ConditionalOffer of Amnesty

PURPOSE: The sovereign peoples Conditional Offer of Amnesty is extended to Stevens
County elected and appointed officers, and deputies, currently operating under a timely
subscribed Oath of Office but one which fails to qualify as being properly filed into the official
public record as prescribed by those legislative acts that are codified in the Revised Codes of
Washington, RCW 36.16.060 and RCW 65.04.015. This failure to duly qualify for office is not
harmless error. Deliberate or not, ignorance of the law for public officials is not an excuse

public officials and deputies so affected by this failure to duly qualify are subject, but not limited
to, the penalties of the legislative acts that are codified in RCW 42.20.030 and RCW 9.92.020.
TERMS AND CONDITIONS OF AMNESTY
First Condition: That the Oath of Office Ordinance be enacted within a period of time not to
exceed 45 days from the date subscribed to this Conditional Offer of Amnesty.

Second Condition: It is acknowledged and understood that it is a violation of their Oath of
Office, or Oath of their Supervisor, should any elected or appointed official, deputy, or other
employee of Stevens County, in any way or manner, interfere or otherwise inhibit the sovereign
people's unalienable rights, including, but not limited to, the right to constitute a Common Law
Grand J ury.

TIME PERIOD OF AMNESTY

This amnesty period shall extend for 45 days from this date of Notice, giving time for the
Stevens County Commissioners to execute the Oath of Office Ordinance wherein this
Conditional Offer of Amnesty is incorporated. This will grant sufficient time for those officers,
elected or appointed, and deputies, so affected to pay the legislated filing/recording fee and to
cause their timely executed existing Oath of Office to be properly incorporated into the official
public record. Failure to do so will vacate their office and/or be subject to RCW 29A.56.110.

AMNESTY IS NOT IMMUNITY

This Conditional Offer of Amnesty grants restoration to office for those public officials so
affected as if their timely subscribed

Constitution for the United States of America.

Every person elected to county office shall before heor she enters upon the duties of hisor

a municipality, together with all deputies and assistants of such an officer, and all persons

Thedefinitionssetforthinthissectionapplythroughoutthischapterunlessthecontextclearly

(1) "Recording officer" means the county auditor, or incharter counties thecounty official
chargedwiththeresponsibilityforrecordinginstrumentsinthecountyrecords.
(2) "File," "filed," or "filing" means the act of delivering or transmitting electronically an
instrumenttotheauditororrecordingofficerforrecordingintotheofficialpublicrecords.
(3)"Record,""recorded,"or"recording"meanstheprocess,suchaselectronic,mechanical,
optical, magnetic, or microfilm storage used by the auditor or recording officer after filing to
incorporatetheinstrumentintothepublicrecords.
(4)"Recordingnumber"meansauniquenumberthatidentifiesthestoragelocation(book
or volume and page, reel and frame, instrument number, auditor or recording officer file
number, receiving number, electronic retrieval code, or other specific place) of each
instrumentinthepublicrecordsaccessibleinthesamerecordingofficewheretheinstrument
containingthereferencetothelocationisfound.
(5)"Grantor/grantee"forrecordingpurposesmeansthenamesofthepartiesinvolvedinthe
transaction used to create the recording index. There will always be at least one grantor and
one grantee for any document. In some cases, the grantor and the grantee will be the same
individual(s),oroneofthepartiesmaybethepublic.
(6) "Legible and capable of being imaged" means all text, seals, drawings, signatures, or
othercontentwithinthedocumentmustbelegibleandcapableofproducingareadableimage,
regardlessofwhatprocessisusedforrecording.
RCW65.04.030Instrumentstoberecordedorfiled.
The auditor or recording officer must, upon the payment of the fees as required in RCW
36.18.010forthesame,acknowledgereceiptthereforinwritingorprintedformandrecordin
largeandwellboundbooks,orbyphotographic,photomechanical,electronicformat,orother
approvedprocess,thefollowing:
(1)Deeds,grantsandtransfersofrealproperty,mortgagesandreleasesofmortgagesofreal
estate, instruments or agreements relating to community or separate property, powers of
attorney to convey real estate, and leases which have been acknowledged or proved:
PROVIDED, That deeds, contracts and mortgages of real estate described by lot and block and
additionorplat,shallnotbefiledorrecordeduntiltheplatofsuchadditionhasbeenfiledand
madeamatterofrecord;
(2) Patents to lands and receivers' receipts, whether for mineral, timber, homestead or
preemptionclaimsorcashentries;
(3)Allsuchotherpapersorwritingasarerequiredbylawtoberecordedandsuchasare
requiredbylawtobefiled.
Chapter65.08RCWRECORDING
RCW65.08.140Noliabilityforerrorinrecordingwhenproperlyindexed.
Arecordingofficerisnotliableforrecordinganinstrumentinawrongbook,volumeorsetof
records if the instrument is properly indexed with a reference to the volume and page or
recordingnumberwheretheinstrumentisactuallyofrecord.

