1. Mobile tower installation rules.

Regulations regarding Mobile Telephony Towers issued by Environment Department,


Government of West Bengal from time to time.
No. EN/939/T-IV-1/001/2006

ORDER
WHEREAS,theDepartmentofEnvironment,GovernmentofWestBengal,isentrusted
toprotectenvironmentincludeswater,airandlandandtheinterrelationshipwhichexistsamong
andbetweenwater,airandland,andhumanbeings,otherlivingcreates,plantsmicroorganismand
propertywithintheterritorialjurisdictionofWestBengal;
ANDWHEREAS the DepartmentofEnvironment,GovernmentofWestBengal,is
empoweredunderEnvironment(Protection)Act,1986andRulesmadethereunderforimposing
restrictionsupontheindustries,operationorprocessformaintainingsafeguardoftheenvironment
andalsoentrustedforlayingdownprocedureforthepreventionofenvironmentalhazards.
ANDWHEREAS theDepartmentofEnvironmenthasreceivednumberofcomplaints
regardingindiscriminateinstallationofmobiletowersinresidentialandschoolbuildingandafter
necessary technical scrutiny and after considering different technical papers, it is observed that
overwhelmingincreaseinthenumberofinstallationofmobiletowersevenonresidentialbuildings,
schools,hostelsandhospitalsandsuchinstallationshaveaharmfulelectromagneticradiations;
ANDWHEREAS itisobservedthatinNewDelhi,PrincipalSecretary,Healthand
FamilyWelfarehadalreadyissuedacircularinrespectofguidelineforinstallationofthemobile
towers;

HENCE,inexerciseofthepowersconferredunderEnvironment(Protection)Act,1986

andrulesmadethereunder,allmobilephoneserviceprovidersareherebydirectedtofollowthe
followingguidelinesstrictlyatthetimeofinstallationofthemobiletowers.

InstallationofBaseStationAntennaswithinthepremisesofschoolsandhospitalsmaybeavoided
becausechildrenandpatientsaremoresusceptibletoElectroMagneticField.

InstallationofBaseStationAntennasinnarrowlanesshouldbeavoidedinordertoreducetherisks
causedbyanyearthquakeorwindrelateddisaster.
TheBaseStationAntennasshouldbeatleast3mawayfromthenearbybuildingandantennas
shouldnotdirectlyfacethebuilding.Further,thelowerendoftheantennashouldbeatleast3metre
abovethegroundorroof.
Incaseofmultipletransmittersitesataspecificlocalitysharingofacommontowerinfrastructure,
shouldbeexplored,asfaraspossible,whichcanbecoordinatedthroughanodalagency.
AccesstoBaseStationAntennasitesshouldbeprohibitedforgeneralpublicbysuitablemeanssuch
aswirefencing,lockingofthedoortotheroofetc.Accesstotowersite,evenforthemaintenance
personnel,shouldbeforaminimumperiodasfaraspossible.
Signboards/WarningSignsaretobeprovidedatBaseStationAntennasiteswhichshouldbeclearly
visibleandidentifiable.Awarningsignshouldbeplacedattheentranceofsuchzone.
TheWarningSignshoulddiscouragelongerstayinthezone,evenforthemaintenancepersonnel.
Thesignboardmaycontainthefollowingtext:
Danger!RFradiations,Donotenter!
RestrictedArea.
Theoperatorsandmaintenancepersonnel,whoaredealingwithradiofrequencydevices,specially
withBaseStationAntennasinstalledontowersandatanyotheroutdoorsites,shouldbeprotected
fromelectromagneticradiations.Itisrequiredthatoperatorsandmaintenancepersonnelshouldbe
educatedforpossiblehazardsfromthesedevices.
All local authorities arealso requestedthat before givinganypermission for installationof the
mobiletowersaforementionedguidelinesshouldbeconsider.
Incaseofnoncomplianceoftheaforementioneddirections,regulatoryorderwillbeissuedin
accordancewithlaw.

