3.0 MINIMUM ELIGIBILITY CRITERIA


(a) The bidder shall be a contractor, experienced in Piling Works for industrial/commercial buildings
(Central/State Government).
(b) The bidder should have constructed such work for buildings of minimum height of 25 m during
the last 5 years.
(c) Necessary certificate as proof of experience issued by any officer of the rank of Manager or above
in a PSU shall be submitted either in original or notarized copy.
(d) The bidder should have achieved an annual turnover of at least Rs.50 Lakhs.. from work
contracts during any of the last three years ending 31st March 2012 during last three years.
(e) The bidder shall produce a audited profit/loss statement of the organization for the last three
consecutive years from the date for submission of bid.
(f) Offer from joint ventures will not be accepted.
(g) Bidder should have executed piling/structural work for a value amounting to Rs. 15 Lakhs in a
single work order. Copy of work order/completion certificate of the same to be produced in proof
of the above along with the tender.

4.0 PROCESSING CHARGE OF TENDER DOCUMENTS


Tender documents can be obtained from the office of HIL, Udyogamandal on payment of Rs. 573 /- i
DD in favour of Hindustan Insecticides Limited payable at any Nationalized Bank in Kalamassery /
Udyogamandal, on any working day during office hours from 09.00 hrs To 16.30 hrs This Payment is
not refundable.

6.0 INSTRUCTIONS TO TENDERERS


a)

Tenderer is strongly advised to go through all the documents in connection with this contract
very carefully.

b)

Sealed Tenders (pre-qualification cum Techno-commercial bid and priced bid) super scribed with
the tender number and the opening date should be submitted to the commercial manager, HIL,
Udyogamandal office before 2 pm on 09.07.2013 ...

c)

Tenders received without receipt for Earnest Money will not be considered.

d)

Incomplete or conditional tenders differing from the specified are liable to be rejected.

e)

No modification to the tender will be entertained, unless specifically asked for, and agree to by
the company.

f)

The tender amount / rates should be given in figures as well as in words. If there is any cutting /
overwriting / erasing, this should be attested with full Signature of tenderer.

g)

One copy of the conditions of contract should be submitted along with the tender duly signed.

h)

Any tender received after the due time will be rejected.

6.1 Procedure for submission and opening of tenders


A. Tenderer shall submit their offer in two separate sealed envelopes. Envelope No.1 to
be addressed and super scribed PREQUALIFICATION & TECHNO COMMERCIAL
BID FOR PILING WORKS FOR MANCOZEB EXPANSION and containing the prequalification documents with the name of work and address of the tenderer in the
prescribed form along with supporting documents duly filled in and signed on all
pages and the details asked for, pre-qualification and the Main Tender Document,
which is the techno-commercial bid.
B. The E.M.D. has also to be kept in the same Envelope No.1.
C. Letter accompanying the tender with any technical details other than those stipulated
in the tender has also to be kept in this cover.
D. The contractor has to study the tender and any technical improvement they feel to be
incorporated may be specified by the contractor along with the techno-commercial bid
in Envelope No.1. Financial implications of conditions if any the contractor has
included in the prequalification bid may be loaded with the price quoted for
comparison of bids. The decision of HIL will be final and binding on the contractor in
this respect.
E. Bidders shall also enclose the following documents in Envelope No.1:

Technical specifications for all civil and structural work

ii.

Programme for Completion

iii.

Contractors proposed site organization chart

F. Envelope No.2 to be addressed and super scribed PRICE BID FOR PILING FOR
MANCOZEB EXPANSION containing the Schedule of items and rates and price
duly filled in, the manner specified in tender schedule duly signed on all pages.
G. Envelope No-2 SHALL NOT contain any other documents including requests for any
change in technical/commercial conditions.

H. Envelope No.1 and 2 shall be put together in envelope No.3 duly sealed and
indicating Tender number, the name and address of the tenderer and to be
addressed and super scribed PILING WORKS FOR MACOZEB EXPANSION
BUILDINGand to be submitted to Commercial Manager, HIL, Udyogamandal.
I. Prequalification cum techno-commercial bids will be opened in the presence of
contractors or their authorized representatives who are present at the office of HIL.
J. The bids of those contractors who have submitted EMD will be considered for further
evaluation. These contractors shall have to submit if requested by HIL/ Consultant,
additional details/clarifications on technical/commercial matters, in order to bring all
bids to the same technically and commercially acceptable level. The priced bids of
those contractors who meet the minimum pre-qualification criteria shall be opened at
the office of the Commercial Manager, HIL, Udyogamandal, on a date to be notified
later to the eligible tenderers.
K. After the public opening of the tenders, the information relating to the examination,
clarification, evaluation and comparison of tenders and recommendations concerning
the award of contract shall not be disclosed to other tenderers and persons not
officially concerned with such process.

