The contract labour

Act 1970
This act was passed in 1970 and came into
force from 10th feb 1971.The two major
objectives of this act are:
1)to regulate the employment of contract
labour in certain establishments.
2)To provide for the abolition of contract labour
in certain establishments.
Application of the act
• The act extends to whole of India . it applies:
1)To every establishment in which twenty or
more workers are employed or were
employed on any day of the preceding twelve
months as contract labour.
2)To every contractor who employs or who
employed on any day of the preceding twelve
months twenty or more workmen.
Few important definitions'
• Contract labour :a workman shell be deemed
to be employed as “contract labour” in or in
connection with the work of an establishment
when he is hired in or in connection with such
work by contractor ,with or without the
knowledge of the principle employer.
Definations
• Contractor it means a person who undertakes
to produce a given result for the
establishment , other then mere supply of
goods or articles.
• Controlled industry (sec 2 d ):it means any
industry the control of whioch by the union
govt has been declared by any central act to
be expedient in the public intrst.
Definations
• establishment: (section 2 e ):it means
1)Any office or department of the govt or a local
authority .
2)Any place where any industry
,trade,business,manufacturer or occupation os
carried on .
The advisory boards
1)Central advisory board
2)State advisory board
3)Power to constitute committee
Central advisory board
It shall consist of:
1)A chairman to be appointed by the central
govt.
2)The chief labour commissioner .
3)Such no. of members,not exceeding seventeen
but not less than eleven.
State advisory board….
1. A chairman to be appointed by the state
government
2. The labour commissioner,ex-officio, or in his
absence any other officer nominated by the
state government in that behalf.
Power to const. committee….
The commites are appointed by the state board
or central board. The transaction of
businesses are controlled by such committees
The members of the committee must be paid
legal allowances and fees for attending the
meetings of the committee.
Registrations of employee establishment (contract labour)…..

The act contains provisions for registrations of


establishments which provide jobs to contract
labour. It is described in 6 and 10 section of the
act. Process involved:
1. Appointment of registration officers.
2. Registration of certain establishments.
3. Effect of non registration.
4. Prohibition of employement of contract labour.
Licensing of contractors……

1. Appointment of Licensing Officer.


2. Licensing of contractors.
3. Grant of licences.
4. Revocation , Suspension and amendment of
licenses.
Welfare and health of contract labour…

The contractors are required to take the


following measures for welfare and health of
contract of labours:
1. Canteens
2. Rest Rooms.
3. Other Facilities.
4. First Aid Facility
Penalities….
The various penalities on the nonfulfillment of
contract labour requirements are:
1.Obsstructions
2.Contravention of provisions regarding
employement of contract labour
3.Other offences.
Inspectors (section 28)…
1. Right to inspect the place where the labour is
employed without any permission and having
the right to bring in the full assistance.
2. Examine any person in the work place that
whether he is a workman employed there.
3. Have authority to question any person or
workman to give information for whom he
works and with respect to the payments to be
made for the work.
