InlightoftheissuesraisedintheEUPilotcommunication,weproposetointroduceanewrelaxationtobringtherequirementsfor
safetydevicesforbothprimaryandsecondarysystemsofunventedhotwaterstoragesystemsinlinewiththerequirements

withinPartGoftheBuildingRegulations2010.TheBuildingRegulationshavealreadybeenamendedinlinewithsimilarconcerns
raisedbytheCommissionintheirDetailedOpinionin2009.Thereforetherelaxationwillprovideamoreconsistentregulatory
approachandensurethattherequirementsoftheWaterSupply(WaterFittings)Regulations1999donotimpedetheinstallation
ofhotwaterboilersthatmeettherequirementsofDirectives97/23/ECand2009/142/EC.
TheWaterRegulationsAdvisoryScheme(WRAS),whoaretechnicalexpertsinthefieldofproducttestingforRegulations
complianceandprovideadvicetoDefraonthisarea,requestedtherelaxationonbehalfofwaterundertakersinEnglandand
proposedthefollowingamendedtext:
TherequirementsofParagraphs17,18and23ofSchedule2oftheWaterSupply(WaterFittings)Regulations1999,regarding
theprovisionofsafetydevicesforpreventingthetemperatureofwaterexceeding100Cinprimaryorsecondaryunventedhot
waterstoragesystems,tobecompliedwithbytheprovisionofsafetydevicesforthesamepurposeswhichsatisfythe
requirementsofPartGoftheBuildingRegulations.

9.BriefStatementofGrounds
TheseregulationswereoriginallydraftedonajointEnglandandWalesbasis,however,thereareseparaterelaxationsinrespect
ofEnglandandWaleswhichwillcomeintoeffectondifferentdates.ForthisreasonEnglandhavealreadynotifiedtheirrelaxations
separatelytoWales,thepreviousnotificationnumberis2011/0184/UK.
TherelaxationisinresponsetotheCommission'sconcernsthattheWaterSupply(WaterFittings)Regulations1999(S.I.
1148/1999)(WSWFR)containprovisionsthatimpedetheplacingonthemarketand/ortheputtingintoserviceofhotwater
boilerswhichcomplywithDirective97/23/EConpressureequipmentandDirective2009/142/ECongasapplianceswhichbearthe
CEmark.
TheWSWFRrequirethatunventedwaterheatersshallincludeappropriateventpipes,temperaturecontroldevicesand
combinedtemperaturepressureandreliefvalvesshallbeprovidedtopreventthetemperatureofthewaterwithinasecondary
hotwatersystemfromexceeding100C.Thispreventstheinstallationofhotwaterboilerswhichareequippedwitha
thermostatictemperaturecontrolandaseparatepressurereliefvalvewhichcomplywithDirective97/23/ECand/orDirective
2009/142/EC.
However,Directives97/23/ECand2009/142/ECdonotrequiretheinclusionofacombinedtemperatureandpressurereliefvalve
andthechoiceofthetechnicalsolutiontomeettherequiredsafetylevelbytheDirectivesislefttothemanufacturerofthe
product.TheprovisionsintheWSWFRaremoreprescriptiveandincompatiblewithArticle4(1)ofbothDirectiveswhichstates
thatmemberstatesmaynotprohibit,restrictorimpedethesaleandinstallationofapplianceswhichcomplywiththeprovisions
ofthatDirective.
