NOTICE OF FILING OF EXECUTED AMENDED AND RESTATED ASBESTOS CLAIMS HANDLING AGREEMENT PLEASE TAKE NOTICE THAT on April 23, 2008, the above-captioned debtors (collectively, the Debtors) and the Collins & Aikman Post-Consummation Trust (the PCT) filed a motion [Docket No. 9285] (the Motion)2 requesting that the Court enter an order requiring the Insurers to show cause why they each had failed to enter into the Amended and Restated Asbestos Claims Handling Agreement (the Amended Agreement).

PLEASE TAKE FURTHER NOTICE THAT on June 26, 2008, the Court held a hearing on the Motion at which hearing the Debtors and the PCT informed the Court that the Amended Agreement had not yet been executed by all of the Insurers. PLEASE TAKE FURTHER NOTICE THAT on July 7, 2008, the Court entered an order requiring that a representative of each Insurer with the authority to negotiate on behalf of and bind such Insurer to the terms of the Amended Agreement and each Insurers respective counsel appear before the Court on July 31, 2008 to finalize the negotiations concerning, and language of, the Amended Agreement [Docket No. 9699] (the Appearance Order). PLEASE TAKE FURTHER NOTICE THAT since the Courts entry of the Appearance Order, the parties to the Amended Agreement have been able to finalize the terms of the Amended Agreement, and each party has executed the Amended Agreement. A copy of the fully executed Amended Agreement (without exhibits) is attached hereto as Exhibit A.
