ANACTPROVIDINGFOR,AMORERESPONSIVEANDCOMPREHENSIVEREGULATIONFOR THE PRACTICE, LICENSING, AND REGISTRATION OF ELECTRICAL ENGINEERS AND ELECTRICIANS BeitenactedbytheSenateandHouseofRepresentativesofthePhilippinesinCongressassembled: ARTICLEI TITLEANDDEFINITIONOFTERMS SECTION1.Title.ThisActshallbeknownasthe"NewElectricalEngineeringLaw." SEC.2.DefinitionofTerms.AsusedinthisAct,thefollowingtermsshallmean: (a) "Practiceofelectricalengineering"apersonisdeemedtobeinthepracticeofelectrical engineeringwhenherendersorofferstorenderprofessionalelectricalengineeringserviceintheformof: (1)Consultation,investigation,valuationandmanagementofservicesrequiringelectrical engineeringknowledge (2) Design and preparation of plans, specifications and estimates for electric power systems, power plants, power distribution systems including power transformers, transmission lines and networkprotection,switchgear,buildingwiring,electricalmachines,equipmentandothers (3) Supervision of erection, installation, testing and commissioning of power plants, substations,transmissionlines,industrialplantsandothers (4) Supervision of operation and maintenance of electrical equipment in power plants, industrialplants,watercrafts,electriclocomotivesandothers (5) Supervision of the manufacture and repair of electrical equipment including switchboards,transformers,generators,motors,apparatusandothers

(6)Teachingofelectricalengineeringprofessionalsubjectsand (7) Taking charge of the sale and distribution of electrical equipment and systems requiringengineeringcalculationsorapplicationsofengineeringdata. (b) "Electric supply equipment" is any equipment which produces, modifies, regulates, or controlsthesupplyofelectricenergy. (c) "Electric plant" is an establishment or a systemfortheproductionandmodification of electricenergy. (d) "Power plant design" refers to planning, specifying, coordinating and layouting of electricalequipmentinpowerplants,substationsandthelike. (e) "Substation" is any building, room or separate place which houses or encloses electric supplyequipmentconnectedtotransmissionordistributionlinesandtheinteriorofwhichisaccessible,as arule,onlytoproperlyqualifiedpersons. (f) "Electricalsystemdesign"referstothechoiceofelectricalsystems,includingplanning and detailing of requirements for protection, control, monitoring, coordination and interlocking of electricalsystemsamongothers. (g) "Voltage"isthehighesteffectivepotentialdifferencebetweenanytwoconductorsofthe circuitconcernedexpressedinvolts. (h) "kVA" refers to the installed capacity of an alternating current (A.C.) electricplantor supply equipment, or the connected load of industrial plants, commercial establishments, institutional buildingsexpressedinkilovoltamperes. (i) "kW" refers to the installed capacity of a direct current (D.C.) electric plant on board watercraftexpressedinkilowatts. (j) "Utilizationequipment"referstoenergyconsumingequipmentincludingmotors,heaters, furnaces,lightsourcesandotherdeviceswhichutilizeelectricenergy,foranypurpose. (k) "Industrial plant or factory" refers to manufacturing assembly plants, including engineering shops, shipyards or other business endeavorswhereelectricalmachineryandequipmentare installed. (l) "Commercial establishments" are department stores, supermarkets, shopping malls, office buildings, hotels, theaters, stadiums, condominiums, convention centers, restaurants and the like, usedforbusinessorprofit.. (m) "Institutional buildings" are school buildings, hospitals, museums, display centers, governmentbuildingsandthelike. (n) "Watercraft"isanywaterborneunitwhichisdesignedandbuilttohaveanelectricplant.

(o) "Electriclocomotive"referstothepowerplantmountedonwheelsasusedintherailroad transportationindustry.

ARTICLEII

BOARDOFELECTRICALENGINEERING SEC.3. CompositionoftheBoard. TheBoardofElectricalEngineering,hereinafterreferredto astheBoard,shallbecreatedasacollegialbodyunderthegeneralsupervisionandadministrativecontrol of the Professional Regulations Commission, hereinafter called as the Commission, composed of a chairman and two (2) members to be appointed by the President of the Philippines from among the recommendeesoftheCommissioneroftheProfessionalRegulationsCommission,hereinafterreferredtoas the Commissioner, who were chosen from the nominees of the integrated and accredited association of electricalengineersandofotherregisteredassociationsofelectricalengineersandalliedfields. SEC.4.PowersandDutiesoftheBoard TheBoardshallexerciseexecutive/administrativeor quasilegislative(rulemaking)orquasijudicial(investigative)powersincarryingouttheprovisionsofthis Act.Itshallbevestedwiththefollowingspecificpowers,functions,dutiesandresponsibilities: (a) SuperviseandregulatethepracticeofelectricalengineeringinthePhilippines (b) Determine and evaluate the qualifications of the applicants for registration with or withoutlicensureexaminationsandforspecialpermits (c) PreparetheexaminationquestionsinaccordancewithSection19hereoformodifications thereof prescribe the syllabi of the subjects and their relative weights for the licensure examinations formulate or adopt test questions and deposit them in a test question bank draw the test questions at random through process of computerization conduct the examination correct and rate the examination papers manually or through process of computerization and submit the examination results to the Professional Regulations Commission (PRC) within the period provided for by the rules of the Commission (d) Prescribe, amend or revise the requirements for professional electrical engineers and subjectsinthelicensureexaminationforregisteredelectricalengineersandregisteredmasterelectricians andtheirrelativeweights,subjecttotheapprovaloftheCommission (e) Register successful applicants for professional electrical engineers and applicants who havepassedthelicensureexaminationsforregisteredelectricalengineersorregisteredmasterelectricians andissuethecorrespondingcertificatesofregistrationandprofessionallicenses (f) Issue special permits to individual foreign electrical engineers and electricians for specificprojectsandforaspecificdurationoftime (g) Look into the conditions affecting the practice of the electrical engineeringprofession, adoptmeasuresfortheenhancementoftheprofessionandthemaintenanceofhighprofessional,technical, andethicalstandardsandconductocularinspectionofplaceswhereregistrantspracticetheirprofession, such as, but not limited to: electric plants, substations, industrial plants or factories, commercial establishments,institutionalbuildings,watercrafts,electriclocomotives,engineeringoffices,repairshops andsimilarplacestodetermineandenforcecompliancewiththisAct.TheBoardshallauthorizetheduly integrated and accredited electrical engineering association and other registered electrical 'engineering associationstorenderassistanceinthisfunction (h) Promulgate rules and regulations including a code of ethics, administrative policies, ordersandissuancestocarryouttheprovisionsofthisAct (i) Investigate violations of the Act and the rules and regulations, code of ethics, administrative policies, orders and issuances promulgated by the Board. The rules on administrative investigationpromulgatedbytheCommissionshallgoverninsuchinvestigation (j) Issue subpoena or subpoena duces tecum, to secure the attendance of respondents or witnessesortheproductionofdocumentsatandrelativetotheinvestigationconductedbytheBoard

