Sub:- Regulations APSEBoard Service Regulations Part I Exercising of revised option under Regulation 30 (A) whenever retrospective Pay fixation is made Clarification Issued. ***** Sub-Regulation (2) of Regulation 30(A) of the Andhra Pradesh State electricity Board Service Regulations part-I lays down that Option shall be given by the Board employee within one month from the date of promotion:Provided that the Board employee shall be entitled to revise his option only one within a period of one year from the date of promotion, and it shall be final. 2) It has been brought to the notice of the Board that wherever retrospective fixation of pay of an employee is made by an order of the Board or other competent authority, there may be a change in the date of increment which will have bearing on the option earlier exercised under Regulation 30(A) of the Andhra Pradesh State Electricity Board Service Regulations Part-I. A doubt has therefore arisen whether an employee whose pay was refixed retrospectively based on the orders of the Board is entitled to exercise revised option under Regulation 30(A) of the Andhra Pradesh State Electricity Board Service Regulations Part-I. 3) After careful examination, it is hereby clarified that- As and when retrospective fixation of pay is made to the individual by an order of the Board either due to a change in date of increment or due to a material change in pay, such individual or his legal heirs, as the case may be, may be permitted to revise or exercise the option now under Regulation 30(A) of the Andhra Pradesh State Electricity Board Service Regulations Part-I within a period of six months from the date of issue of retrospective orders by the Board. 4) The employees in whose cases the six months period referred to in para 3 above, has already lapsed they shall exercise option within 3 months form the date of this memorandum. As per the pay fixation principles ordered in the said B.P. in some cases where seniors in a promotion category as on the date of revised scales come into force fixation of pay resulted in Junior continuing in the lower category drawing pay higher than the senior. 2. In the Memo. 2nd cited, as subsequently modified and clarification issued in Memos.3rd to 9th cited orders were issued for stepping up the pay of the seniors on par with the pay of their junior in the same feeder category. 3. It has been brought to the Notice of the Board that certain employees are still representing, seeking parity in pay on par with the pay of their juniors in terms of the orders issued in the Memos.2nd to 8th cited even after a lapse of a decade. This is causing much inconvenience to the administration to consider the claims at this distant time. 4. After careful consideration of the matter, the APSEB directs that the employees shall be allowed time upto a maximum period of 4 (Four) months from the date of these orders to made claims, if any, for refixation of their pay on par with the pay of their junior s in terms of the orders under reference. Any claims made thereafter and any representations for extension of the said time limit will not be entertained under any circumstances. Contd on P/2.

As per the Revised Pay Scales Regulations appended to the said orders the employees are entitled to fixation of pay in the post held on 01.07.1994. 2. As per Regulation 30-A of APSEBoard Service Regulations Part-I and employee on promotion can opt for fixation of pay on the date of promotion under Regulation 30(a) (i) and again for refixation of pay on the date of earning increment in the lower post with the benefit of notional increment provided in Regulation 30(A) of APSEB Service Regulations part-I. 3. Some of the employees who were promoted to higher post after 01.071993, opted for fixation of pay under 30-A Regulation of APSEB Service Regulations Part-I on the date of accrual of increment in the lower post on or after 01.07.1994. 4. After careful consideration, it is hereby ordered that an employee whether drawn 3 stagnation increments or not by 01.07.1993 if promoted to the higher category after 01.07.1993 and opts for fixation of pay under Regulation 30-A of APSEB Service Regulations Part-I on the date of accrual of increment in the lower post on or after 01.07.1994, his pay shall be fixed notionally in the lower post and refixed in the scale of pay of the promotion post under Regulation 30(A) of APSEB Service Regulations Part-I (Model Illustration enclosed). SRs. Part-I Issued. B.P.(PandG.Per)Ms.No.164, PRCEEDINGS Instructions (iii) under Reg.30-A of APSEBoard Service Regulations Part-I, lays down that in the case of promotion option may be given to Board Servant for fixation of Pay on Promotion as under: a) Either his initial pay may be fixed in the higher post on the basis of Regulation 30-A of APSEB Service Regulations Part-I, straight-away without any further review on accrual or increment in the pay scale of the lower post; or (b) His pay on promotion may be fixed initially in the manner as provided under regulation 30(a) (i) of APSEB Service Regulations Part-I, which may be re-fixed on the basis of the provision of Regulation 30-A of APSEB Service Regulations Part-I on the date of accrual of the next increment, in the scale of pay of the lower post. Sub-Reg. (2) of Regulation 30-A of the said Regulation provides that Option may be given within one month from the date of promotion. Option once exercised shall be final. 2) In B.P.(P & G. Per) Ms.No.135, dated 27.06.1991 orders were issued that a Board employee may be given only one opportunity to revise his option provided such revised option shall be within a period of one year from the date of promotion. 