TECHNICAL AIRWORTHINESS REGULATION


REGULATION 4 APPROVED MAINTENANCE ORGANISATIONS (AMO) 4.1. GENERAL 4.1.1. Applicability - Who May Maintain State Aircraft and Aeronautical Product a. Except as detailed under Regulation 4.1.1.e, maintenance of State aircraft and/or aeronautical product shall only be performed by an organisation that has been certified by the Technical Airworthiness Regulator (TAR) and authorised through its responsible Maintenance Authorising Office as an Approved Maintenance Organisation (AMO). b. All service organisations and commercial organisation having contract with government shall only operate as an AMO with, and in accordance with, a valid Maintenance Authority Certificate (MAC) issued by the TAR. c. The Letter of Maintenance Authority issued by the TAR with each MAC shall be considered part of the Certificate. d. The Letter of Maintenance Authority shall define the scope and level of activity for which the certificate is issued. e. Maintenance on State aircraft and aeronautical product shall only be performed by an organization without a valid MAC issued by the TAR when: (1) the organisation is part of an AMOs Maintenance Support Network and is performing maintenance on behalf of, and within the authorised scope and level of, an AMO as per Regulation 4.4.3; or (2) an AMO outsources maintenance to an organisation which is not part of its Maintenance Support Network and the AMO retains full accountability for the technical integrity of the work as per Regulation 4.4.3.b; or (3) the Senior Design Engineer of the SAO Authorised Engineering Organisation (AEO) provides specific temporary authorisation for an organisation to undertake a maintenance task, in which case the Senior Design Engineer will be accountable for the technical integrity of the work; or (4) the DGTA provides specific interim authorisation for the organisation to undertake maintenance as part of the transition to full AMO certification, in which case the DGTA will be accountable for the technical integrity of the work; or (5) when the organisation is specifically excluded from these Regulations by the TAR; or (6) the organisation is an AEO undertaking maintenance confined to the installation of modifications, which have been developed by that AEO, in accordance with Regulation 3.5.20.c.

4.2. AUTHORISATIONS 4.2.1. Application for Certification a. An organisation seeking certification as an AMO, (hereafter referred to as the applicant), shall submit an application for an MAC to the TAR, through its responsible MAO. b. Each application shall be submitted with details of: (1) the applicant, including the organisations name and address, and the reason for the application; (2) the applicants Maintenance Management System (MMS) documented in a Maintenance Management Plan (MMP), which provides a description of the scope and level of work to be undertaken and how the applicant satisfies, or intends to satisfy, these Regulations; (3) (4) (5) the applicants documented Quality Management System; any Exemptions required; and any relevant certifications held by the organisation.

c. Notwithstanding Regulations 4.2.1.a and b, the applicant shall supply additional documentation in support of its application when requested to do so by the MAO or the TAR. 4.2.2. Award and Retention of AMO Certification a. Each applicants submission shall be assessed to ensure that: (1) the MMS complies with all applicable clauses of Regulations 4 and 5; (2) maintenance carried out by the applicant on State aircraft or aeronautical product is being performed: (i) (ii) (iii) and to Single State Airworthiness (SSA) approved standards, by competent and authorised personnel, by personnel acting as members of an authorised organisation,

(iv) by personnel whose work is certified as correct and accepted by the SSA. (3) the applicant has sufficient competent personnel available to plan, supervise, perform and inspect all maintenance activities within the scope and level applied for; (4) the applicant provides appropriate and adequate facilities for the scope and level of maintenance applied for; and (5) the applicant has all necessary tools, equipment and material to carry out aircraft and/or aeronautical product maintenance within the scope and level applied for. b. Submissions failing to satisfy the requirements of Regulations 4.2.1 and 4.2.2.a will be rejected and shall have the basis for the rejection fully documented and disclosed to the applicant. c. The AMO (through the MAO) shall allow the TAR (or representative thereof) to make such investigation of its facilities, personnel and records as are needed to satisfy the TAR that the AMO complies and continues to comply with these regulations. www.dgta.gov.my 2.4 - 2 of 8 TERHAD

d. Submissions satisfying the requirements of Regulations 4.2.1 and 4.2.2.a shall, following satisfactory compliance assessment, entitle the applicant to be formally certified as an AMO by issue of an MAC and accompanying Letter of Maintenance Authority. e. A non-SAO applicant shall only be certified as an AMO, or retain AMO certification, whilst under contract to the Government of Malaysia; the AMO certification in this case relates directly to the scope and level of the contracted maintenance. f. The continued validity of an AMO certification shall be re-assessed by a process and at a frequency determined by the TAR. 4.2.3. RESERVED 4.2.4. Changes to AMO Certification a. Each AMO shall: (1) continue to comply with the requirements of Regulations 4 and 5; (2) advise any change to the basis of its certification to the TAR within two working days of the change and seek approval for that change; and (3) ensure that, where the TAR has approved changes to the basis of an AMOs certification in accordance with Regulation 4.2.4.a(2), its organisational documentation (including the MMP) is updated to reflect all changes approved by the TAR. 4.2.5. Duration of AMO Certification a. The MAC and accompanying Letter of Maintenance Authority shall remain in force valid up to three (3) years or until they (the contract to which they relate) expires or is terminated, surrendered, suspended, or superseded. 4.3. EXEMPTIONS 4.3.1. Exemption Requirements b. Each AMO shall: (1) not operate in a manner contrary to these Regulations unless permitted by an Exemption granted by the TAR; (2) maintain a system, documented, either directly or by reference, in the MMP, to formally request Exemptions; (3) submit a Request for Exemption, through the MAO, to the TAR when the AMO: (i) (ii) is not able to meet any of Regulations 4 or 5, or is unable to meet any of the terms of its MMP;

