AN ACT toregulatetheoperationofcabletelevisionnetworksinthecountryandfor mattersconnectedtherewithorincidentalthereto. BEitenactedbyParliamentintheFortysixthYearoftheRepublicofIndiaas follows. CHAPTERI PRELIMINARY 1.Shorttitle,extentandcommencement. (1)ThisActmaybecalledthe CableTelevisionNetworks(Regulation)Act,1995. (2)ItextendstothewholeofIndia. (3)Itshallbedeemedtohavecomeintoforceonthe29thdayofSeptember, 1994. 2.Definitions.InthisAct,unlessthecontextotherwiserequires, 2 [(a) authorisedofficermeans,withinhislocallimitsofjurisdiction; (i) aDistrictMagistrate,or (ii) aSubdivisionalMagistrate,or (iii) aCommissionerofPolice, andincludesanyotherofficernotifiedintheOfficialGazette,bythe Central Government or the State Government, to be an authorised officerforsuchlocallimitsofjurisdictionasmaybedeterminedbythat Government;] 3 [(aa)] cableoperatormeansanypersonwhoprovidescableservicethrougha cabletelevisionnetworkorotherwisecontrolsorisresponsibleforthe managementandoperationofacabletelevisionnetwork; (b) cable service means the transmission by cables of programmes includingretransmissionbycablesofanybroadcasttelevisionsignals; (c) cabletelevisionnetworkmeansanysystemconsistingofasetofclosed transmission paths and associated signal generation, control and distributionequipment,designedtoprovidecableserviceforreception bymultiplesubscribers; (d) companymeansacompanyasdefinedinsection3oftheCompanies Act,1956;(1of1956).

(e) personmeans (i) anindividualwhoisacitizenofIndia; (ii) an association of individuals or body of individuals, whether incorporatedornot,whosemembersarecitizensofIndia; (iii) acompanyinwhichnotlessthanfiftyonepercentofthepaidup sharecapitalisheldbythecitizensofIndia; (f) prescribedmeansprescribedbyrulesmadeunderthisAct; (g) programmemeansanytelevisionbroadcastandincludes (i) exhibitionoffilms, features,dramas,advertisementsandserials throughvideocassetterecordersorvideocassetteplayers; (ii) any audio or visual or audiovisual live performance or presentation,andtheexpressionprogrammingserviceshallbe construedaccordingly; (h) registeringauthoritymeanssuchauthorityastheCentralGovernment may, by notification in the Official Gazette, specify to perform the functionsoftheregisteringauthorityunderthisAct; (i) subscribermeansapersonwhoreceivesthesignalsofcabletelevision network at a place indicated by him to the cable operator, without furthertransmittingittoanyotherperson. CHAPTERII REGULATIONOFCABLETELEVISIONNETWORK 3.Cabletelevisionnetworknottobeoperatedexceptafterregistration. Nopersonshalloperateacabletelevisionnetworkunlessheisregisteredasa cableoperatorunderthisAct: Provided that a person operating a cable television network, immediately beforethecommencement ofthisAct,maycontinuetodosoforaperiodof ninetydaysfromsuchcommencement;andifhehasmadeanapplicationfor registrationasacableoperatorundersection4withinthesaidperiod,tillheis registered under that section or the registering authority refuses to grant registrationtohimunderthatsection. 4. Registration as cable operator.(1) Any person who is operating or is desirousofoperatingacabletelevisionnetworkmayapplyforregistrationasa cableoperatortotheregisteringauthority. (2)Anapplicationundersubsection(1)shallbemadeinsuchformandbe accompaniedbysuchfeeasmaybeprescribed. (3)Onreceiptoftheapplication,theregisteringauthorityshallsatisfyitself thattheapplicanthasfurnishedalltherequiredinformationandonbeingso satisfied,registertheapplicantasacableoperatorandgranttohimacertificate ofsuchregistration: Provided that the registering authority may, for reasons to be recorded in writingandcommunicatedtotheapplicant,refusetograntregistrationtohimif