(k) Delegate the investigation of the ease to the chairman, a member of the Board or a ProfessionalRegulationsCommissionattorney(PRCattorney).Ifthecaseconcernsstrictlythepracticeof the profession, the investigation shall be presided by the chairman or a member of the Board with the assistanceofaPRCattorney (1) Render decision, order or resolution on preliminary investigation or inquiry, on undocketed cases and on docketed administrative cases against examinees or registrants which shall becomefinalandexecutoryunlessappealedwiththeCommissionwithinfifteen(15)daysfromreceiptof thecopythereof.ThedecisionoftheCommissionmaybeappealedtotheCourtofAppealsinaccordance withtheprocedureprovidedintheRulesofCourt (m) Afterduenoticeandhearing,cancelexaminationpapersand/orbaranyexamineefrom futureexaminationrefuseordeferhisregistrationreprimandtheregistrantwithsternwarningsuspend himfromthepracticeofhisprofessionrevokehiscertificateofregistrationdelisthisnamefromtheroll of professional electrical engineers, registered electrical engineers, and registeredmasterelectriciansfor continuousnonpaymentofannualregistrationfeesandnoncompliancewiththeContinuingProfessional Education (CPE)requirementsreinstateorreenrollhisnameinthesaidroll,reissueorreturnhiscertificate ofregistration.Adecisionofsuspension,revocationofthecertificateofregistration,ordelistingfromthe rollbytheBoardasprovidedherein,may beappealedinitiallytotheCommissionwithinfifteen(15)days from receipt thereof. The decision of the Commission may be appealed to the Court of Appeals in accordancewiththeprocedureprovidedintheRulesofCourt. (n) ofthisAct Administeroathsinconnectionwiththeadministration,implementation,orenforcement

(r) CoordinatewiththeCommissionandtheDepartmentofEducation,CultureandSports (DECS)inprescribing,amendingand/orrevisingthecourses (s) Prescribe guidelines and criteria on the CPE program for professional electrical engineers, registered electrical engineers and registered master electricians and renew their professional licensesaftercompliance.withtheCPErequirements (t) Perform such other functions and duties as may be necessary to implement effectively thisAct.Thepolicies,resolutions,rulesandregulations,ordersordecisionsissuedorpromulgatedbythe Board shall be subject to the review and approval by the Commission however, the Board's decisions, resolutions or orders which are not interlocutory, rendered in an administrative case, shall be subject to reviewonlyifonappeal. SEC. 5. Qualifications of Board Members. Each Board member must, at the time of his appointment: (a) Be a naturalborn Filipino citizen and a resident of thePhilippinesforatleastfive(5) consecutiveyears (b) Beatleastthirtyfive(35)yearsofage,ofprovenintegritywithhighmoralvaluesinhis personalaswellashisprofessionalconduct