3) After careful consideration and in exercise of the powers conferred by Clause (C) of Section 79 of the Elecy.(Supply) Act, 1948 (Central Act LIV of 1948), the Andhra Pradesh State Electricity Board issues the following amendment to Andhra Pradesh State Electricity Board service Regulations Part-I issued in B.P.Ms.No.548, dated 21.08.1967 and published at pages 63-134 of Supplement to part-II of A.P.Gazette dated 28.031968 as subsequently amended from time to time. B.P.(PandG-Per) Ms.No.197, dated 09.07.1992. ***** PRCEEDINGS:Regulation 30 A of Andhra Pradesh State Electricity Board Service Regulations Part-I provides that where a Board servant holding a post in a substantive, officiating or temporary capacity to another post carrying duties and responsibilities of greater importance than those attaching to the post held by him, his initial pay in the time scale of the higher post shall be fixed at the stage next above the pay notionally arrived at by increasing his pay in respect of the lower post by one increment at the stage at which such pay has accrued. This regulation came into force with effect from 19.11.1984 vide B.P. first cited. 2. Instruction (i) under the said Regulation provides for protection of pay of the Senior employees, who are promoted to higher post on or after 19.11.1984 and drawing a lower rate of pay in that post than another Board Servant Junior to him in the lower grade, on par with the pay of such Junior. Instruction (ii) provides for protection of pay of the senior employee, who got promotion to higher category of post prior to 19.11.1984 and draws less pay than the junior in the lower category who got promotion after 19.11.1984, on par with the pay of such junior. 3. Sub-clause (f) of instruction (ii) referred to above provides that the next increment of the senior will be drawn from the date on which it would have fallen due but for the stepping up of his pay under this order. In cases coming under instruction (i) the next increment of the Senior Officer shall be draw on completion of the requisite qualifying service with effect from the date of re-fixation of pay. In G.O.Ms.No.31 F & P (FW.FR.II) Department dated 25.01.1993 the Government issued orders that the next increment of the senior person will accrue only after completion of one year from the date of stepping up of his pay in respect of the cases of the above referred to under instruction (ii) under Reg.30 A of APSEBoard Service Regulations Part-I referred to in para-2 above. These orders of Govt., were given effect from 11.02.1990. 5. After careful consideration the Andhra Pradesh State Electricity Board issues the following notification. NOTIFICATION In exercise of the powers conferred by Clause (C) of section 79 of the Electricity (Supply) Act, 1948 (Central Act IV of 1948) and all other powers here unto enabling, the APSEBoard Services Regulations Part-I issued at pages 63-134 of supplement to Part II of A.P.Gazette date the 28th March, 1968 and as subsequently amended. AMENDMENT In the said Regulation, for clause (f) under Instruction (ii) of Sub-Regulation (i) of Regulation 30 A, the following shall be substituted, namely:f) The next increment of the senior shall accrue only, after completion of one year qualifying service with effect from the date of re-fixation of pay. In the Memo second cited it was clarified that the orders in the memo first cited apply to cases of O & M or construction. Staff also when they were appointed to posts governed by Service Regulations made by Board provided that such appointment involves higher duties and responsibilities than those attached to the posts held by them before such appointment. 2. With reference to the memos first and second cited the Superintending Engineer (SSLM) has sought for clarification on fixation of pay of an employee who has been appointed to a post carrying the same scale of pay (A tool keeper carrying scale of pay for Rs.1330-45-1825-50-2375 is appointed as LDC carrying same scale). 3. It is hereby ordered that in such cases fixation of pay has to be done under Regulation 30 (a) (ii) of Service Regulations Part-I. When an employee is appointed to a post which carries higher scale with a higher minimum, higher maximum and higher rate of increment his pay has to be fixed under Reg.30-A of Andhra Pradesh State Electricity Board Service Regulations Part-I. B.P.(PandG-Per) Ms.No.135, dated 27.06.1991. ***** PRCEEDINGS:Regulation 30 A of the APSEB Service Regulations Part-I provides for option to be exercised by the promotes within a period of one month for fixation of pay either from the date of promotion or from the date of accrual of next increment in the lower category and the option once exercised shall be final. 2. Considering the representation received from certain employees of the Board stating that they have either exercised incorrect options or not exercised the options within one month as provided in the Regulations, orders were issued in B.P. cited as follows: i) to extend the time limit up to 30.09.1994 for exercising revised options to those employees who consider that they have exercised incorrect options and to those employees who have not exercised the option at all within the stipulated time but who intend exercising options and ii) that in respect of the Board employees to be promoted in future they may be given only one opportunity to revise their option provided such revised option shall be within a period of one year from the date of promotion. 