Mcllnay that the Wisconsin Department of Natural Resources (DNR) has issued a “WPDES Construction Site Storm Water Runoff” permit to Richard and Yvonne Holz for the property located at 609 Scenic Road. The legal counsel for Scenic Pit LLC. further advised that his client is ‘proceeding with its plan to fill this pit without seeking local approvals’. ‘The Village takes the position that local approvals are needed and none have been granted to date. This position, that local approvals are necessary, is based largely on representations made to the Village by the DNR. Over the last several months the Village has been in close communication with the Wisconsin DNR. regarding Scenic Pit LLC.s proposed operations and they were assured that local approvals are, in fact, a requirement.
