WHEREAS, on February 24,2010, the Comnlission on Elections promulgated
Resolution No. 8785 prodding for the R~tlesand Procedur+eaJor the Testing and
Scclli~tgof the Precinct Count Optical Scan (PCOS] Machines;
WHEMAS, due to technical problems encountered with the Colnpact Flash
(CF)Cards of the PCOS mnchitles during the conduct of Testing and Senlillg of the
latter in some areas on May 3,2010, Resolution No. 8865 was promulgated on May 5,
2010 extending the period for testing and seallng to Itlay g, 2010;

WHEREAS, the reconfigured (3F Cards will be delivered to the fleld until May
9,2010;

WHEREAS, there are reports from tl~efield that some PCOS machines
delivered inadvertently do not have ~vitbthem the Test Ballots to be used for the
testing and seallng;
N O W THEREFORE, pursuant to the powers vested in it by the Constitution,
the Omnibus Election Code, Republic Act No. 9369, and other election laws, the
Commission RESOLVES, as it. hereby RESOLVED, to pronlulgate the follo~ving
contingency procedures for the Testing of the PCOS Machines:

SECTION I., Period for* tesiitzg of PCOS Jfabhirte. I n the event that the
CF Cards will not al-rive on May 9,2010, or the test ballots are not included with the
PCOS Machines, the testing of the PC09 Machine concerned shall be conducted on
election day, May lo, 2010 before the start of the initialization procedures;

Sec. 2. Test Ballots The test ballots to be used shall be those included in
the flnal Testing and Sealing (FTS)Kit. In casc no test ballots are incll~dedin the FTS
Kit, the Board of Elcctiorl Inspectors (BEI) sl~allget three (3) official ballots to be used
in the testing of the PCOS Machine, and record such fack in the Mii~utesof Testing
and Sealing ~ n Minutes

Sec. 3. Procedttrerr - The ~~~~~~~~~s for the testing protided under

Resolution No. 8785 shall be obsen~ed,and after the ~nanualcounting of the ballots,
the BE1 shall write the words "TESr R4LL01'9" at the lower back portion of the
ofAda1 ballots that were used for the testing. Horvever, the procedures for the shutting
down and senling of the PCOS Machines provided under Section ti of said Resolutioll
shall no longer be observed. Immediately after the testing and comparison of the
manual results, the BE1 shall re-zero the PrSOS Machines, and proceed with the
il~itializationprocedures and, thereafter, voting should forthwith commence;

Sec. 4.Eflectidty and dissemi~~ation,This Resolution shall take effect:

The Education and Information Depatrnent shall furnish copies thereof t* all
Regional Election Directors, Pro-iincid Election Supenisors, Election Officers, and
accredited political parties. The Elmtion Officers shall inform all Boards of Election
Tnspectors of this Resolution.
