HASAWA

The Health and Safety at Work Act (HASAWA) is a law that was
introduced in 1974. It aims to provide all workers with protections
against hazard at work such as personal protective equipment and
any action that can reduce the risk. This law is provided to factories,
offices, hospitals, transports and other premises. It covers the
employees as well as the employers. An employee should as an
employee the responsible for his safety are herself and the
employers. So, the employers should make sure that the workers
already understood by providing trainings. HASAWA cannot replace
the factorys act but it gives protection to employees to get writing
statement of general policy with respect to the health and safety
from the employers. There are several laws which growing up during
30 years. It gives more protection to employees and get more
beneficial to the employers.
In April 2008, the Health and Safety Executive (HSE) was found in
order to administer the HASAWA. It employs power and penalties
inspector to enforce the act. The are 3 main systems which is
developed by HSE
1. Improvement Notice
Inspectors will issue this notice to the employees for
correcting things within a specified time
2. Prohibition notice
If the employees cannot comply the improvement notice, the
inspector can issue prohibition notice to force the employee to
stop the operation. The inspector can also issue immediate a
prohibition notice if there is an immediate danger to workers.
The scope of these notices is to protect the employee from
very serious consequences of injury.
3. Fines and Imprisonment
A fine will be given to everyone who fails to comply with any
of these notices whish are stipulated by a magistrate court,
even unlimited fine or imprisonment will be given if the
offences a more serious. And also continuing daily fine for
each day will be given for an employee who doesnt comply
with this notice.
As I mention earlier HASAWA ensures the Health and Safety
and give more beneficial for the employees. It says that the
employers has responsibility to the employees so do the employees.
As an employer besides providing trainings to the employees, they
must make sure that all of machinery and working area is safe.
To reduce a damaging effect of working without protection,
HASAWA also says 5 hazards that can cause accident, diseases, and

death. The hazards are noise, vibration, radiation, temperature, and


chemical substances. HASAWA says by controlling them, it can
reduce every risk.
