1. The jurors for the State upon their oath present that on or about January 14, 2003
through and until December 23, 2009, in Wake County, the Defendant named above unlavflly,
willfully and feloniously did knowingly and designedly with the intent to cheat and defraud,
obtain and attempt to obtain good and lawful United States currency having a value of
$393,949.56, which is an amount over $100,000, from Garner Volunteer Fire-Rescue, Ine, by
‘means of a false pretense which was calculated to deceive and did deceive.
The false pretense consisted of the following: The Defendant made out 301 checks
payable to herself drawn on the account of Gamer Volunteer Fire-Rescue, Ine. for money that
was not owed to her, totaling $393,949.56, and then recorded these transactions in the account
ledger as either being money paid for legitimate operating expenses for fuel or not recorded at al
This act was done in violation of N.C.G.S. 14-100.
2. And the jurors for the State upon their oath present that on or about January 14, 2003
through and unti] December 23, 2009, in Wake County, the Defendant named above unlawfully,
willfully and feloniously did, being the employee of Gamer Volunteer Fire-Rescue, Ine., go away
with and convert to the Defendant's own use money which had been delivered to be kept for her
employer's use, with the intent to steal and to defraud the Defendant's employer. ‘This act was
done without her employers consent and contrary to the trust and confidence placed in the
Defendant by her employer. The Defendant was over the age of 16 years old at the time of this
offense, The value of the money described above was $393,949.56, which is an amount over
$100,000. This act was done in violation of N.C.G.S. 14-74.David Saacks
