Case 1
Canadian Charter of Rights and Freedoms Section 2: Fundamental Freedoms Everyone has the following fundamental freedoms: a) freedom of conscience and religion; b) freedom of thought, belief, opinion, and expression, including freedom of the press and other media of communication; c) freedom of peaceful assembly; and d) freedom of association Section 7: Legal Rights Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice.

Case 2
Criminal Law Assault In the case of assault, the plaintiff must simply prove that the defendant threatened imminent harm; the plaintiff believed the threat was genuine, and the defendant could have carried out the threat. Section 265 (1)(a) of the Criminal Code states that a person commits the wrongful act (actus reus) of assault when without the consent of another person, he applies force intentionally to that person, directly or indirectly.