Beapersonwithnofinalconvictionbythecourtofanoffenseinvolvingmoralturpitude

(d) BeaholderofthedegreeofBachelorofScienceinElectricalEngineering(BSEE) froma university, school, college, academy or institute duly constituted, recognized and accredited by the Philippinegovernment (e) Be a professional electrical engineer with a valid certificate of registration and a valid professionallicensedulyqualifiedtopracticeelectricalengineeringinthePhilippines (f) Havepracticedelectricalengineeringforaperiodofnotlessthanten(10)yearspriorto hisappointment,withaswornstatementassuchand (g) Notbeanofficialnoramemberofthefacultyof,norhaveapecuniaryinterestin,any university,college,schoolorinstitutionconferringabachelor'sdegreeinelectricalengineeringforatleast three(3)yearspriortohisappointment,andisnotconnectedwithareviewcenterorwithanygroupor association where review classes or lectures in preparation for the licensure examinations are offeredor conductedatthetimeofhisappointment. SEC.6. TermofOffice. ThemembersoftheBoardshallholdofficeforatermofthree(3)years fromthedateofappointmentoruntiltheirsuccessorsshallhavebeenappointedandqualified.Theymay, however,bereappointedforasecondterm.Eachmembershallqualifybytakinganoathofofficebefore enteringupontheperformanceofhisduties. VacanciesintheBoardshallbefilledbythePresidentfromthelistofrecommendeesselectedby theCommissionerwhowerechosenfromthelistofnomineessubmittedbytheintegratedandaccredited associationfortheunexpiredtermonly. SEC. 7. Removal of Board Members. Any member of the Board may be removed by the President of the Philippines, upon the recommendation of the Commissioner for neglect of duty, incompetence, malpractice, commission or tolerance of irregularities in the examinations, or for unprofessional, unethical, or dishonorable conduct, after having been given the opportunity to defend himselfinaproperadministrativeinvestigation. SEC.8.CompensationofChairmanandtheBoardMembers. Thechairmanandmembersofthe Board shall receive a monthly compensation of no less than Twelve thousand pesos (P12,000.00): Provided,Thatthechairmanshallreceiveamonthlycompensationoftenpercent(10%)more:Provided, further, ThatsuchcompensationshallbeincreasedormodifiedpursuanttotheGeneralAppropriationsAct oftheyear:Provided,furthermore,Thattheyshallreceiveotherbenefitsthatmaybeprovidedforbylaw. SEC.9. ExecutiveOfficeroftheBoard. TheCommissionershallbetheexecutiveofficerof theBoardandshallconducttheexaminationgivenbytheBoardandshalldesignateanysubordinateofficer of the Commission to act assecretaryandcustodianofallrecordsincludingallexaminationpapersand minutesofthedeliberationsoftheBoard. ARTICLEIII EXAMINATIONANDREGISTRATION SEC. 10. Examination Required. All applicants for registration for the practice of electrical engineering in the Philippines shall be required to pass a technical examination as hereafter provided, exceptasotherwisespecificallyallowedunderthisAct. SEC. 11. Registration and License Required. A valid certificate of registration and a valid professionallicensefromtheCommissionarerequiredbeforeanypersonisallowedtopracticeelectrical engineeringinthePhilippinesexceptasotherwiseallowedunderthisAct.

SEC. 12. Examination Fees. Allapplicationsfororalexaminationsforprofessionalelectrical engineerandwrittenexaminationsforregisteredelectricalengineerandregisteredmasterelectricianshall besubjecttopaymentoffeesprescribedbytheCommission:Provided,Thatninetypercent(90%)ofthe feesistobetreatedasaspecialfundfortheprograms,projectsandactivitiesoftheCommissionandthe remainingtenpercent(10%)shallbesetasideasatrustfundfortheestablishmentandmaintenanceofthe centerforcontinuingeducationandresearch. SEC.13.RegistrationFees,LicenseFeesandFines. Allapplicantsforregistrationandlicense to practice as professional electrical engineer, registered electrical engineer, and registered master electrician,shallbesubjecttothepaymentofregistrationfees,licensefees,andfinesincaseofviolationof the pertinent rules and regulations for the amounts prescribed by the Board and approved by the Commission:Provided,Thatfiftypercent(50%)fromthesecollectionsaretobetreatedasaspecialfund forprograms,projectsandactivitiesoftheCommissionandtheotherfiftypercent(50%)shallbesetupin aseparatespecialfundforthesupervisoryandregulatoryfunctionsoftheBoard. SEC.14.ExemptionfromExaminationandRegistration. (a)Examinationandregistrationshall not be required of foreign electrical engineers,erection/commissioning/guaranteeengineersemployedas technicalconsultantsbythePhilippinegovernmentorbyprivatefirms,forwhichthepertinentprofessional societycertifiesthatnoqualifiedFilipinoprofessionalisavailable,orofforeignelectricalinstallersforthe erection and installation of a special project or for any other specialized work, subject to the following conditions: (i) Thattheabovementionedforeignprofessionalsarelegallyqualifiedtopracticetheirprofessionin their own country in which the requirements and qualifications for obtaining a license or certificate of registrationarenotlowerthanthosespecifiedinthisAct (ii) Thatthescopeofworktobeperformedbysaidforeignprofessionalsshallbelimitedonlytothe particularworkforwhichtheywerecontracted (iii) That prior to commencing work, the foreign professionalshallsecureaspecialpermitfromthe Commission (iv)Thatsaidforeignprofessionalshallnotengageinprivatepracticeontheirownaccount (v) That for every foreign professional contracted pursuant to this section, one Filipino understudy who is registered under the provisions of this Act shall be employed by the private firm utilizing the servicesofsuchforeignprofessionalforatleastthedurationofthealienexpert'stenurewithsaidfirmand. (vi)Thattheexemptionhereingrantedshallbegoodonlyforsix(6)months,renewableforanothersix (6) months at the discretion of the Board: Provided, That in case the foreign professional ceases to be employedinaccordancewiththissectionandengagesinanoccupationrequiringregistrationaselectrical engineer,suchprofessionalmustberegisteredundertheprovisionsofthisAct. (b) NoregistrationwiththeBoardshallberequiredofthefollowing: (i) Engineering students, apprentices and other persons employed or acting as subordinates of, or undergoing training under a person holding a valid certificate of registration and a valid professional licenseunderthisAct (ii) Persons in charge of or supervising the operation, tending and maintenance of an electric generating set for private use employing voltages not exceeding two hundred fifty volts (250 V) and capacity not exceeding fifty kilovoltamperes (50 kVA): Provided, That the owneroroperatorshallberequiredtohavetheelectricgeneratingsetperiodicallyinspectedatintervalsof not more than one (1) year by a professional electrical engineer, a registered electrical engineer on a national, city, provincial or municipal government authority exercising legal jurisdiction over electrical installations.