itissatisfiedthathedoesnotfulfiltheconditionsspecifiedinclause(e)ofsection 2. 4 [4A. Transmissionofprogrammesthroughaddressablesystem,etc. (1) Where the Central Government is satisfied that it is necessary in the public interesttodoso,itmay,bynotificationintheOfficialGazette,makeitobligatory foreverycableoperatortotransmitorretransmitprogrammeofanypaychannel throughanaddressablesystemwitheffectfromsuchdateasmaybespecifiedin thenotificationanddifferentdatesmaybespecifiedfordifferentStates,cities, townsorareas,asthecasemaybe. (2)IftheCentralGovernmentissatisfiedthatitisnecessaryinthepublic interestsotodo,itmay,bynotificationintheOfficialGazette,specifyoneor morefreetoairchannelstobeincludedinthepackageofchannelsformingbasic servicetierandanyormoresuchchannelsmaybespecified,inthenotification, genrewise for providing a programme mix of entertainment, information, educationandsuchotherprogrammes. (3)TheCentralGovernmentmayspecifyinthenotificationreferredtoinsub section(2),thenumberoffreetoairchannelstobeincludedinthepackageof channels forming basic service tier for the purposes of that subsection and differentnumbersmaybespecifiedfordifferentStates,cities,townsorareas,as thecasemaybe. (4)IftheCentralGovernmentissatisfiedthatitisnecessaryinthepublic interest so to do, it may, by notification in the Official Gazette, specify the maximumamountwhichacableoperatormaydemandfromthesubscriberfor receivingtheprogrammestransmittedinthebasicservicetierprovidedbysuch cableoperator. (5) Notwithstanding anything contained in subsection (4), the Central Governmentmay,forthepurposesofthatsubsection,specifyinthenotification referredtointhatsubsectiondifferentmaximumamountsfordifferentStates, cities,townsorareas,asthecasemaybe. (6)Notwithstandinganythingcontainedinthissection,programmesofbasic servicetiershallbereceivablebyanysubscriberonthereceiversetofatype existing immediately before the commencement of the Cable Television Networks(Regulation)AmendmentAct,2002withoutanyaddressablesystem attachedwithsuchreceiversetinanymanner. (7) Every cable operator shall publicise, in the prescribed manner, to the subscribers the subscription rates and the periodic intervals at which such subscriptions arepayableforreceivingeachpaychannelprovidedbysuchcable operator. (8)Thecableoperatorshallnotrequireanysubscribertohaveareceiversetof aparticulartypetoreceivesignalsofcabletelevisionnetwork:

Providedthatthesubscribershalluseanaddressablesystemtobeattachedto hisreceiversetforreceivingprogrammestransmittedonpaychannel. (9)EverycableoperatorshallsubmitareporttotheCentralGovernmentin theprescribedformandmannercontainingtheinformationregarding (i) thenumberoftotalsubscribers; (ii) subscriptionrates; (iii) number of subscribers receiving programmes transmitted in basic servicetierorparticularprogrammeorsetofprogrammestransmitted onpaychannel; in respect of cable services provided by such cable operator through a cable television network, and such report shall be submitted periodically at such intervalsasmaybeprescribedandshallalsocontaintherateofamount,ifany, payablebythecableoperatortoanybroadcaster. Explanation.Forthepurposesofthissection, (a) addressable system means an electronic device or more than one electronicdevicesputinanintegratedsystemthroughwhichsignalsof cabletelevisionnetworkcanbesentinencryptedorunencryptedform, whichcanbedecodedbythedeviceordevicesatthepremisesofthe subscriberwithinthelimitsofauthorisationmade,onthechoiceand requestofsuchsubscriber,bythecableoperatortothesubscriber; (b) basicservicetiermeansapackageoffreetoairchannelsprovidedbya cableoperator,forasinglepricetothesubscribersoftheareainwhich hiscabletelevisionnetworkisprovidingserviceandsuchchannelsare receivableforviewingbythesubscribersonthereceiversetofatype existingimmediatelybeforethecommencementoftheCableTelevision Networks(Regulation)AmendmentAct,2002withoutanyaddressable systemattachedtosuchreceiversetinanymanner; (c) channel means a set of frequencies used for transmission of a programme; (d) encrypted,inrespectofasignalofcabletelevisionnetwork,meansthe changingofsuchsignalinasystematicwaysothatthesignalwouldbe unintelligible without a suitable receiving equipment and the expressionunencryptedshallbeconstruedaccordingly; (e) freetoairchannel,inrespectofacabletelevisionnetwork,meansa channel, the reception of which would not require the use of any addressablesystemtobeattachedwiththereceiversetofasubscriber; (f) paychannel,inrespectofacabletelevisionnetwork,meansachannel thereceptionofwhichbythesubscriberwouldrequiretheuseofan addressablesystemtobeattachedtohisreceiverset.]

