October 30, 2012 Meeting with City of Rockford Holly, Charlie, Todd, Marcy Holly and Charlie met with Todd and Marcy from the City of Rockford to discuss the responsibilities and expectations of Lot 193. The City is not interested in assuming ownership of Lot 193. The Citys definition of maintenance for lot 193 o o o o mow the lot keep it free of debris (includes grass clippings, leaves, sod, etc.) look for gopher/mole holes that could lead to erosion keep the culvert / drain located in the southwest corner of the lot free of debris

The City recognizes that Lot 193 provides drainage for areas beyond our subdivision. o o If there is a natural disaster or major flooding that requires a significant cost, they are open to helping us navigate cost-sharing solutions, potential grants and federal assistance. The City has stepped up their inspection of common lands (Lot 193) in the City. They are looking for erosion, dumping, clippings, etc. Marcys department will inform the HOA if there are additional things for us to do or things to look for to continue maintaining the property.

The trees located on Lots 181 and 166 are located wholly within the properties. They are not City trees, nor are they common trees. The Rockford School District owns the adjacent lot in the southwest corner. We could explore transferring the property to the School District. The Plat indicates a city easement for a pedestrian pathway (i.e. bike path) through Lot 193. The Plat indicates that no permanent structures may be placed in Lot 193. If the HOA is interested in placing play equipment or something similar in Lot 193, the City would work with the HOA to determine what would be appropriate and not affect the natural flow of stormwater. In subdivisions similar to ours, it is common to have the developer (McKiski) transfer ownership of Lot 193 to the HOA. Sometimes this is done when the subdivision is at 50% or 75% complete; however there is no standard or requirement.