RCW65.08.150Dutytorecord.
A recording officer, upon payment or tender to him or her of the lawful fees therefor, shall
record in his or her office any instrument authorized or permitted to be so recorded by the
lawsofthisstateorbythelawsoftheUnitedStates.
RCW65.04.130Feestobepaidortendered.
Said county auditor is not bound to record any instrument, or file any paper or notice, or
furnish any copies, or to render any service connected with his or her office, until his or her
feesforthesame,asprescribedbylaw,areifdemandedpaidortendered.
RCW36.18.010Auditor'sfees.
Countyauditorsorrecordingofficersshallcollectthefollowingfeesfortheirofficialservices:
(1)Forrecordinginstruments,forthefirstpageeightandonehalfbyfourteeninchesorless,
five dollars; for each additional page eight and onehalf by fourteen inches or less, one dollar.
The fee for recording multiple transactions contained in one instrument will be calculated for
eachtransactionrequiringseparateindexingasrequiredunderRCW65.04.050asfollows:The
fee for each title or transaction is the same fee as the first page of any additional recorded
document; the fee for additional pages is the same fee as for any additional pages for any
recorded document; the fee for the additional pages may be collectedonly once and may not
becollectedforeachtitleortransaction;
(2) For preparing and certifying copies, for the first page eight and onehalf by fourteen
inches or less, three dollars; for each additional page eightand onehalf by fourteen inches or
less,onedollar;
(3)Forpreparingnoncertifiedcopies,foreachpageeightandonehalfbyfourteeninchesor
less,onedollar;
(4)Foradministeringanoathortakinganaffidavit,withorwithoutseal,twodollars;
(5)Forissuingamarriagelicense,eightdollars,(thisfeeincludestakingnecessaryaffidavits,
filingreturns,indexing,andtransmittalofarecordofthemarriagetothestateregistrarofvital
statistics)plusanadditionalfivedollarfeeforuseandsupportofthepreventionofchildabuse
and neglect activities to be transmitted monthly to the state treasurer and deposited in the
state general fund plus an additional ten dollar fee to be transmitted monthly to the state
treasurer and deposited in the state general fund. The legislature intends to appropriate an
amount at least equal to the revenue generated by this fee for the purposes of the displaced
homemakeract,chapter28B.04RCW;
(6)Forsearchingrecordsperhour,eightdollars;
(7) For recording plats, fifty cents for each lot except cemetery plats for which the charge
shall be twentyfive cents per lot; also one dollar for each acknowledgment, dedication, and

(8)Forrecordingofmiscellaneousrecordsnotlistedabove,forthefirstpageeightandone

Every person who shall falsely personate or represent any public officer, or who shall willfully
intrude himself or herself into a public office to which he or she has not been duly elected or
appointed,orwhoshallwillfullyexerciseanyofthefunctionsorperformanyofthedutiesof
such officer, without having dulyqualified therefor,as required by law, or who, having been
an executive or administrative officer, shall willfully exercise any of the functions of his or her
office after his or her right to do so has ceased, or wrongfully refuse to surrender the official
seal or any books or papers appertaining to such office, upon the demand of his or her lawful

Punishmentofgrossmisdemeanorwhennotfixedbystatute.
Everypersonconvictedofagrossmisdemeanorforwhichnopunishmentisprescribedinany
statute in force at the time of conviction and sentence, shall be punished by imprisonment in
thecountyjailforamaximumtermfixedbythecourtofuptothreehundredsixtyfourdays,or
