MINUTES
CITY COUNCIL SPECIAL MEETING
CARMEL-BY-THE-SEA
July 15, 2015
Mayor Pro Tem Talmage called the meeting to order at 4:35 p.m. Mayor Burnett
participated via telephone conference call from the following location:
George Fraser Community Room, Ucluelet Community Centre, 500 Masterson
Drive, Ucluelet, British Columbia, Canada.

PLEDGE:

Council Member Dallas led the pledge of allegiance.

Item 1:

Consideration of options for the Forest Theater Projects,


including handicapped parking, west pathway and the
driveway, as well as alternate vehicular access location(s).

Mayor Pro Tem explained that he and Councilmember Beach met as a Council
subcommittee to address concerns about the location of the handicapped
parking stall to be constructed as part of Triage Phase of the Forest Theater
rehabilitation. Using conceptual drawings to illustrate alternatives,
Councilmember Beach summarized various options to redesign the previouslyapproved ADA-compliant parking space.
Public Works Special Projects Manager Andrew Vanderford reported that the
construction is underway and is expected to be complete in November or
December. He explained that a change order would delay the construction by
one to two months.
Community Planning and Building Director Robert Mullane stated that the current
project is for repair and maintenance to address urgently issues regarding ADAcompliance, which is not subject to the California Environmental Quality Act

(CEQA). He cautioned that any significant change to the project would trigger
CEQA analysis and recommended that any proposed alternations to the design
be reviewed the Planning Commission and Historic Resources Board.
Council questions followed.
Public Comments:
Stacey Meheen asked if the plan is changed if it would delay the construction
schedule.
Kathryn Gualtieri, Barbara Livingston and Carolyn Hardy spoke in favor of
moving forward with the current project, as planned and approved.
Karen Ferlito urged the Council to get input from the Forest and Beach
Commission about any changes that may have a potential impact on the trees.
Stephen Moorer, Ian Martin, Karyl Hall, Michael LePage, Yvonne Moen, Brian
Congelton, Sue McCloud and Judy Furman commented in support of considering
design alternatives.
---End of Public Comments--City Administrator Doug Schmitz emphasized that the staff has a duty to provide
the Council with all of the information that it needs to make good decisions,
including important cautions and considerations, as expressed verbally by staff
and as outlined in the staff report.
Building Official Joe Headley provided clarification about the ADA-compliant
parking space, the building permit and the issuance of the Certificate of
Occupancy.
Mayor Pro Tem Talmage called a recess at 5:38 p.m. The meeting resumed at
5:45 p.m. Council discussion ensued.
Action: On a motion made by Councilmember Theis, seconded by Mayor Pro
Tem Talmage, the Council unanimously provided the following direction to staff:
1) Reorient the handicapped parking space in the approved plans with the
intent of not triggering CEQA; 2) Meet the March 2016 deadline; 3) The
approved driveway and walkway (attached to driveway on west side) are to
be gone; meet with Otto Construction ASAP; 4) Planning Commission to
review plan on an expedited basis; 5) Approved driveway/walkway subject of
a change order for removal; 6) Goal is to keep a handicapped space out of
vehicle/pedestrian conflict mode; 7) Incorporate Otto into process; and 8)
Planning Commission to look at new west path as part of its review. Motion

Mayor Burnett mentioned that he has been in conversation with a major donor
and will bring back more information formally to the City Council.
ADJOURNMENT: There being no further business, Mayor Pro Tem Talmage
adjourned the meeting at approximately 6:45 p.m.
