My Grandmother is currently defending her property from being taken by Eminent Domain, so this topic is very close to my family.

This is an instance where the power of Eminent Domain is not being used for its intended purpose as set forth by our forefathers, but is in fact being abused by governmental authority. The town determined that the property is blighted and thus seeks to take a valuable central, corner property and give it to a developer who oddly has no particular plan for the property. The developer will then ra!e the property and build a new building that meets his own economic plan. "nterestingly this blighted property is fully rented and contributes significant ta# dollars to the town. The governmental authority has the ability to over$power the landowner, so the reality is, in the end it is e#pected that the town will win, not matter how we defend the matter. % landowner should not be forced to sell his property unless there is a strict and proper application of this law, but in this case the desire to retain the property is not solely for financial reasons. This property owned by my family for forty years was also the site of a business owned and operated by my family for twenty of those years, thus there is significant sentimental value. Establishing a website was the perfect way to use my computer skills to convey my research and analysis of Eminent Domain and allowed me to divide the different subtopics into different webpages. The law gives the Government the right to take private property from a landowner, but the responsibility to only take the land if it is for public purpose. %dditionally, any taking must be partnered with /ust compensation. The challenge in modern day is first whether the taking is truly for a public purpose and if that prong is met then whether the compensation proffered to the landowner who is about to be stripped of his property is being /ustly reimbursed for the loss.
