RESPONSE

Responsestosexualassaultallegationsmustbesurvivorcentricandtraumainformed
tothebestextentpossible
Intheinstanceofareportedassault:
Fraternitymembershouldtellthesurvivorhebelieveshim/her,andthat
theassaultisnotthefaultofthesurvivor.
ProvidethesurvivorwiththeinformationfortheTitleIXcoordinator,
counselingservices,andtheoptionofaforensicexamination.
Encouragethesurvivorinhis/herdecisiontoreport/notreportto
universityofficialsorlawenforcement.
ReportthePERPETRATORtothefraternitypresident,butrespectthe
survivorsdecisiontoremainanonymousifsodesired.
Brothersaccusedofsexualassaultshouldbeplacedundertemporarysuspensionuntil
aninvestigationcanbecompleted
TheretractionofsuspensioniscontingentonBOTHtheuniversityfindingthe
accusednotresponsibleANDtheapprovalofthefraternityforreadmittance
Eveniftheuniversityfindstheaccusednonresponsible,thefraternityreserves
therighttoindefinitelysuspendorterminatefraternitymembership
Fraternitybrotherswithknowledgeofasexualassaultmustreporttothefraternity
presidentorrisksuspension.Thisdoesnotrequirethatthesurvivorparticipateinanyof
thefraternitysproceedings.

Retaliationagainstsexualassaultsurvivorsorwitnessestoasexualassaultisexplicitly
prohibited.Theexecutivecouncilofthefraternityreservestherighttoremoveany
memberwhoinfringesuponthispolicy.
Possibledefinitionofretaliation:
Threats,otherformsofintimidation,andretaliation
againstasurvivorofsexualassault,witnesstoasexualassault,orfriendofa
survivorofsexualassaultforbringingacomplaintofharassmentordiscriminationor
forassistinganotherinbringingacomplaintisprohibited.

ADVOCACY

Fraternitiesshouldholdtheiruniversityaccountableforupholdinggoodpolicy
concerningsexualassaultbypetitioningfor:
Creatingandenforcinganamnestypolicyensuringthatanyonewhoreportsoris
awitnessforasexualassaultinvestigationwillnotbepenalizedfornonviolent
disciplinarycodeviolations.
Mandatorysmallgroupinpersonconsenteducationandbystanderintervention
trainingatorientationandatthebeginningofeachschoolyear
Comprehensivecampusclimatesurveys
Consenttobedefinedasaffirmativeinthestudentconductcodeorapplicable

Affirmative,conscious,andvoluntaryagreementtoengageinsexual

Thiscaninclude,butisnotlimitedtotheunderstandingthat:membersof
blackandbrowncommunitiesmayhavedifferentexperienceswithlaw
enforcement,andthatthosehistoricalcontextsoughttobeconsidered
whenconsideringinvolvinglawenforcementinvolvementundocumented
studentsmayalsobewaryoflawenforcementinvolvement,evenifthey
havebeenvictimsofacrimesexualassaultcanalsohappenbetween
chaptermembers,andinfact,theratesofcampussexualassaultare
evenhigherformembersoftheLGBTQ*communitythantheyarefor
womenandsurvivorswhoaredifferentlyabledmayneedmorenuanced
kindsofsupportfromtheirchapters.

Theuniversityoughttohireatleastoneconfidentialresourcespecialisttohelp
guidesurvivorsthroughgettingaccommodations,counseling,and/orreportingto
lawenforcementortheuniversity
Developaclearunderstandingofthefraternitysrelationshipwithlaw
enforcement
Forexample:Educateyourmembersonwhetheranofficerhastheright
toenterthepremisesifasexualassaultisreportedandthepoliceare
called.
Theuniversityoughttocreateupamemorandumofunderstanding
(MOU)betweenitselfandthelocalpolicedepartmentsothatitisclear
whohasjurisdictioninwhatsituationandthatstudentsaredirectedtothe
rightplace.