(4) action approved Requests for Exemption in accordance with terms and conditions provided by the TAR; (5) maintain a permanent record of details relating to all Exemptions that have been requested and those that have been granted; and (6) advise the TAR, through MAO, when the grounds for Exemption no longer apply. www.dgta.gov.my 2.4 - 3 of 8 TERHAD

4.4. MAINTENANCE ORGANISATIONAL STRUCTURE 4.4.1. Key Appointments and Groups within an AMO a. In its submission, an applicant for certification as an AMO shall structure key maintenance management appointments and other functional groupings as listed below. The applicant shall either use these appointments and groupings or, in the application, clearly define the correlation between them and the applicants own positions and groups. (1) (2) (3) (4) (5) (6) (7) (8) Accountable Manager (AM); Senior Maintenance Manager (SMM); Quality Manager (QM); Maintenance Manager; Maintenance Inspector/Supervisor; Authorised Tradesperson; Aircrew; and Non-Technical Personnel.

4.4.2. Documentation of Organisational Structure a. The AMO shall document its organisational structure, either directly or by reference, in the MMP. The description of the organisational structure shall contain: (1) (2) the title(s) of management positions; the titles of supervisory positions; and

(3) an organisational chart or equivalent document showing associated chains of management and maintenance responsibility of the key appointments and groups specified in Regulation 4.4.1. 4.4.3. Maintenance Support Networks a. Where the AMO does not have sufficient internal resources or capability to conduct the required maintenance, and regularly outsources maintenance functions, the AMO shall state, either directly or by reference, in the MMP: (1) the organisation(s) used to supplement the AMOs maintenance or maintenance support functions; and (2) the scope and level of maintenance conducted by the external organisation(s) on behalf of the AMO. b. The AMO shall be accountable to the TAR for ensuring technical integrity of aircraft and aeronautical product whenever maintenance is outsourced by the AMO. c. The AMO shall state, either directly or by reference, in the MMP, the management processes associated with assessing and authorising sub-contractors for inclusion in the organisations Maintenance Support Network. 4.4.4. Quality Management System a. The AMO shall establish and maintain a Quality Management System that is acceptable to the TAR. The system shall be defined, either directly or by reference, in the MMP. (1) and (2)

management reviews of processes, procedures and audit findings, a system of internal quality indicators.

b. The Quality Management System shall include an internal audit system program that, as a minimum, evaluates: (1) ongoing compliance with procedures and processes as defined in the MMP; (2) (3) corrective action follow-up, effectiveness and close-out; and the effectiveness of preventative actions.

4.5. PERSONNEL REQUIREMENTS 4.5.1. Maintenance Authority a. AMOs shall establish and maintain a system to assess and assign internal Maintenance Authority to personnel involved in planning, performing, supervising, inspecting, or certifying maintenance. b. AMOs shall maintain and utilise a system to record all assessments and approvals for the assignment of Maintenance Authority. c. The systems and processes to assess, assign and record assignment of maintenance authority shall be stated, either directly or by reference, in the MMP. 4.5.2. Accountable Manager a. Each AMO shall have an Accountable Manager who has corporate authority for ensuring that all maintenance activities undertaken are adequately resourced and conducted to approved RMAF standards, methods and practices. 4.5.3. Senior Maintenance Manager (SMM) a. Each AMO shall have an appointed SMM who is responsible for the conduct of all maintenance activities within the AMOs authorised scope and level. b. Specific selection criteria for appointment as the SMM, detailing qualifications, training and experience required, shall be defined, either directly or by reference, in the MMP. c. The AMO shall demonstrate to the satisfaction of the TAR that the SMM is competent to comply with the technical airworthiness requirements embodied in this manual to the level commensurate with their position. d. The SMM shall demonstrate a thorough understanding of the Regulations in relation to the maintenance of aircraft and/or aeronautical product carried out on behalf of the State. e. The SMMs responsibilities shall be stated, either directly or by reference, in the MMP. 4.5.4. Quality Manager a. AMOs shall have a Quality Manager who is authorised by the Accountable Manager.