Circulartoallthelocalauthoritiesi.e.Corporations,MunicipalitiesandGramPanchayatsunder
Memo No. EN/939/TIV1/001/2006 dated 24042008, mentioning thereto that at the time of
givingpermissionforinstallationofmobiletowerbythelocalauthorities,theguidelineofthe
DepartmentofEnvironmentshouldbefollowed.

AND WHEREAS itisreportedtotheDepartmentofEnvironmentthatsomeofthe

municipalitiesandgrampanchayatshavebeenrefusingtogivepermissionforinstallationofmobile
towersonthepleathatsuchunitswillhavetoobtain`NoObjectionCertificatefromtheWest
BengalPollutionControlBoard.
ANDWHEREASaftercarefulconsiderationonceagainitisreiteratedthatenvironment
clearancefromtheWestBengalPollutionControlBoardfortheinstallationofthemobiletoweris
notrequireasthelocalauthorityandthepanchayatsarealreadyempoweredandentrustedunderthe
lawtogivepermissionforinstallationofmobiletowersubjecttomaintainingtheguidelinesissued
bytheDepartmentofEnvironment.
HENCE,allMunicipalandPanchayatauthoritiesarenowherebyinstructedtogive
necessarypermissionforinstallationofmobiletowersmaintainingtheguidelineoftheDepartment
ofEnvironment.
This is as per the approval of the Principal Secretary, Department of Environment,
GovernmentofWestBengal.

necessarypermissionforinstallationofmobiletowersmaintainingtheguidelineoftheDepartment
ofEnvironment.

DIRECTION

WHEREAS, Department of Environment is entrusted to curb and mitigate pollution

problemintheStateofWestBengalalongwithWestBengalPollutionControlBoard(hereinafter
willbereferredtoasthe`StateBoard).
AND WHEREAS Department of Environment is receivingnumber of complaints in
respectofpollutionalproblemgeneratedfromtheDieselGeneratorSetspeciallyinstalledbythe
mobile tower company and also by the different entrepreneurs for the purpose of generating
electricity.
AND WHEREAS it is observed that due to use of generator by the mobile tower
companyalargenumberofpeopleareaffectingfromtheairpollutionandnoisepollutionand
therefore,itisnecessarytocontrolthepollutionfromthesources.

AND WHEREAS inthemarketbatteryisavailablewhichcaneasily substitutethe


diesel generator set and use of battery set for the mobile tower will definitely reduce the
pollutionalloadandalsorelievethesurroundingpeoplefromthesufferingofairpollutionand
noisepollution.
HENCE, in exercise of the powers conferred under Section 18 and 19 of the Air
(Prevention & Prevention & Control of Pollution) Act, 1981 and rules made thereunder, the
followingdirectionsarebeingissuedforimplementation:

Thenewupcomingallmobiletowercompaniesshouldnotinstallanydieselgeneratorset
fortheircaptivepowerrequiredduringloadsheddingandtheyareatlibertytousebattery
forobtainingpowerduringloadsheddingperiodandwhereelectricityisnotavailable,in
suchareathesolarpowerorbatterypowershouldbeusedforthenewupcomingmobile
towercentres;

Themobile tower company shouldalsoensure that wherein Diesel Generator Set has
alreadybeeninstalledinsuchcasethesamemaybesubstitutedbybatteryorbythesolar
systemforobtainingpowerwithinMay,2010.

TheStateBoardshouldnotissueany`ConsenttoEstablishand`ConsenttoOperateto
usedieselgeneratorsetformobiletowercentrefurtherandalsogivenecessarydirection
toswitchoverallDieselGeneratorSetalreadyinstalledbythemobiletowercompanies
maintaining the aforementioned directions i.e. to convert into battery system or solar
systemwithinMay,2010.

Itisfurtherorderedthatincaseofnoncomplianceoftheaforementioneddirectionsbythe
mobiletowercompanies, necessarylegalactionwillbetakenasperprovisionof theAir
(Prevention&ControlofPollution)Act,1981andRulesmadethereunderandalsotheDiesel
GeneratorSetmaybeconfiscatedinaccordancewithlaw.
Thisorderwilltakeimmediateeffect.