SEC.15. HoldingofExaminations. Examinationsforthepracticeofelectricalengineeringinthe PhilippinesshouldbegiventwiceayearintheCityofManilaandotherplacesondatesthattheBoardmay recommendfordeterminationofscheduling.TheBoardshallscheduleinterview/oralexaminationofevery applicantforregistrationasprofessionalelectricalengineeronlyattheofficeoftheCommission. Toqualifiedapplicantsforexamination,noticeofadmissionshallbeissuednotlaterthanten(10) dayspriortothefirstdayofexamination. SEC.16. QualificationsofApplicantforRegistrationasProfessionalElectricalEngineer. Any personapplyingforregistrationasprofessionalelectricalengineershallestablishtothesatisfactionofthe Boardthatonorbeforethedateofregistration,hepossessesthefollowingqualifications: (a) (b) (c) HeisacitizenofthePhilippines Heisofgoodreputationwithhighmoralvalues Hehasnotbeenfinallyconvictedbythecourtofanoffenseinvolvingmoralturpitude

(d) He is a holder of the degree of Bachelor of ScienceinElectricalEngineering(BSEE) fromauniversity,school,college,academyorinstitutedulyconstituted,recognizedandaccreditedbythe Philippinegovernmentand (e) He is a registered electrical engineer. with valid certificate of registration and professional license and with four (4) years or more of active practice reckoned from the date of his registrationasaregisteredelectricalengineer. SEC. 17. Qualifications of .Applicants for Registered Electrical EngineerExamination.Any person applying for admission to the registered electrical engineering examination, as herein, provided, shallestablishtothesatisfactionoftheBoardthat,onorbeforethedateoftheexamination,hepossesses thefollowingqualifications: (a) (b) (c) (d) and (e) He is a holder of the degree of Bachelor of ScienceinElectricalEngineering(BSEE) fromauniversity,school,college,academyorinstitutedulyconstituted,recognizedandaccreditedbythe Philippinegovernment. SEC. 18. Qualifications of Applicants for Registered Master Electrician Examination. Any personapplyingforadmissiontotheregisteredmasterelectricianexaminations,ashereinprovided,shall establish to the satisfaction of theBoardthat,onorbeforethedateoftheexamination,hepossessesthe followingqualifications: (a) (b) (c) HeisacitizenofthePhilippines Heisatleasteighteen(18)yearsofage Heisofgoodreputationwithhighmoralvalues HeisacitizenofthePhilippines Heisatleasttwentyone(21)yearsofage Heisofgoodreputationwithhighmoralvalues He has notbeenfinallyconvictedbythecourtofanoffenseinvolvingmoralturpitude

(d) and (e)

He has notbeenfinallyconvictedbythecourtofanoffenseinvolvingmoralturpitude

Hehasanyofthefollowingtechnicalbackgrounds: (1) Has completed at least three (3) years of a fiveyear Bachelor of Science in Electrical Engineering(BSEE)programorathreeyearcourseinelectricalengineeringtechnology from an engineering school recognized by the Philippinegovernmentand,inaddition, has a subsequent specific record of one (1) year practice in electrical wiring and installation,operationandmaintenanceofutilizationdevicesandequipmentor (2) Has graduated from a twoyear electrician's course of instruction from a vocational or tradeschoolrecognizedbythePhilippinegovernmentand,inaddition,hasatleasttwo (2) years of apprenticeship after completion of the course of instruction on electrical installation,operationandmaintenanceofutilizationdevicesandequipmentor (3) Has completed a oneyear electrician's course of instruction from a vocational school recognizedbythePhilippinegovernmentand,inaddition,hasatleastthree(3)yearsof apprenticeship after completion of the course of instruction on electrical installation, operationandmaintenanceofutilizationdevicesandequipmentor (4) Hascompletedafouryearhighschooleducationoritsequivalentand,inaddition,hasa subsequentspecificrecordofatleastfive(5)yearsofapprenticeshipinelectricwiring, installation,operationandmaintenanceofutilizationdevicesandequipment.

SEC. 19. Scope of Examination. As a prerequisite for registration as professional electrical engineer,registeredelectricalengineerandregisteredmasterelectrician,theapplicantshallcomplywith thefollowingrequirements: (a) Professionalelectricalengineer:

Forthepurposeofconfirmingtheservicerecordandclarifyingthetechnicalreportsubmittedby theapplicantforregistrationasaprofessionalelectricalengineer,anoralexaminationorinterviewshallbe conductedonthefollowingdocumentstobesubmittedtotheBoard: (1) Certified experience record from the date applicant took oath as a registered electrical engineer indicating the inclusive dates, companies worked for, description of specific responsibilities, significant accomplishments as well as the name and position of immediatesupervisors (2) Technicalpapercoveringanevaluation,ananalysis,astudyoracriticaldiscussionofan electrical engineering project or subject, on one or several technical aspects such as: design,construction,installation,commissioning,testing,operation,maintenance,repair, researchandthelike.Thetechnicalpapershallbesupportedbyengineeringprinciples anddata.Publishedorunpublishedscientificpaperortreatiseonelectricalengineering theoriesandapplicationsmaybeconsideredascomplyingwiththerequirement (3) Three(3)certificationssignedbythree(3)professionalelectricalengineerstotheeffect that the experience record submitted by the applicant is factual and that the technical papersubmittedwasactuallypreparedbytheapplicant. Theapplicantmustobtainpassingmarksontheexperiencerecordandonthetechnicalreportin ordertoqualifyforregistrationasaprofessionalelectricalengineer. (b) Registeredelectricalengineer:

The applicant shall pass a written examination on different subjects or group of subjects as follows: (1) Mathematics, such as: algebra, trigonometry, analytic geometry, differential calculus, integral calculus, differential equations, complex numbers, probability and statistics, advanced engineering mathematics including matrices, power series, Fourier analysis, Laplacetransforms,andothers.Theweightistwentyfivepercent(25%). (2) Engineering sciences and allied subjects, such as: general chemistry, college physics, computerfundamentalsandprogramming,engineeringmaterials,engineeringmechanics, fluid mechanics, strength of materials, thermodynamics, electrical engineering law, engineering economics, engineering management, contracts and specifications,codeof professionalethics,PhilippineElectricalCode,Parts1and2andothers.Theweightis thirtypercent(30%). (3) Electrical engineering professional subjects, such as: electric circuits, electronic theory andcircuits,energyconversion,powertransmissionanddistribution,instrumentationand measurement,circuitandlineprotection,controlsystems,principlesofcommunication, electrical machines, electrical equipment, components and devices, electric systems, powerplant,electronicpowerequipment,illumination,buildingwiringandothers.The weightisfortyfivepercent(45%). Thepassinggeneralweightedaverageratingshallbeseventypercent(70%)withnogradebelow fiftypercent(50%)inanygroupofsubjectslistedabove. The examination questions on the foregoing subjects shall cover only basic theories and principles,andshallexcludequestionsbasedonexperienceandtradepractices.Thenumberofquestions shallbesuchthattheexaminationscanbefinishedinthree(3)consecutiveeighthourdays. (c) Registeredmasterelectrician:

The applicant shall pass a written examination on the different subjects or group ofsubjectsas follows: (1) Technicalsubjects: Ohm'sLaw:Calculationsforresistance,current,voltageandpowerfordirectcurrent andalternatingcurrentcircuits. Electrical machines: Description and operating principles of motors, generators and transformers. Controlequipment:Descriptionandfunctionoffuses,overloadrelays,safetyswitches, magneticswitches,circuitbreakers,stardeltamotorstarters,transformertypemotorstarters,D.C.motor starters. Electrical components: Description of resistors, capacitors, inductors and semi conductors. Maintenanceandrepair:Descriptionoftheproceduresinthemaintenanceofelectrical machinery. Testequipment:Typesandusesof measuringinstruments. Electricalengineeringlawprovisionspertainingtoregisteredmasterelectricians.

OtherrelatedsubjectsasmaybeprescribedbytheBoard. (2) PhilippineElectricalCode,Parts1and2: Generalrequirementsforinstallationofelectricwiringandequipment. Approvedwiringmethods. Wiringdiagramsofdifferenttypesofmotorstarterswithmotorprotection Drawingsymbolsandwiringplans. OtherrelatedsubjectsasmaybeprescribedbytheBoard. Thenumberoftestquestionsshallbesuchthattheexaminationscanbefinishedinone(1)eight hourday. Therelativeweightsshallbefiftypercent(50%)fortechnicalsubjectsandfiftypercent(50%)for PhilippineElectricalCode. The passing general average rating shall be seventy percent (70%) with no grade below fifty percent(50%)inanysubject. SEC.20. ReportofRatings. TheBoardofElectricalEngineeringshall,withinonehundredfifty (150)daysafterthedateofcompletionoftheexaminations,reporttheratingsobtainedbyeachcandidateto theCommission. SEC. 21. Reexamination of Failed Subjects. An applicant shall be allowed to retake, any numberoftimes,onlythesubject/sinwhichhehasobtainedagradebelowfiftypercent(50%).Whenhe shallobtainedanaveragegradeofseventypercent(70%)inthesubject/srepeated,heshallbeconsidered tohavepassedhislicensureexamination. SEC. 22. Oath. All successful candidates in the examination shall be required to take a professional oath before the Board or any government official authorized to administer oaths prior to enteringuponthepracticeofprofessionalelectricalengineer,registeredelectricalengineer,andregistered masterelectrician. SEC.23. IssuanceofCertificatesofRegistrationandProfessionalLicenses. Theregistrationof professionalelectricalengineer,registeredelectricalengineerorregisteredmasterelectriciancommences fromthedatehisnameisenteredintherollofregistrantsorlicenseesforhisprofession.Everyregistrant whohassatisfactorilymetalltherequirementsspecifiedinthisAct,uponpaymentoftheregistrationfee, shall be issued a certificate of registration as a professional electrical engineer, a registered electrical engineeroraregisteredmasterelectricianthatshowsthefullnameoftheregistrantandwithserialnumber, signedbytheCommissionerandbythechairmanandmembersoftheBoard,stampedwiththeofficialseal, as evidence that the person named therein is entitled to practice the profession with all the rights and privileges appurtenant thereto. The certificate shall remain in full force and effect until withdrawn, suspended,orrevokedinaccordancewithlaw. AprofessionallicensesignedbytheCommissionerandbearingtheregistrationnumberanddate ofissuancethereofandthemonthofexpiryorrenewabilityshalllikewisebeissuedtoeveryregistrantwho