7.0 EMD / SECURITY DEPOSIT/RETENTION MONEY


7.1 Earnest Money Deposit (E.M.D)
a) Earnest Money Deposit prescribed shall be remitted in the form of crossed demand
draft in favor of Hindustan Insecticides Limited, Kerala, payable at Kalamassery /
Udyogamandal valid for a period of 4 months.
b) E.M.D of the unsuccessful tenders will be refunded without any interest on
finalization of contract with the successful tenderer or on the expiry of the validity
period whichever is earlier.
c) E.M.D. may be forfeited If a bidder withdraws his bid during the period of validity specified.
If the successful bidder fails within the time limit to sign the contract document or
fails to furnish the required security deposit.
NOTE : SSI Units registered with NSIC are exempted from payment
of EMD provided they enclose attested Photostat copy of their valid
Certificate of registration (along with technical bid as well as Price Bid)
otherwise the tender will not be considered. The EMD remitted will be
returned to unsuccessful tenderers after finalizing order. No interest will
be paid on the EMD deposit. EMD can also be remitted by way of
Bank Guarantee for equivalent amount from Nationalised/Scheduled
banks. Bank guarantee format attached -

7.2 Security deposit


a) The successful tenderer will deposit an amount equal to 5% of the awarded
contract value in the form of Bank guarantee from nationalized Bank in the format

prescribed by HIL and valid for the entire period of construction plus defect liability
period of 12 months within one week of the award of the work.
b) E.M.D. will be refunded to the contractor after remittance of the security deposit and
execution of the agreement. The SECURITY DEPOSIT will be refunded to the
contractor after the Defect Liability Period.

7.3

Retention amount & Deductions


a) Retention Money at the rate of 10% of the value of work done for each running bill
will be deducted from first and following bills until such time as the cumulative total
of such deductions (herein referred to as the Retention money) shall amount to
10% of the contract price named in the letter of acceptance. When the cumulative
amount of retention money has reached 10% of the contract price, one half of the
retention money recovered (i.e. 5% of contract price) will be released. The balance
will be released on expiry of the defects liability period of 1 year provided there are
no outstanding amount payable by the contractor towards rectification of works etc.
b) Deposits of E.M.D, SECURITY DEPOSIT AND RETENTION MONEY will not bear
any interest whatsoever
c) Income-tax and surcharge on income tax at the rate prevailing at the time of
payment will be deducted from each running bill and final bill.
d) All statutory payments in connection with the employment of the Workmen &
contractors all risk policy for this work will be borne by the contractor at the
prevailing rates.
e) Recovery towards Kerala State Construction Workers welfare fund will be made
from each running bill and final bill at prevailing rate (currently 1%) and will be
remitted by HIL to the concerned department.
f)

The contractor is the employer of all the workers engaged for this work and should
therefore take all required registrations and pay premiums correctly to labor welfare
funds/ employees state insurance, PF, Cess Act 1996 etc.

g) The contractor will be responsible for the payment of minimum wages and
compliance under the various enactments regarding the workers deployed by him.
h) Sales Tax on work (work contract tax) shall be deducted at the prevailing rate and
as per prevailing rules (K.G.S.T rules).Quoted rates should be inclusive of W.C.S.T.
i)

The deduction towards statutory deductions shall be changed if the government


revises the rate. Any tax omitted, to be deducted in any part bill shall be deducted
in the subsequent bills/final bill.

j)

Service tax, at applicable rate shall be paid by HIL.

7.4 Period of Validity


The tender shall remain valid for acceptance for a period of 90 days from the date of submission of
the tenders. If any tenderer withdraws his tender before the said period or makes any
modifications in terms and conditions of the tender, then HIL has the liberty to forfeit the said
Earnest Money Deposit.

7.5 Inspection of site


Every tenderer is expected to inspect the site of the proposed work and acquaint himself with
the site conditions approaches, availability of raw materials, geological and weather conditions
etc. before quoting his rates. He must go through all the drawings, specifications and other
tender documents. Any further clarifications in the drawings and documents can be had from the
HIL at the above mentioned address.

7.6 Quantum of work


A schedule of approximate quantities for various items accompanies this tender. It shall be
definitely understood that HIL do not accept any responsibility for the correctness or
completeness of this schedule in respect of items and quantities and this schedule is liable to
alteration by deletions, deductions, or additions at the discretion of HIL without affecting the
terms of the contract. HIL reserves the right to increase or decrease the quantum of work at site
without assigning any reason.

7.7 Method of quoting rate


The contractor's rate must be firm and include the cost of transportation of
material to the site, taxes such as W.C.S.T and Octroi etc. and the fixing or placing
in position for which the item of work is intended to be operated. The rates quoted by
the Contractor shall be firm throughout the contract period and there shall be no upward
revision of the rates quoted by the contractor for any reason whatsoever. In addition to
the statutory deductions towards Income Tax, work contract tax and ESI & PF shall be
deducted on the state government at the current rates. However the rate of deduction
towards work contract tax shall be changed if the government revises the rates. And also
deductions shall be made towards any other tax imposed by the government prior to the
last date for submission of tender. It should be clearly understood that any claims for
Sales Tax, Excise duty, Construction tax or any other tax existing as on the last date for
submission of tender, shall not be entertained in any case what so ever once the tenders
are opened. Also, any claim on account of variation in the rates of taxes prevailing as on
the last date for submission of Tender, will not be considered.

7.8 Interpreting specifications


a. In interpreting the specifications, the following order of decreasing importance shall
be followed:
I. Schedule of Quantities
II. Special conditions of contract
III. Drawings
IV. Technical Specifications
V. General conditions of contract & Instructions to tenderers
b. Matters not covered by the specifications given in the contract as a whole shall be
covered by the relevant Indian Standard Codes. If such codes on a particular
subject have not been framed, the decision of HIL shall be final.
