HaMishpat
The case of self-immolated, social protest activist Moshe Silman was one of the earliest cases,
handled in Net HaMishpat - the Tel-Aviv District Court's first electronic record system. The case
highlights the lack of validity and integrity of the system, and ways in which it facilitates the
conduct of simulated litigation in the Court .
Jerusalem, December 5 - the case of the self-immolated, social protest activist Moshe Silman
exposes the conduct of simulated litigation in the Tel-Aviv District Court. It is also one of the
earliest cases, handled in Net HaMishpat - the Court's new case management system.
Is it only a coincidence?
Although the system dates back to 2003, the Tel-Aviv District Court was one of the last courts of
the State of Israel, where the system was implemented. Case no. 1617-08, opened on June 3,
2008, is probably the earliest case. Silman's case number is 1752-08 , opened on July 3, 2008
(according to Net HaMishpat listing, but probably earlier).
Abundant evidence of erroneous of falsified court records are found in preliminary review of
early files of the Tel Aviv District Court in Net HaMishpat:
- Index discrepancies show invalid, false index:
Numerous court files numbers, which were presumably opened during the inspected period,
are missing from the index as "paper files". File numbers are out of sequence, and invalid
file numbers appear in the index. A court file appears under the file number index (1680-08),
which fails to appear in the opening date index, and the opposite a court file appears in the
opening date index (32056-08 - June 15, 2008; 3541-08 July 8, 2008), but fails to appear in
the file number index.
- Numerous decision records are false, misfiled, and/or falsified court orders:
Back-dated, filed under wrong file number, handwritten, unrecorded orders, records that are
not authentic court records, records that are not the original record filed under the same
notation, etc.
- Decision records show variation in invalid signature execution:
No signature, scanned hand-signature, electronic graphic image none of them valid
electronic signatures, pursuant to the Electronic Signature Act (2001) of the State of Israel.
Electronic signatures were implemented in the system, pursuant to the Electronic Signature
Act (2001), but kept invisible, hidden from the public.
Silman v Bituach Leumi, in the Tel-Aviv District Court was one of the earliest cases in Net
HaMishpat in the Tel-Aviv District Court, The case is replete with falsified court records from
the start:
- The original complaint was filed under case number (13491/2008), which now the office of
the clerk claims never existed.

First decision, dated July 10, 2008, lists on its face the "Legal Unit" of the Court as the
adjudicating authority, with no name of an individual or a signature. Elsewhere it is listed as
a decision by Magistrate Eitan Orenstein. The decision was registered under case number
13491/2008. This decision record is a falsified court record.
Two records, both listed as decisions, dated November 19, 2009, by Magistrate Hagai
Brenner are not authentic court records. These records are falsified court records.
Later, "post-it" decisions, which are listed in the case management system of the Court, fail
to appear in the online public access system.
Eventually, Magistrate Hagai Brenner affected the closing of the complaint file. Pro tem District
Judge Hagai Brenner affected the closing of the appeal, which originated in Magistrate Brenner's
decision.
Review of the early records in Net HaMishpat in the Tel Aviv District Court, documents features
of the system, which must never be permitted in an honest, valid electronic record system of any
court. The review also shows how such features, when permitted, facilitate the conduct of
simulated litigation Fraud on the Court.
A plausible explanation for the blatant fraudulent nature of the records in Silman's case is that
with transition of a file, which was opened as a paper file, to the electronic record system, older
methods of simulated litigation (e.g., running parallel, invalid file indices) had to be replaced
with newer methods (e.g., filing simulated decision records, using hidden signatures). In the
transition period, both methods were unusually exposed.

Net HaMishpat.
- Other query parameters were kept constant: Old File, Tel Aviv District Court, civil case.
- The initial query outcome screen was copied and printed below.
- Initial survey showed that the first civil case in the Tel Aviv District Court is 1617-08,
opened on June 3, 2008. Consequently, additional case numbers from 1600s to 1700s were
examined. (Silman's case is 1752-08).
