Background:
The Challenge in Dr Joseph Zernik v Office of the Clerk of the Supreme Court
(8835/11) originated in the refusal of the office of the Clerk of the Supreme Court to
accept the November 27, 2011 Request for review by an expanded panel of the
Supreme Court of the case of Zernik v State of Israel (6041/11). [i]
The conduct of the Supreme Court relative to Zernik v State of Israel, is the best evidence
discovered so far for lack of integrity in the electronic record systems of the Court, and
the conduct of simulated litigation in the Supreme Court of the State of Israel. [ii]

intended recipient is a sufficient showing that the document was delivered.

To the Honorable Court and the Parties in this case:
The Appellant files herein a Challenge on the Office of the Clerk (the Challenge), and a
Request for Review by an Expanded Panel of the Challenge, Pertaining to Refusal to
Accept the Filing of: A request addressed to the chief justice for initial review by an
expanded panel, alternatively a premature request addressed to the chief justice for
additional review by an expanded panel, filed prior to the due entry of judgment, and a
request for due service of a signed decision on instant request. (the Request Exhibit
A)
This Challenge is filed pursuant to the Regulations of Civil Procedure (1984),
Regulations 412-421, following guidance by the office of the Clerk of the Court. Given
that the Challenger is not an attorney, and has no legal education, he respectfully requests
that the Honorable Court guides him in this matter, in case he erred in applying these
Regulations.
I.

Pursuant to the Regulations of Civil Procedure (1984), Regulation 413:

2. Respondent: Office of the Clerk of the Supreme Court.
3. Office of the Clerk of the Supreme Court; Refusal to accept the filing of the Request
on November 27, 2011; Case: Dr Joseph Zernik v State of Israel (6041/11).
4. Mailing address: PO Box 31440, Jerusalem 91313
5. The Request was rejected from filing in the presence of the Challenger on November
27, 2011.
6. Arguments in the Challenge see II-V, below.
7. Instant Challenge does not pertain to any District Court, or Magistrate Court.

II.

The Reasons, provided by the office of the Clerk for rejecting the filing of
the Request, did not match the facts in the matter.

In refusing to accept the filing of the Request, the office of the Clerk decided, as
inscribed on the face of the Request:
We are not able to accept the filing of this paper, since it is not permissible to
apply for additional review proceeding, following a decision by a single
justice of the Court.
The Challenger claims that this decision by the office of the Clerk of the Court does not
match the facts in this matter for the following reasons:
1. In the Request itself, it is claimed that the case was never duly registered by the
Court. To wit, the commencing paper of the case fails to be listed, either under
Requests, or under Rejected from Registration. The Challenger forwarded
written requests to the office of the Clerk, in effort to correct this situation, but the
commencing paper fails to be listed to this date.
2. Additionally, no proceeding was conducted in Zernik v State of Israel. To wit, no
proceeding is listed for the case in the Calendar of the Court, although the
Challenger forwarded written requests to the office of the Clerk, in effort to
correct this situation.
Therefore, the November 27, 2011 Request, should not have been considered a
request for an additional proceeding. The Request itself was primarily titled,
Request Addressed to the Chief Justice, for an Initial Review by an Expanded
Panel. Alternatively, the Request was titled, Request for an Additional
Proceeding by an Expanded Panel, but with the qualification Filed Prior to the
Due Entry of a Decision.
3. In the Request itself, it is claimed that no decision was entered in the case. To wit,
the Challenger holds no signed decision in this matter, regardless of his repeated
requests to be provided with a signed and certified decision.
Therefore, the Challenger claims that the decision by the office of the Clerk of the Court
was based in error, and does not match the facts in this matter.
III.

Alternatively, the decision by the office of the Clerk pertains directly to

the questions, raised in the Request itself, and therefore, should have
been reviewed and decided by justice(s) of the Court.

1. Alternatively, the Challenger claims that all components of the decision by the
office of the Clerk of the Court, are inseparable from the questions, raised in the
Request itself. Therefore, these questions should be reviewed and decided by
justice(s) of the Court, and not by the office of the Clerk.
Therefore, the Requester challenges the decision by the office of the Clerk, and asks that
the facts and the claims in the body of the Request (Exhibit A) be deemed an integral
part of this Challenge.
IV.

Request for review of this Challenge by an expanded panel, due to its

unique and nature and general significance

1. The evidence and the claims in this Challenge directly pertain to the Request
itself, (Exhibit A) and are of unique nature and general significance.
Therefore, the Challenger asks that the Challenge be reviewed by an expanded panel, in
case the Regulations permit review by an expanded panel of a Challenge on the office of
the Clerk.
V.

The inscription on the face of the Request is the basis for this Challenge

1. Relative to Regulations of Civil Procedure (1984), Regulation 419, the Challenger

has no record of the decision by the office of the Clerk, except for the inscription
on the fact of the Request (Exhibit A).
VI.

Request for honest registration and Fair Hearing.

1. The undersigned asks that the Honorable Court accord this paper and this case
due process, pursuant to the law of the State of Israel, and the fundamentals of
Fair Hearing in Human Rights under International Law.
