RESOLUTION NO. 108 82

WHEREAS, the Commission on Elections (Commission), pursuant to


Minute Resolution No. 17-0153, issued on March 74,2017, allows only its
regular empioyees to handle and operate the Voter Registration Machines
(VRMs); and to act on other matters that require access to data information
of registrants in the said VRMs during the period for the conduct of the
system of continuing registration of voters;

WHEREAS, Section 7, paragraph 2.6 of the Field Office Systems and


Data Policy requires that only regular personnel of the Commission
assigned at the Offices of the Election Officer or at the Offices of the
Provincial Election Supervisor shall have access to the VRM;

WHEREAS, the above employees of the Commission are authorized


to receive and process in the Voter Registration System (VRS) the personal
information of the applicalts for plrrposes of voter registration;

WHEREAS, in a recent assessment conducted by the Commission,


it was determined that the insufficiency of VRMs and personnel who are
authorized and capable to operate the same largely contributed to the long
queues of applicants in the registration venues, especially during the tail
end of the registration period;
WHEREAS, in line with the objective to enhance voters' registration
experience, it is necessary to augment the existing number of VRMs and
personnei allowed to operate the same in areas with influx of registrants
as determined by the Commission;

NOW THEREFORE, the Commission on Elections, by virtue of the


powers vested in it by the Constitution, Republic Act No. 8 i89,
the Omnibus Election Code, and other registration and election 1aws,
has RESOLVED, as it hereby RESOLVES to:

1. Authorize Plantilla Casual Employees hired by the Commission,


in areas where additional VRMs will be deployed, to receive,
process personal information from applicants and have access to
the VRMs during registration period for purposes of voter
registration only;

2. Direct the Information Technologz Department (ITD) to provide


extensive training to the above authorized employees/ personnel
on the proper handling of information pursuant to data privacy
policy of the Commission in accordance with Republic Act No.
10173, otherwise known as the Data Privacy Act of 2012, and the
technical aspect of operating the VRM;

3. Require the above employees to execute and submit to the


Election Officer, prior to commencement of duties, a Non-
Disclosure Agreement (NDA) stating, among others, the duty to
duly secure the confidentiality of all personai information of
applicants received and processed during the registration period;

4. Direct the concerned Election Officers (EOs) to exercise immediate


control and supervision with due diligence over the plantilla
casual employees authorized to operate the VRMs during the
registration period;

5. Direct the EOs to ensure that the said employees perform their
duties strictly in accordalce with the pertinent laws and rules on
voter registration, data privacy, and the Field Office Systems and
Data Policy; and

6. Direct the Regional Election Directors (REDs), Assistant Regional


Election Directors (AREDs), and Provincial Election Supervisors
(PESs) to exercise overali supervision over concerned plantilla
casual employees, under the principle of command responsibility,
and to ensure the proper implementation of the provisions of this
Resolution.

Let the Office of the Executive Director/ Data Protection Officer, Office
of the Deputy Executive Director for Operations, Election and Barangay
Affairs Department, Offrces of the Regional Election Directors, Provincial
Election Supervisors, and Election Officer implement this Resolution.