haspaidtheannualregistrationfeesforthree(3)consecutiveyearsandhascompliedwiththerequirements of the Continuing Professional Education (CPE), unless exempted therefrom. This license will serve as evidencethatthelicenseecanlawfullypracticehisprofessionuntiltheexpirationofitsvalidity. SEC.24.ContinuingProfessionalEducationProgram.TheCPEguidelinesshallbeprescribed and promulgated by the Board subject to the approval of the Commission, after consultation with the integratedandaccreditedelectricalengineeringassociations,otherassociationsoftheelectricalengineering profession,andotherconcernedsectors.TheBoardshallincorporateinthesaidguidelinesthecreationofa CPEcouncilthatshallbecomposedofofficerscomingfromtheBoard,theCommission,theintegratedand accreditedelectricalassociations,andotherconcernedsectors.Itshallbevestedwiththefunctions,duties andresponsibilitiestoimplementtheguidelinesandshallhavethejuridicalpersonalitythatisdistinctand separate from and independent of the Board, the Commission, the integrated and accredited electrical engineeringassociation,andotherassociationsof theelectricalengineeringprofession. SEC. 25. Integration of the Electrical Engineering Professions. The electrical engineering professionsshallbeintegratedintoonenationalorganizationwhichshallberecognizedbytheBoardasthe oneandonly integratedandaccreditedassociationofprofessionalelectricalengineers,registeredelectrical engineers and registered master electricians. Every professionalelectricalengineer,registeredelectrical engineer and registered master electrician upon registration with the Board as such, shall ipso .facto, becomeamemberoftheintegratednationalorganization.ThosewhohavebeenregisteredwiththeBoard butarenotmembersofthesaidorganizationatthetimeoftheeffectivityofthisAct,shallbeallowedto register as members of thesaidintegratedorganizationwithinthree(3)yearsaftertheeffectivityofthis Act.Membershipintheintegratedorganizationshallnotbeabartomembershipinotherassociationsof theelectricalengineeringprofession. The professional electrical engineer, registered electrical engineer, and registered master electrician shall receive the benefits and privileges appurtenant to this listed membership in the duly integratedandaccreditedelectricalengineeringassociationonlyuponpaymentoftherequiredmembership feesanddues. SEC.26.SealofProfessionalElectricalEngineer. Alllicensedprofessionalelectricalengineers mayobtainasealofadesignprescribedbytheBoardbearingtheregistrant'sname,thecertificatenumber and the legend "Professional Electrical Engineer." Plans, specifications, reports and other professional documentspreparedbyorexecutedundertheimmediatesupervisionof,andissuedbyalicensee,shallbe stampedoneverysheetwithsaidsealwhenfiledwithgovernmentauthoritiesorwhensubmittedorused professionally:Provided,however,Thatitisunlawfulforanyonetostamporsealanydocumentwithsaid sealaftertheregistrant'snamehasbeendelistedfromtherosterofprofessionalelectricalengineersorafter thevalidityofhisprofessionallicensehasexpired. Theregistrantshallbeallowedagaintousehissealorstampinthedocumentsheprepares,signs orissuesonlyafterheisreinstatedtothepracticeofhisprofessionandreissuedanewprofessionallicense. SEC. 27. IndicationofRegistration/ProfessionalLicenseNumber. Theprofessionalelectrical engineer, registered electrical engineer, or registered master electrician shall be required to indicate his registration/professionallicensenumber,thedateregistered,andthedateofitsexpiryinthedocumentshe signs,usesorissuesinconnectionwiththepracticeofhisprofession. SEC. 28. Refusal to Issue Certificates. TheBoardofelectricalengineeringshallnotissuea certificate of registration to any person convicted by the court of any criminal offense involving moral turpitudeortoanypersonguiltyofimmoralordishonorableconductortoanypersonofunsoundmind.In the event of refusal to issue certificates for any reason, the Board shall give the applicant a written statementsettingforththereasonsforsuchaction,whichstatementshallbeincorporatedintherecordsof theBoard. After no less than a year from the finality of theBoard'sdecision,theBoard,outofequityand justice,mayrecommendtotheCommissiontheissuanceofthecertificateofregistrationtotheapplicant.

SEC. 29. Revocation of Certificates of Registration and Suspension from the Practice of the Profession. TheBoardshallhavethepower,uponpropernoticeandhearing,torevokeanycertificateof registrationofanyregistrant,tosuspendhimfromthepracticeofhisprofessionortoreprimandhimfor any cause specified in the preceding section, or for the use of, perpetration of any fraud or deceit in obtaining a certificate of registration, or for gross negligence or incompetence or for unprofessional or dishonorableconductforviolationofthisAct,therulesandregulationsandotherpoliciesoftheBoardand theCodeofProfessionalEthics. ItshallbesufficientgroundfortherevocationofacertificateissuedtoapersonunderthisAct, andhissuspensionfromthepracticeofhisprofessionforunprofessionalordishonorableconduct,if: (a) Beingaprofessionalelectricalengineer,hehassignedandaffixedhissealonanyplan, design,technicalreports,valuation,estimate,specificationorothersimilardocumentorworknotprepared byhimornotexecutedunderhisimmediatesupervision (b) He has represented himself as having taken charge of or supervised: any electrical constructionorinstallationoperation,tendingandmaintenanceofanyelectricplantmanufactureorrepair of electrical equipment, teaching of electrical engineering subjects sale or distribution of any electric supplyorutilizationequipmentrequiringengineeringcalculationsorapplicationofengineeringprinciples anddata,withoutactuallyhavingdoneso. ThedecisionoftheBoardshallbefinalandexecutoryunlessitisappealedbytherespondentto theCommissionwithinfifteen(15)daysfromthereceiptofsuchdecision.TheBoard'sorCommission's decisionisappealablebytherespondenttotheCourtofAppealsinaccordancewiththeprocedureprovided undertheRulesofCourt. Anyperson,firm,associationorcorporationmayfilechargesinaccordancewiththeprovisionsof thissectionagainstanylicensee,ortheBoardmay,onitsowninitiative(motuproprio) investigateand/or takecognizance ofactsandpracticesconstitutingcauseforsuspensionorrevocationofthecertificateof registration by proper resolution or order, such charges shall be in writing and shall besworntobythe personmakingthemandshallbefiledwiththe Board. The rules and regulations of the Commission on administrative investigation shall govern the procedureandconductofadministrativeinvestigationbeforetheBoard. The respondent shall have the right to a speedy and public hearing and to confront and cross examinewitnessesagainsthim. SEC.30.ReissuanceofRevokedCertificatesandReplacementofLostCertificates. Subjectto the approval of the Commission, the Board may, after the expiration of one (1) year from the date of revocationofacertificate,forreasonsitmaydeemsufficient,entertainanapplicationforanewcertificate inthesamemannerasapplicationforanoriginalone.Itmayexempttheapplicantfromthenecessityof undergoinganexamination. Anewcertificateof registrationtoreplaceanycertificatethathasbeenlost,destroyedormutilated maybeissued,subjecttotherulesoftheBoard.

