INFORMATION IN RESPCT OF THE ELECTION COMMISSION


OF INDIA

(i) The Particulars of the Commission organization, function and duties.

Election Commission of India is a permanent Constitutional Body. The Election


Commission was established in accordance with the Constitution of India on 25th
January 1950. The Constitution of India has vested in the Election Commission of India
the superintendence, direction and control of the entire process for conduct of elections to
Parliament and Legislature of every State and to the offices of President and Vice-
President of India.

(1) Originally the Commission had only one Chief Election Commissioner. It
currently consists of Chief Election Commissioner and two other Election
Commissioners.

The Commission has a separate Secretariat at Nirvachan Sadan ,


Ashoka Road, New Delhi, Consisting of about 350 officials, in a hierarchical set up.

Two or three Deputy Election Commissioners who are the senior most officers in
the Secretariat assist the Commission. They are generally appointed from the national
civil service of the country and are selected and appointed by the Commission with
tenure. Directors, Principal Secretaries, and Secretaries, Under Secretaries and Deputy
Directors support the Deputy Election Commissioners in turn. There is functional and
territorial distribution of work in the Commission. The work is organized in Divisions,
Branches and Sections; each of the last mentioned units is in charge of a Section Officer.
The main functional divisions are Planning, Judicial, Administration, Information
Systems, Media and Secretariat Co-ordination. The territorial work is distributed among
separate units responsible for different Zones into which the 35 constituent States and
Union Territories of the country are grouped for convenience of management.

At the state level, the election work is supervised, subject to overall


superintendence, direction and control of the Commission, by the Chief Electoral Officer
of the State, who is appointed by the Commission from amongst senior civil servants
proposed by the concerned state government. He is, in most of the States, a full time
officer and has a small team of supporting staff. (For further details please see

(ii) The powers and duties of its officers and employees.

The Election Commission is empowered to fix and announce the dates for various
elections. Revision of electoral rolls, and approval of polling stations. Appointment of
Chief Electoral Officers in each State & Union territories, designation of District Election
Officers, Returning Officers, Assistant returning Officers, Electoral Registration Officers,
Assistant Electoral Registration Officers etc. The Chief Electoral Officers, District
Election Officers, Electoral Registration Officers, Assistant Electoral Registration
Officers, Returning Officers, Assistant Returning Officers, are State Government Officers
designated under Representation of people Act, 1950 and Representation of People Act,
1951. They carry out Actual field works in the revision of electoral rolls and conduct of
elections.

(iii) The Procedure followed in the decision-making process, including channels of


supervision and accountability.

The Commission transacts its business by holding regular meetings and also by
circulation of papers. All Election Commissioners have equal say in the decision making
of the Commission. The Commission, from time to time, delegates some of its executive
functions to its officers in its Secretariat

in charge of a Section Officer. Under Secretary or Branch Officer looks after two or three
sections. Secretary, looks after one or more zones. The main functional divisions are

(iv) The norms set by the Commission for the discharge of its functions.
The Commission transacts its business by holding regular meetings and also by circulation of
papers. All Election Commissioners have equal say in the decision making of the Commission. The
Commission, from time to time, delegates some of its executive functions to its officers in its
Secretariat.
(v) The rules, regulations, instructions manuals and records, held by it or under its control or
used by it employees for discharging its functions
Its employees for discharging its functions used the Manual of Election Laws consisting of
Representation of the People Act, 1950, Representation of the People Act, 1951, Conduct of Elections
Rules, 1961, Registration Electors Rules, 1960, Compendiums on the conduct of elections, various
Hand Books etc.
(vi) A statement of the categories of documents that are held by it or under its control
(a) The manual of Election Laws, Compendiums ( compilation of various instructions issued by
the Commission from time to time for the conduct of elections), Various Hand Books like Hand Book
for Returning Officers, Presiding Officers, Polling Officers, Electoral registration Officers, Candidates
etc are available in the Commission as well as in the offices of Chief Electoral Officers and District
Election Officers as well as on Commission’s website.

( b) Electoral Rolls for assembly constituencies are available at the level of District Election
Officers, Returning Officers, Electoral Registration Officers. Two copies each of draft electoral rolls
and final rolls are made available free of cost to all recognized state and National Political parties.
Electoral Rolls are also available on the websites of Chief Electoral Officers of all States & U.Ts.
(c) Copies of affidavits filed by candidates at the time of nominations are available with the
Returning Officers and on the websites of Chief Electoral Officers.
(d) Statements of account of election expenses lodged by the contesting candidates are
available with the concerned District Election Officers.
(e) Details of election results are also available with concerned DEOs and ROs.

(vii) & (viii) The particular of any arrangement that exists for consultation with, or
representation with or representation by the members of the public in relation to the
formulation of it policy or implementation thereof.
A statement of the boards councils, committees and other bodies consisting of two
or more persons constituted as its part or for the purpose of its advice, and as to whether
meeting of those boards, councils, committees and other bodies are open to the public, or the
minutes or such meetings are accessible for public.

(a) District or Block level standing committees comprising of representatives of


recognized political parties and district level officials are constituted to discuss the law
and order situation and implementation of model code of conduct during elections.
Similar standing committees are also constituted to discuss for the creation of new
polling stations or modification of polling stations etc.
(b) At the Commission’s level, meeting with the representatives of recognized
political parties are held from time to time to discuss important issues like application of
model code of conduct and electoral reforms etc.

(c) Meetings are also arranged from time to time with the representatives of RWAs
and NGOs on electoral rolls.

Expenditure on Electoral Rolls, Electors Photo Identity Cards and Electronic


Voting Machines are borne by the Central Government and respective State
Governments. Expenditure regarding General Election to Lok Sabha is borne by the
Central Government and for General Election to the State Legislative Assemblies is
borne by the respective State Governments. In case of simultaneous election expenditure
is shared by the Central Government and respective State Governments on 50 : 50 basis.
The above expenditures are reflected in the budget for the M/o Law and Justice
and in the budget of respective State Governments.

(xii) The manner of execution of subsidy programmes, including the amounts


allocated and the details of beneficiaries of such programmes.

The Commission does not provide any subsidy on any programme.

(xiii) Particulars of recipients of concessions, permits or authorizations granted by


it.

Not applicable in case of the Commission.

(xiv) Details in respect of information, available to or held by it, reduces in an


electronic form.

Statistical data of elections held since 1952 are available in the Commission in its
website as well as in CDs and printed books. Since General Election to Lok Sabha, 2004
apart from election data, affidavit filed by the candidates are also available on the
website. The entire Electoral Roll of the country (except of those state where intensive
revision of Electoral Rolls has been ordered) are available on the ECI website and on the
website of Chief Electoral Officers.

(xv) and (xvi) The particulars of facilities available to citizens for obtaining
information.
