Events beyond our control

Neither the University nor yourself shall be liable nor able to terminate this contract
for any failure to perform as a result of events beyond the control of the party
affected. This assumes that there was neither fault nor negligence and that the said
party was unable to prevent or provide against such an event through reasonable
diligence. Such occurrences might include: acts of nature (including fire, flood,
earthquake, storm, hurricane or other natural disaster), war, invasion, terrorist acts,
labour disputes, or the prolonged failure of electricity or other vital utility service.
Any Party asserting such events as an excuse to performance shall be required to
demonstrate that reasonable steps were taken to minimize the delay and damages
caused by events when known and that the other Party was notified as soon as
possible.