ARTICLEIV SUNDRYPROVISIONSRELATIVETOTHEPRACTICE OFELECTRICALENGINEERING

SEC.31.FieldofPractice. Thefieldofpracticeforprofessionalelectricalengineers,registered electricalengineers,andregisteredmasterelectriciansshallbeasfollows: (a) A professional electrical engineer's field of practice includes the sole authority to seal electricalplans,etc.,andtopracticeelectricalengineeringinitsfullscopeasdefinedinthisAct (b) Aregisteredelectricalengineer'sfieldofpracticeincludesthechargeorsupervisionof: operation and maintenanceofelectricalequipmentinpowerplants,industrialplants,watercraft,electric locomotive, and others manufacture and repair of electrical supply and utilization equipment including switchboards,powertransformers,generators,motors,apparatus,andothersteachingofelectricalsubjects and sale and distribution of electrical equipment and systems requiring engineering calculations or applicationofengineeringdataand (c) A registered master electrician's field of practice includes the installation, wiring, operation, maintenance and repair of electrical machinery, equipment and devices, in residential, commercial, institutional, commercialandindustrialbuildings,inpowerplants,substations,watercrafts, electriclocomotives,andthelike:Provided,Thatiftheinstallationorthemachineryisratedinexcessof five hundred kilovoltamperes (500 kVA) , or in excess of six hundred volts (600 V) the work shall be underthesupervisionofaprofessionalelectricalengineeroraregisteredelectricalengineer. SEC.32.ProhibitionsinthePracticeofElectricalEngineering. Nopersonshall: (a) Practice or offer to practice electrical engineering in the Philippines without having previously obtained a certificate of registration and a professional license from the Board of Electrical EngineeringexceptasprovidedforinSection14hereof (b) Use, or attempttouseashisown,certificateofregistration,professionallicenseorthe sealofanother (c) Give false or forged evidence of any kind to the Board or to any member thereof in obtainingacertificateofregistrationorprofessionallicense (d) Falselyimpersonateanyregistrantoflikeordifferentname

(e) Attempt to use a revoked or suspended certificate of registration or an expired professionallicense (f) Use, in connection with his name or otherwise assume, use or advertise any title or description tending to convey the impression that he is a professional electrical engineer, registered electricalengineer,orregisteredmasterelectricianwithoutholdingavalidcertificateoravalidlicenseand (g) Signadocumentinvolvingelectricaldesign,plan,technicalspecification,valuationand thelikeonbehalfofaprofessionalelectricalengineer. SEC.33.PersonnelRequired. ExceptasotherwiseprovidedinthisAct,everyelectricplant, industrialplantorfactory,commercialestablishment,institutionalbuilding.watercraft,electriclocomotive orinanyotherinstallationwherepersonsandpropertiesareexposedtoelectricalhazardsshallnothave lessthanthefollowingcomplementofprofessionalelectricalengineer,registeredelectricalengineer,and registeredmasterelectrician: (a) Electricplantswithtotalinstalledgeneratingcapacityofanysizeandemployingvoltages of any standard ratingone(1)professionalelectricalengineerorone(1)registeredelectricalengineer. However,forcapacitiesuptofivehundredkilovoltamperes(500kVA)andemployingvoltagesofupto sixhundredvolts(600V)one(1)registeredmasterelectrician

