Institutional Correction
Non-Institutional Correction
The method of correcting sentenced offenders without having to go to prison.
o They are allowed to stay in the community.
1. Probation = the release of an offender from detention subject to a period of good
behavior under supervision
Must be convicted
First time conviction
Penalty must be under 1 day to 6y
Probation is a privilege it can be granted or denied
Once granted you can go back to community
Condition under probation
2yrs to 6 yrs under supervision of probation officer
Failure to comply will result in serving the original sentence
1. Parole – a method by which a prisoner who has served a minimum of his sentenced
is conditionally released but remains in legal custody, the condition being that in
case of misbehavior, he shall put back to prison
2nd time offender
Denied of probation
Sentenced must be 6 yrs and 1 day to 40 yrs
Served unexpired portion of minimum sentenced
o 12y & 1d – 20y
o Served 12y & 1d in prison
Once out served the unexpired portion of max sentence
Conditions under parole
o Must be under supervision of parole officer
o Failure to comply, will serve the remaining sentence
2. Executive clemency
1. Collective term for absolute pardon, conditional pardon, amnesty, reprieve and
commutation of sentence
2. Granted by the chief of executive officer (President of the Phil)
Pardon
Absolute pardon = total extinguished of criminal activity
Conditional pardon = partial extinguished of crim. Act
Amnesty
An act of sovereign power granting oblivion or general pardon
for the past offense usually granted in favor of certain classes of
persons who have committed crimes of political
Commutation of sentence
Reduction of the sentence from a heavier sentence to a less
serious one, or from longer prison term to a shorter one
Reprieve
Temporary suspension of the execution of sentence
