Cloyee, a nine years old girl, entered into a rental contract with Mr Albert, an engineer to rent a
property in Taman Tun Dr Ismail. The contract was done by Cloyees father in the name of Cloyee.
However, Mr Albert did not paid the rental of the property to Cloyee and did some alteration to the
property which was against and breach the rental contract agreement. Cloyee decided to bring the
case to the court. The reason of Cloyee to bring this case to the court is because to seek damages to
mitigate the loss incurred on the tenancy of the property.
Advice the legal implications on this situation. Which type of contract that Cloyee may enter and
may not enter legally? Explain the phrase mitigate the loss. Write your answer by referring to the
relevant Sections of the Act and the previous cases.