5.Programmecode.Nopersonshalltransmitorretransmitthroughacable service any programme unless such programme is in conformity with the prescribedprogrammecode: [****] 6.Advertisementcode.Nopersonshalltransmitorretransmitthrougha cableserviceanyadvertisementunlesssuchadvertisementisinconformitywith theprescribedadvertisementcode: 6 [****] 7.Maintenanceofregister.Everycableoperatorshallmaintainaregisterin theprescribedformindicatingthereininbrieftheprogrammestransmittedorre transmittedthroughthecableserviceduringamonthandsuchregistershallbe maintained by the cable operator for a period of one year after the actual transmissionorretransmissionofthesaidprogrammes. 7 [8.Compulsory transmission ofDoordarshan channels (1)Every cable operator shall, from the commencement of the Cable Television Networks (Regulation) Amendment Act, 2000, retransmit at least two Doordarshan terrestrialchannelsandoneregionallanguagechannelofaStateintheprime band, in satellite mode on frequencies other than those carrying terrestrial frequencies. (2) The Doordarshan channels referred to in subsection (1) shall be re transmittedwithoutanydeletionoralterationofanyprogrammetransmittedon suchchannels.] 9. Use of standard equipment in cable television network. No cable operatorshall,onandfromthedateoftheexpiryofaperiodofthreeyearsfrom the date of the establishment and publication of the Indian Standard by the BureauofIndianStandardsinaccordancewiththeprovisionsoftheBureauof IndianStandardsAct,1986,useanyequipmentinhiscabletelevisionnetwork unlesssuchequipmentconformstothesaidIndianstandard: 8 [Providedthattheequipmentrequiredforthepurposesofsection4Ashallbe installed by cable operator in his cable television network within six months

fromthedate,specifiedinthenotificationissuedundersubsection( 1)ofthat section,inaccordancewiththeprovisionsofthesaidActforsaidpurposes.] 10.Cabletelevisionnetworknottointerferewithanytelecommunication system.Every cable operator shall ensure that the cable television network beingoperatedbyhimdoesnotinterfere,inanyway,withthefunctioningofthe authorisedtelecommunicationsystems. CHAPTERIII SEIZUREANDCONFISCATIONOFCERTAINEQUIPMENT 11. Power to seize equipment used for operating the cable television network. 9[(1) If any authorized officer has reason to believe that the provisionsofsection3,10[4A],5,6or8havebeenorarebeingcontravenedby any cable operator, he may seize the equipment being used by such cable operatorforoperatingthecabletelevisionnetwork.] (2)Nosuchequipmentshallberetainedbytheauthorisedofficerforaperiod exceedingtendaysfromthedateofitsseizureunlesstheapprovaloftheDistrict Judge,withinthelocallimitsofwhosejurisdictionsuchseizurehasbeenmade, hasbeenobtainedforsuchretention. 12.Confiscation.Theequipmentseizedundersubsection(1)ofsection11 shall be liable to confiscation unless the cable operator from whom the equipmenthasbeenseizedregistershimselfasacableoperatorundersection4 withinaperiodofthirtydaysfromthedateofseizureofthesaidequipment. 13. Seizure or confiscation of equipment not to interfere with other punishment.Noseizureorconfiscationofequipmentreferredtoinsection11 orsection12shallpreventtheinflictionofanypunishmenttowhichtheperson affectedtherebyisliableundertheprovisionsofthisAct. 14.Givingofopportunitytothecableoperatorofseizedequipment. (1) Noorderadjudicating confiscation oftheequipment referredto insection12 shall be made unless the cable operator has been given a notice in writing informing him of the grounds on which it is proposed to confiscate such equipmentandgivinghimareasonableopportunityofmakingarepresentation inwriting,withinsuchreasonabletimeasmaybespecifiedinthenoticeagainst theconfiscationandifhesodesiresofbeingheardinthematter:

Providedthatwherenosuchnoticeisgivenwithinaperiodoftendaysfrom thedateoftheseizureoftheequipment,suchequipmentshallbereturnedafter theexpiry ofthat periodtothecableoperatorfromwhosepossession itwas seized. (2)Saveasotherwiseprovidedinsubsection(1),theprovisionsoftheCode of Civil Procedure, 1908 (5 of 1908) shall, so far as may be, apply to every proceedingreferredtoinsubsection(1). 15. Appeal.(1) Any person aggrieved by any decision of the court adjudicatingaconfiscationoftheequipmentmaypreferanappealtothecourtto whichanappealliesfromthedecisionofsuchcourt. (2) The appellate court may, after giving the appellant an opportunity of beingheard,passsuchorderasitthinksfitconfirming,modifyingorrevisingthe decisionappealedagainstormaysendbackthecasewithsuchdirectionsasit maythinkfitforafreshdecisionoradjudication,asthecasemaybe,aftertaking additionalevidenceifnecessary. (3)Nofurtherappealshalllieagainsttheorderofthecourtmadeundersub section(2). CHAPTERIV OFFENCESANDPENALTIES 16.PunishmentforcontraventionofprovisionsofthisAct .11[1]Whoever contravenesanyoftheprovisionsofthisActshallbepunishable, (a) forthefirstoffence,withimprisonmentforatermwhichmayextendto twoyearsorwithfinewhichmayextendtoonethousandrupeesor withboth; (b) foreverysubsequentoffence,withimprisonmentforatermwhichmay extendtofiveyearsandwithfinewhichmayextendtofivethousand rupees. 12 [(2)NotwithstandinganythingcontainedintheCodeofCriminalProcedure, 1973(2of1974),thecontraventionofsection4Ashallbeacognizableoffence underthissection.] 17.Offencesbycompanies.(1)WhereanoffenceunderthisActhasbeen committed by a company, every person who, at the time the offence was committed, was in charge of, and was responsible to, the company for the conductofthebusinessofthecompany,aswellasthecompany,shallbedeemed to be guilty of the offence and shall be liable to be proceeded against and punishedaccordingly: Provided that nothing contained in this subsection shall render any such personliabletoanypunishment,ifheprovesthattheoffencewascommitted

withouthisknowledgeorthathehadexercisedallduediligencetopreventthe commissionofsuchoffence. (2)Notwithstandinganythingcontainedinsubsection(1),whereanyoffence under this Act has been committed by a company and it is proved that the offencehasbeencommittedwiththeconsentorconnivanceof,orisattributable toanynegligenceonthepartof,anydirector,manager,secretaryorotherofficer ofthecompany,suchdirector,manager,secretaryorotherofficershallalsobe deemedtobeguiltyofthatoffenceandshallbeliabletobeproceededagainst andpunishedaccordingly. Explanation.Forthepurposesofthissection, (a) Company means any body corporate and includes a firm or other associationofindividuals;and (b) directorinrelationtoafirmmeansapartnerinthefirm. 18.Cognizanceofoffences.Nocourtshalltakecognizanceofanyoffence punishableunderthisActexceptuponacomplaintinwritingmade 13[byany authorizedofficer.]