(b) Industrialplantsorfactories,commercialestablishments,orinstitutionalbuildingshaving a connected kVA load of any size and employing voltages of any standard rating one (1) professional electrical engineer or one (1) registered electrical engineer. However, for connected loads up to five hundred kilovoltamperes (500 kVA) and employing voltages up to six hundred volts (600 V) one (1) registeredmasterelectrician (c) Watercraftsorelectriclocomotiveswithinstalledgeneratingcapacityuptothemaximum size and voltage available for these units one (1) professional electrical engineer or one (1) registered electricalengineer.However,forgeneratingcapacitiesuptofivehundredkilovoltamperes/kilowatt(500 kVA/kW)andemployingvoltagesuptosixhundredvolts(600V)one(1)registeredmasterelectrician. Provided,however, Thatinalltheaforementionedcases,additionalqualifiedpersonnelshallbe employedtoensuresafeoperationandsafeguardpublicwelfare,lifeandproperty:Provided,further,That whentheoperationrequiresmorethanoneshiftofpersonneleverytwentyfour(24)hours,theminimum complementofqualifiedpersonnelshallbeemployedineachshift. This section, however, shall not apply to any installation which has a connected load of fifty kilovoltamperes(50kVA)orlessandemploysvoltagesofnotmorethantwohundredfiftyvolts(250V) andforinstallationswhicharedesignedtobeautomaticanddonotrequireresidentpersonnelfortheirsafe operation: Provided, however, That their maintenance and repair shall be under the charge of a duly registeredpersonnel:Provided,further,Thatayearlyinspectionwillbeconductedandcertifiedtobeina safe operating condition by a professional electrical engineer, a registered electrical engineer, or a registeredmasterelectrician. SEC. 34. Preparation of Plans, Supervision of Installation, Application of the Philippine Electrical Code. It shall be unlawful for any person not authorized under this Act to prepare plans, designs, valuations or specifications for any electrical wiring, equipment or system and no installation thereofshallbeundertakenunlesstheplans,designs,valuationsandspecificationshavebeenpreparedby or under the responsible charge of, and signed and sealed by a professional electrical engineer and a construction permit for the execution thereof is firstsecuredandunlesstheworkisdoneinaccordance with the Philippine Electrical Code and is executed under the responsible charge or supervision of a professionalelectricalengineer,aregisteredelectricalengineer,oraregisteredmasterelectrician,asthe case may be, and the routinary fiscal and ministerial requirements of the government agency, if any, exercisingjurisdictionovertheparticularinstallationhavebeencompliedwith. SEC.35.PracticeNotAllowedforFirmsandCorporations. Thepracticeofelectricalengineering isaprofessionalserviceadmissiontowhichisbasedonindividualandpersonalqualifications.Hence,no firmorcorporationmayberegisteredorlicensedassuchforthepracticeofelectricalengineering. However,personsproperlyqualifiedandlicensedasprofessionalelectricalengineersmay,among themselves, form a partnership or association and collectively render electrical engineering service. Individualmembersofsuchpartnershipsorassociationsshallberesponsiblefortheirownrespectiveacts. SEC.36. PostingofCertificates. Theowner,managerorthepersoninchargeofanelectricplant, industrial plant or factory, commercial establishment, institutional building, watercraft, or electric locomotiveshallpostorcausetobepostedinaconspicuousplacewithinsuchplantorestablishmentthe certificate of registration of the engineers or electricians employed in such plant or establishment, in a frameprotectedbytransparentglassorequivalent. SEC.37.CertificateofSpecialty. CertificatesofspecialtyshallbeissuedbytheBoard,subject to the approval of the Commission, to professional electrical engineers who have been screened and recommended by the integrated and accredited electrical engineering association. These are for specific fieldsinwhichtheapplicantshavespecializedknowledge,trainingandexperienceandhavedemonstrated their competence and expertise. The Board shall, subject to the approval of the Commission, and after consultationwiththesaidassociation,prescribeandissuethenecessaryguidelinesfortheissuanceofthese certificates.

SEC. 38. Foreign Reciprocity. No foreign engineer shall be admitted to take a board examination,begivenacertificateofregistration,orbeentitledtoanyoftherightsandprivilegesunder this Act unless the country of which he is a subjectorcitizenspecificallypermitsFilipinoengineersto practicewithinterritoriallimitsonthesamebasisasthesubjectsorcitizensofsuchcountry. SEC.39.EnforcementoftheActbyOfficersoftheLaw. Itshallbethedutyofallconstituted officersofthelawofthenationalgovernment,oranyprovincial,cityormunicipalgovernmentorofany politicalsubdivisionthereoftoprosecuteanypersonviolatingtheprovisionsofthisAct.TheSecretaryof JusticeorhisassistantshallactaslegaladviseroftheBoardandrendersuchlegalassistanceasmaybe necessaryincarryingouttheprovisionsofthisAct. SEC.40.PenaltyClause. AnypersonwhoshallviolateanyoftheprovisionsofthisActshallbe guilty of misdemeanor and shall, upon conviction, be sentenced to a fine of not less than Ten thousand pesos(P10,000.00)normorethanFiftythousandpesos(P50,000.00)orimprisonmentforaperiodnotless thansix(6)monthsnormorethanfive(5)yearsorbothatthediscretionofthecourt. ARTICLEV TRANSITORYPROVISIONS SEC. 41. Terms of Office of Board Members. Upon approval of this Act, the incumbent chairmanandtwo(2)membersoftheBoardshallcontinuetoserveuntiltheirtermsofofficeexpireoruntil theirreplacementshavebeenappointedbythePresidentandshallhavebeendulyqualified. SEC. 42. New Certificates of Registration and ProfessionalLicenses. (a)Associateelectrical engineersandassistantelectricalengineerswithvalidcertificatesofregistrationandprofessionallicense issuedunderRepublicActNo.184shallregisterwithintwo(2)yearsfromtheeffectivityofthisActandbe issuednewcertificatesofregistrationandnewprofessionallicenseasregisteredelectricalengineersunder thisActtoreplacetheiroriginalones.Theirserialnumbersshallbeprovidedbytheregistrationdivisionof theCommission. (b) Masterelectricianswithvalidcertificatesofregistrationandprofessionallicensesunder RepublicActNo.184shallregisterwithintwo(2)yearsfromtheeffectivityofthisActandbeissuednew certificates of registration and new professional licenses as registered master electricians with the same serialnumbersastheiroldonestoreplacetheiroriginalcertificatesandlicenses.

ARTICLEVI FINALPROVISIONS SEC.43.RepealingClause. RepublicActNo.184andexistingprovisionsofprovincial,cityor municipal ordinances or regulations pertaining to examinations for electrical contractors, electrical inspectors,orelectricians,andallotherlaws,partoflaws,orders,ordinancesorregulationsinconflictwith thisActareherebyrepealedoramendedaccordingly. SEC. 44. Separability Clause. If any part of this Act or the application of such provision or circumstanceisdeclaredunconstitutional,theremainderofthisActortheapplicationofsuchprovisionto otherpersonsorcircumstancesshallnotbeaffectedbysuchdeclaration. SEC. 45. Effectivity Clause. ThisActshalltakeeffectafterthirty(30)daysfollowingitsfull publicationinthe OfficialGazetteornewspaperofgeneralcirculation. Approved,
