Sir,
The applicant respectfully submits as under:-

1- That the applicant has filed a complaint against the opposite parties before the
Hon’ble forum.

2- That the applicant made Reebok India Limited Cannought Place, New Delhi as
opposite party No. 2.

3- That now the applicant does not want to continue the said complaint with opposite
party no. 2 because the applicant does not have proper address of opposite party no. 2
and in absence of not having the address of opposite party no. 2 the summoning is not
possible to it and the proceedings of the said complaint is not possible.

It is therefore prayed that the opposite party no. 2 may kindly be removed from
the said complaint.

GIFT DEED

This Gift Deed is made on this the 08 th day of February 2010, between Smt Poonam
Katoch W/o Col. D.C. Katoch D/o Late Shri Balbir Inder Bali R/o 7 Mall Road,
Garhi Cantt., Dehradun. (hereinafter called the “Donor”) of the one part;
AND

Smt. Mona Bali W/o Dr. Brij Mohan Sharma D/o Late Shri Balbir Inder Bali R/o
64 East Rest Camp, Dehradun. (hereinafter called the “Donee”) of the other part;

Both the terms the “Donor” and “Donee” unless repugnant to the context sell
mean and include there respective heirs , representatives, successors and assigns etc.

WHEREAS the Donor had purchased the scheduled property morefully shown
in the scheduled herein under at the foot of this deed from Smt. Vijay Shakti vide sale
deed dated 25.01.2007 which is duly registered in the office of sub-registrar II
Dehradun at Book No. 1, Vol. 1698, Page 56, A.D.F. Book No. 1, Vol. 1711 page 73
to 88 at No. 894 on dated 27.01.2007 and the name of the donor is duly mutated in the
relevant municipal records.

AND WHEREAS The scheduled property is free from all encumbrance,
charges, acquisition or any sort of disputes, litigation and proceedings and the Donor
has right to transfer the scheduled property.

AND WHEREAS the donor has agreed to gift the scheduled property to the
donee and the donee hereby accepts the gift given to her from the donor.

The donor DOTH hereby convey, transfer and assign all her rights of
ownership, easements whatsoever in the property mentioned in the schedule herein
under, to the donee as her property forever, free from all encumbrance, charges,
acquisition etc. without any obstructions, hindrance from the donor or any other
person claiming through or under her either directly or indirectly in any manners
whatsoever.

That the actual physical possession of the property hereby gifted has been
delivered to the donee and the donee shall have rights to use and utilized the said
property in any manner she may like.

That the donee shall hereafter be fully entitled to use, hold and enjoy the
scheduled property in any manner, make construction on it or make sale, transfer in
any manner and mortgage the same without any let hindrance or interruption from the
donor or any other person whomsoever.

NOW THIS DEED WITNESSETH AS UNDER;-

(a) That the property hereby transferred is free form all charges, liens, mortgages and
encumbrances, demands, claims or any other sort of attachment and the donor has
done no Act whereby her right to transfer the same is restricted in any manner.

(b) That the donor had paid all the taxes, ceases, water and electricity bills, charges
due in respect of the scheduled property hereby transferred up to the date of gift and
thereafter it shall be the responsibility of the donee to pay the same.

(c) That the donee has right to get the scheduled property mutated in her name in the
relevant municipal records.

(d) That donee has right to change the electricity and water connections fitted in the
schedule property if any, in the relevant offices in her name.

(e) That the scheduled property is situated within municipal corporation limit thus
there is no violation of Uttaranchal act 29 of 2003.

(f) It is made clear that the property on ground floor belongs to Smt. Vijay Shakti and
the boundry wall is also property of Smt. Vijay Shakti and not being transferred by
virtue of this gift deed.

(g) That the scheduled property is situated at Kishan Nagar, Dehradun, the market
value of the land on ground floor which is 21 sq. mts (for garrage and stair case)
comes to Rs. 1,36,500 at the rate of Rs. 6,500/- per sq. mts. and the market value of
the open roof which is 148 sq. mts. comes to Rs. 8,65,800/- at the rate of 5,850/- per
sq, mts, after giving depreciation of 10% on circle rate i.e. Rs. 6,500/- per sq. mtr.
being on the first floor thus the total market value of the scheduled property comest to
Rs. 10,03,000/- on which the stamp duty has been paid according to law.

(h) That the donor and donee are real sisters. The stamp duty is being paid at the rate
of 3% according to government order.

WEST – Property of Smt. Vijay Shakti,
NORTH – Property of Smt. Vijay Shakti thereafter 20 ft. wide Road,
