Dear District Attorney Rice,

I've reviewed the responses to questions asked of us at the WABC-TV debate with
respect to stop-and-frisk policies in New York City and elsewhere. I specified my
concerns in my letter to you, but absent any response other than the debate I believe we
need to keep the public record honest and clear.

Your response to my concerns was that, "he is simply wrong on the facts" and asserted
that the program was done in partnership with the community. I never offered any views
about who sought your “stop-and-frisk" program, and I never challenged the other
aspects of the program that involved arrests of wrongdoers. If I'm wrong about the facts,
let's make that clear. If I'm not, let's make that clear.

Accordingly, please accept this letter as an official request under the Freedom of
Information Act, for copies of the 84 letters that were sent out to innocent passers-by that
are referenced in your press release of January 14, 2008, and any other such letters that
were sent out at other times. And I ask that you respond to the following factual
questions:

How many such letters were sent out?


What was the text of such letters?
Are the names and addresses of those who received the letters still retained?
Who has access to them?

You quite publicly have opposed the retention of similar records by the New York City
Police Department. I again call upon you to destroy such records in the possession of
Nassau County, and look forward to your clarification of what, if any "facts" I got wrong.
