Non Arrival of - The Notice of Intended Prosecution

On initial inspection this appears to be fairly obvious and we would agree. The ACPO Code of Practice for Operational Use of Road Policing Enforce ent Technology provides a huge nu ber of correct procedures that the police are intended to adhere to whereby these reco endations if used correctly will ensure that the police do their !ob correctly. The police are only hu an with all the frailties that we all suffer" ta#ing shortcuts in the wor#place is co o place. $n discharging their responsibilities of adhering to the correct procedures where their Code of Practice is concerned% will result in the police failing to do their !ob correctly. $n the a!ority of cases the people who suffer through this failure of the police doing their !ob correctly is usually the otoring public. &owever% on this occasion the beneficiaries of this lapse by the police could easily be the savvy otorist who realise that the police once again have decided not to adhere to the correct procedures reco ended by The ACPO Code of Practice for Operational Use of Road Policin !nforce"ent Technolo y# The savvy otorist #nows that the reco ended practice for the police is to send the 'otice of $ntended Prosecution by Recorded $elivery% thus ensuring that %the alle ed& offender cannot clai non receipt of the 'otice within () days of the alleged offence. *ailure to prove receipt of the '$P within that period will nullify the offence. The %savvy& otorist also #nows that this theory can tested% as a '$P doesn+t need to be returned for ,- days #nowing that the Police will send a re inder before the ,- day period.
