2006, the Township of Ewing Planning Board adopted the
“Ewing Township Master Plan” dated February 6, 2006 (the “Plan”); and,

WHEREAS, certain rezoning recommendations were made in the Land Use Element of
the Plan, including:

Rezoning the site located on the corner of Phillips Boulevard and Lower Ferry Road,
known as Block 225.01, Lots 2, 3, 4, and 5 from Industrial Park (IP-1) to Residential
Multi-Family Elevator (RME); and

Rezoning of properties along Parkside Avenue, known as Block 193.06, Lots 9 and 2 and
Block 186, Lots 1 through 9 from Professional, Research, Office (PRO) to Residential
Multi-Family (RM); and,

WHEREAS, other recommendations included revisions to existing zoning districts,


amendments to Section 15-8, the definitional section of the Land Development Ordinance, and
the establishment of a floor area ratio standard, as briefly set forth below and described further
herein:

Amending the permitted principal uses of the Residential Multi-Family with Elevators
District (RME) to include apartments in non-elevator buildings not exceeding three (3)
stories in height;

Amending the permitted principal uses of the Residential Multi-Family District (RM) to
include townhouses;

Amending the lot, area, yard, height, density and coverage requirements section of the
Residential Multi-Family District (RM) to include height and gross density requirements
for apartments and townhouses;

Adding the definition of dwelling unit multi-family (townhouse) which shall mean a
single family attached, multi-floor unit, situated in a building of not more than three (3)
stories and forty-five (45) feet in height, and not less than three (3) units nor more than
twelve (12) units; no two (2) dwelling units served by the same exterior door, and each
dwelling unit having two points of ingress and egress; a portion of one unit may be
located over and/or share a story with another unit; and

Establish a Floor Area Ratio standard for the existing R-1, R-2, and R-3 residential zones;
and,

WHEREAS, the Planning Board found that the proposed rezoning, revision and addition
of certain districts and requirements would be substantially consistent with the Township land
use planning principals described in the Master Plan; would have substantial positive tax benefits
to the community; and would not adversely impact the zone plan; and,

WHEREAS, the Township Council accepts the Planning Board’s rezoning and revisions
as described herein; and,

NOW, THEREFORE, based upon the recommendations of the Planning Board of the
Township of Ewing and pursuant to the Master Plan as adopted February 22, 2006, BE IT
ORDAINED by the Township Council of the Township of Ewing that Chapter 15, LAND

DEVELOPMENT, of the Code of the Township of Ewing, and the Official Zoning Map of the
Township of Ewing are hereby amended and supplemented as follows:

Section 1.

The following Block and Lots shall be rezoned from the current Industrial Park (IP-1) to
Residential Multi-Family (RME):

Block Lots

225.01 2, 3, 4, and 5

The following Block and Lots shall be rezoned from the current Professional, Research, Office
(PRO) to Residential Multi-Family (RM):

Block Lots

193.06 9 and 2

186 1, 2, 3, 4, 5, 6, 7, 8, and 9

Section 2. The Township of Ewing Land Development Ordinance, Chapter 15, should be
amended as follow:

§ 15-8. DEFINITIONS.

Dwelling Unit Multi-Family (Townhouse) shall mean a single family attached, multi-floor unit,
situated in a building of not more than three (3) stories and forty-five (45) feet in height, and not
less than three (3) units nor more than twelve (12) units; no two (2) dwelling units served by the
same exterior door, and each dwelling unit having two points of ingress and egress; a portion of
one unit may be located over and/or share a story with another unit.

§ 15-12. SCHEDULE, AREA, YARD AND BUILDING REQUIREMENTS

Amend schedule to include Floor Area Ratio standards established below for R-1, R-2, and R-3
zones.

§ 15-17A.1. Permitted Principal Uses.

a. Apartments in elevator building regulated by a condominium association, or rental units.

b. Apartments in non-elevator buildings not exceeding three (3) stories in height.

Section 3. This Ordinance shall take effect after final publication according to law.

STATEMENT

This Ordinance amends the Revised General Municipal Ordinances of the Township of Ewing to
adopting the rezoning and revisions recommended in the Land Use Element of the Ewing
Township Master Plan as adopted February 22, 2006.
