PAROLE it is the conditional release of the prisoner after serving his minimum sentence.
Elements:
That the person is convicted.
That the person must have served the minimum part of his sentence.
That he must be release before the full expiration of his sentence.
That the said release is conditional depending upon his good behavior.
That he will remain on parole until the expiration of his maximum sentence.
DISTINCTION :
Parole Probation
It is an administrative function of the executive branch
of the government.
It is the judicial function of the executive branch of the
government.
That the offender must have served the minimum part
of his sentence in a prison institution before his
release.
The offender does not need to go to prison at all.
The parole is an extension of correctional treatment. It is only substitute for imprisonment.
Parole of granted by the Board of Parole and
Probation.
It is granted by the judge/court.

EXECUTIVE CLEMENCY it is an act of grace extended by the President of the Republic of the Philippines to
a person who has been sentenced by a final judgment of a duly constituted court of tribunal suspending the
execution of the sentence charging it to a less severe penalty of sentence totally or partially extinguishing it
with or without certain or specified condition.