b. Specific selection criteria for the Quality Manager, detailing qualifications, training and experience required, shall be stated, either directly or by reference, in the MMP. c. The person appointed as the Quality Manager shall have qualifications and experience appropriate to quality systems management. 4.5.5. Maintenance Manager a. The SMM shall authorise Maintenance Managers, as required, to meet the maintenance management responsibilities and workloads within the AMO. b. Maintenance Managers shall be authorised by the SMM after formal assessment to determine the applicants competence, and knowledge of maintenance, supervision, inspection, and technical administration requirements in their area of responsibility. c. Specific selection criteria for Maintenance Managers, detailing qualifications, training and experience required, shall be stated, either directly or by reference, in the MMP. d. The SMM shall ensure that each Maintenance Manager is competent to comply with the technical airworthiness requirements embodied in this manual to the level commensurate with their position. e. Maintenance Managers shall be formally re-assessed and re-authorised by the SMM on a periodic basis not exceeding 12 months. 4.5.6. Maintenance Inspector/Supervisor a. The SMM shall authorise Maintenance Inspector/Supervisors as required, to meet maintenance inspection and supervision responsibilities within the AMO. b. Specific selection criteria for Maintenance Inspector/Supervisors shall be stated, either directly or by reference, in the MMP. c. Specific selection criteria for Maintenance Inspector/Supervisors shall comply with a Standard acceptable to the TAR. d. The SMM shall ensure that each Maintenance Inspector/Supervisor is competent to comply with the technical airworthiness requirements embodied in this manual to the level commensurate with their position. e. Maintenance Inspector/Supervisors shall be formally re-assessed and reauthorised by the SMM on a periodic basis not exceeding 12 months. 4.5.7. Authorised Tradespersons a. The SMM, or an appropriate delegate authorised by the SMM, shall authorise Tradespersons to be Authorised Tradespersons as required, to meet the maintenance responsibilities and workloads within the AMO. b. Specific selection criteria for Authorised Tradespersons shall be stated, either directly or by reference, in the MMP. c. Specific selection criteria for Authorised Tradespersons shall comply with a Standard acceptable to the TAR. d. The SMM shall ensure that each Authorised Tradesperson is competent to comply with the technical airworthiness requirements embodied in this manual to the level commensurate with their position. e. Authorised Tradespersons shall be formally re-assessed and re-authorised by the SMM or appropriate delegate on a periodic basis not exceeding 12 months. www.dgta.gov.my 2.4 - 6 of 8 TERHAD

4.5.8. Aircrew a. The SMM shall authorise Aircrew, as required, to perform maintenance, supervision and/or inspection tasks. b. The scope of tasks determined by the SMM which Aircrew may be authorised to perform shall be stated, either directly or by reference, in the MMP. c. The SMM shall ensure that each Aircrew member authorised to perform maintenance, supervision and inspection tasks is competent to comply with the technical airworthiness requirements embodied in this manual to the level commensurate with their authorisation. d. Authorised Aircrew shall be formally re-assessed and re-authorised by the SMM, on a periodic basis not exceeding 12 months. 4.5.9. Non-Technical Personnel a. The SMM shall authorise Non-Technical Personnel, as required, to meet the maintenance responsibilities and workloads within the AMO. b. The scope of maintenance tasks determined by the SMM which NonTechnical Personnel may be authorised to perform shall be defined, either directly or by reference, in the MMP. c. The SMM shall ensure that each Non-Technical Person is competent to comply with the technical airworthiness requirements embodied in this manual to the level commensurate with their position. d. Non-Technical Personnel shall be re-assessed and re-authorised by the SMM on a periodic basis not exceeding 12 months. 4.5.10. Human Factors in Maintenance a. The AMO shall establish and maintain a system for the appropriate notification and management of human factors affecting maintenance in order to minimise effects on airworthiness. b. The system and procedures for the management of human factors shall be documented, either directly or by reference, in the MMP. c. The Accountable Manager shall ensure that personnel do not perform maintenance on State aircraft or aeronautical product when their performance would be impaired. d. AMO personnel shall be responsible for informing the Accountable Manager or their delegate, when they are subject to psychological or physiological factors that would impair, or might impair, their ability to perform maintenance. 4.6. FACILITIES 4.6.1. AMO Facilities a. The AMO shall have, or have access to, the necessary maintenance facilities for all management, planning, certification and maintenance activities conducted under the scope and level of its certification as an AMO. b. The AMO shall maintain a general description of its facilities, including their location, used to conduct maintenance on State aircraft and/or aeronautical product, either directly or by reference, in its MMP.

4.6.2. Storage Facilities a. Facilities shall be provided and utilised for the storage of State aircraft and/or aeronautical product and maintenance documentation for which the AMO is responsible. The facilities shall: (1) (2) (3) provide security; where appropriate, provide adequate segregation; and minimise deterioration, contamination, corrosion and damage.

4.6.3. Alternative Facilities a. AMOs shall establish and document, either directly or by reference, in the MMP, procedures to assess facilities required to conduct maintenance on State aircraft and/or aeronautical product away from the main maintenance facility.