. CHAPTERV MISCELLANEOUS 19.Powertoprohibittransmissionofcertainprogrammesinpublicinterest. Where14[anyauthorizedofficer],thinksitnecessaryorexpedientsotodoin the public interest, he may, by order, prohibit any cable operator from transmitting or retransmitting 15[any programme or channel if, it is not in conformity with the prescribed programme code referred to in section 5and advertisement code referred to in section 6 or if it is] likely to promote, on groundsofreligion,race,language,casteorcommunity oranyotherground whatsoever, disharmony or feelings of enmity, hatred or illwill between differentreligious,racial,linguisticorregionalgroupsorcastesorcommunities orwhichislikelytodisturbthepublictranquillity. 20. Power to prohibit operation of cable television network in public interest. 16[1]WheretheCentralGovernmentthinksitnecessaryorexpedient sotodoinpublicinterest,itmayprohibittheoperationofanycabletelevision networkinsuchareasasitmay,bynotificationintheOfficialGazette,specifyin thisbehalf.

21.Applicationofotherlawsnotbarred. TheprovisionsofthisActshallbe inadditionto,andnotinderogationof,theDrugsandCosmeticsAct,1940,(23 of 1940.) the Pharmacy Act, 1948, (8 of 1948.) the Emblems and Names (PreventionofImproper Use)Act,1950,(12of1950.)theDrugs(Control)Act, 1950,(12of1950.)theCinematographAct,1952,(37of1952.)theDrugsandMagic Remedies(ObjectionableAdvertisements)Act,1954,(21of1954.)thePrevention ofFoodAdulterationAct,1954,(37of1954.)thePrizeCompetitionsAct,1955, (42of1955.)theCopyrightAct,1957,(14of1957)theTradeandMerchandise Marks Act, 1958, (43 of 1958) the Indecent Representation of Women (Prohibition)Act,1986(60of1986.)andtheConsumerProtectionAct,1986.(68 of1986). 22.Powertomakerules. (1)TheCentralGovernmentmay,bynotification intheOfficialGazette,makerulestocarryouttheprovisionsofthisAct. (2) In particular, and without prejudice to the generality of the foregoing power,suchrulesmayprovideforalloranyofthefollowingmatters,namely, (a) the form of applicationand thefee payableunder subsection (2) of section4; 17 [(aa) the manner of publicising the subscription rates and the periodical intervalsatwhichsuchsubscriptionsarepayableundersubsection(7) ofsection4A; (aaa) the form and manner of submitting report under subsection (9) of section 4A and the interval at which such report shall be submitted periodicallyunderthatsubsection;] (b) theprogrammecodeundersection5; (c) theadvertisementcodeundersection6; (d) theformofregistertobemaintainedbyacableoperatorundersection 7; (e) anyothermatterwhichisrequiredtobe,ormaybe,prescribed. (3)EveryrulemadeunderthisActshallbelaid,assoonasmaybeafteritis made,beforeeachHouseofParliament,whileitisinsession,foratotalperiodof thirtydayswhichmaybecomprisedinonesessionorintwoormoresuccessive sessions, and if, before the expiry of the session immediately following the sessionorthesuccessivesessionsaforesaid,bothHousesagreeinmakingany modificationintheruleorbothHousesagreethattheruleshouldnotbemade, theruleshallthereafterhaveeffectonlyinsuchmodifiedformorbeofnoeffect, asthecasemaybe;so,however,thatanysuchmodificationorannulmentshall bewithoutprejudicetothevalidityofanythingpreviouslydoneunderthatrule. 23.Repeal and savings.(1) The Cable Television Networks (Regulation) Ordinance,1995isherebyrepealed.
