RE: Gillespie v. Barker, Rodems & Cook, P.A. / Case No.: 05-CA-007205
Dear Mr. Gillespie:
I am in receipt of your January 14, 2011 letter regarding the captioned case, and particularly the issue you raise regarding the appeals procedure and the Clerk's role in the appeals procedure. Based upon the authority of G. w: v. Karen Rushing, Clerk of Circuit Court, 22 So.3d 819 (Fla. 2d DCA 2009), I am advising the director of the Clerk's appellate division to provide all administrative services of the Clerk's office under the Florida Rules of Appellate Procedure in the captioned case. Please be advised that the Clerk's duty to prepare a record on appeal comes at the direction of the Appellant in the case. You will need to follow the requirements of the Florida Rules of Appellate Procedure in giving the Clerk direction for the appellate record.
If you have any further questions, please advise. Thank you.
Very truly yours, Dale K Bohner
