Dear Sir,
I have gone through the draft of letter of
appointment for fixed term contract of employment. The
clauses of appointment letter in question are correct except
changes conveyed to your goodself on telephone. It is pertinent
to mention here that company cannot engage temporary
workman for fixed period on a post, which is of permanent
nature. If a person is engaged on a job on temporary basis, but
same is of permanent nature, the individual concerned has the
right to claim his status of being permanent on completion of 3
months’ period. Moreover, the company cannot engage another
person on this post by terminating the services of previously
engaged person, who can claim his right against that post as the
post against which he was employed is of permanent nature. In
the field of labour legislation, a post, which is of permanent
nature, cannot be filled through an employee by appointing him
on temporary basis.

Note: - The case was fixed for 12.1.2002. The court sent
them notice earlier but the same could not be effected. The
court ordered to send fresh notice. We have got despatched the
notice. Now the case is fixed for 16.2.2002.
