sale shall be preserved. All sale proceeds shall be retained by the Receiver in an interest bearing
escrow account and shall not be disbursed pending further order of this Court; provided, however
that the Receiver may make disbursements ofsale proceeds necessary to fulfill his obligations to pay

the Cleanup Costs (as defined in the Agreement); and

Except as provided in paragraph8 herein,nothingin this Order shall be construedas

waiving or otherwise effecting any rights, claims, defenses, objections or other interests of the
Secured Claimants, Austin or other creditors with respectto the Hydrotreater Assets, the existence or

priority of liens on proceeds from the sale, the distribution of sales proceeds, or otherwise, and all

such rights, claims, defenses, objections orotherinterests shall beresolved byseparate order ofthis
Court at a later date, after all interested parties have opportunity to be heard.
IT IS FURTHER ORDERED that within three (3) days ofthe date ofthis Order, the Receiver

shall mail a copy of the Order to all known creditors and parties-in-interest who have or may have

claims against KiOR Columbus, LLC ortothe Hydrotreater Assets, commanding such parties tofile
notice inthis Court ofanyclaim to theKiOR Columbus assets and/or written objection tothis Order

onorbefore September 11,2015. The Receiver shall file a certificate ofservice with the Clerk of
Court confirming the notice of this Order.