3. Again some individual employees have represented that they may be permitted to revise the options exercised earlier stating they have been put to financial loss due to the incorrect options exercised earlier and for exercising option in case they have not exercised the option. 4. After careful consideration of the matter and in continuation of the orders issued in para 3(i) of B.P. cited, the APSEB directs that as a last opportunity such of those employees who intend to exercise option or who intend to revise the option exercised earlier under Regulations 30 A of the APSEB Service Regulations Part-I shall do so within one month from the date of this order. Cited it was ordered that as per the amendment issued in B.P.Ms.No.415, dated 11.05.1988, any Board employee (including O & M) when promoted/appointed to a post governed by the APSEB service regulations is entitled for fixation of pay with effect from 01.07.1986 as per Regulation 30 A of Andhra Pradesh State Electricity Board Service Regulations Part-I provided such promotion/appointment involves higher duties and responsibilities than those that are attached to the existing post. It has been brought to the notice that in spite of the instructions issued in the Memo. Cited, the provisions of Reg.30-A of Andhra Pradesh State Electricity Board Service Regulations Part-I are not being applied in cases where the O & M and construction., staff are appointed by transfer to the categories in Andhra Pradesh State Electricity Board Engineering service etc. The instructions in the Memo.cited are very clear and benefits under Regulation 30 A of Andhra Pradesh State Electricity Board Service Regulations Part-I are to be extended in cases of O & M and construction. Staff also when they are appointed to posts governed by the Andhra Pradesh State Electricity Board Service Regulations, provided such appointment involves assumption of higher duties and responsibilities than those attached in respect of the posts held by them before such appointment. Memo.NoDS(PS)/DM.VI/S1-140/92, dated 22.05.1992. ***** In Board Memo 2nd cited orders were issued extending the benefit of regulation 30 A issued in a B.P.Ms.No.1032, dated 19.11.1984, as amended in B.P.Ms.No.415, dated 11.05.1988 to the O & M / Construction staff duly allowing notional fixation of pay only from 19.11.1984 with monetary benefit from 07.09.1989 i.e., the date of issue of orders of B.P.ms.No.965, dated 07.09.1989. 2. Again it has been represented that the benefit of lower pay fixation may be extended to O & M / Construction staff on par with office staff with effect from 01.04.1981. 3. After careful consideration of the above request, the APSEB directs that the benefit of release of increment in the lower post and consequential fixation in the promotional post earlier ordered to the office staff in memo first cited, shall be extended to O & M / Construction staff also with effect from 01.04.1981 in modification of orders in para (2) of Memo.(i) cited. How ever increments in lower post beyond the maximum of the time scale of the said post are not admissible. 4. The beneficiaries with reference to the orders in paragraph (3) above are entitled only for the notional fixation of pay with effect from 01.04.1981 to 18.11.1984 with monetary benefit from 07.09.1989 ie., the date of issue of orders vide B.P.Ms.No.965, dated 07.09.1989. 5. Ref:-1) Circular Memo.No.Adm/ROC/332/G2/71-32A, dated 07.04.1971 of the CEE/O and CE/Projects. 2) B.P.Ms.No.219, dated 14.031977. 3) Boards Memo.No.DM(IR)/PO.2.3/140/83-4, dated 27.031984. 4) B.P.Ms.No.1032, dated 19.11.1984. 5) B.O.Ms.No.415, dated 11.05.1988. 6) B.P.Ms.No.965, dated 07.09.1989. ***** As per the orders issued in the circular Memo. First cited and the pay scale Regulations issued in the B.O.s.No.219, dated 14.03.1977 the O & M/Constructions staff were entitled to protection of the pay in the lower post upto 31.03.1981. The subsequent pay scale regulations effective from 01.04.1981 do not provide for fixation for pay in the lower post. In the memo third cited, it has been clarified that the O & M and Construction staff are not entitled for increments in the lower post for promotion after 01.04.1981. 2. Board, in B.O.Ms.No.965, dated 07.09.1989 has extended the benefits of Regulation 30 A ordered in B.P.Ms.No.1032, dated 19.11.1984 as amended in B.P.Ms.No.415, dated 11.05.1988 to O & M Construction staff, with effect from issue of the order ie., 07.09.1989 only. 3. The Unions have been requesting time and again for allowing the O & M and Construction staff for fixation of pay in the higher promotion post on par with office staff retrospectively form 01.04.1981 and the orders issued in B.P.m.s.No.965, dated 07.091989 may be adopted retrospectively from 19.11.1984 on par with office staff. 4. After careful consideration of the request of the Unions, the regulation 30 A issued with B.P.Ms.No.1032, dated 19.11.1984, as amended in B.P.Ms.No.415, dated 11.05.1988, the APSEB directs that the benefits of pay fixation earlier ordered to office staff shall be extended to O & M and construction staff also subject to the conditions mentioned in para (5) below.

The beneficiaries of the orders in paragraph (4) are entitled only for notional fixation of pay with effect from 19.11.1984 with monitory benefit from 07.09.1989 i.e., the date of issue of orders vide B.O.Ms.No.965, dated 07.09.1989. To make matters amply clear, there will be no arrears to be drawn for the period 19.11.1984 to 07.09.1989. 6. Ref:- Your Letter NoDEE/O/SDPT/Camp.1, dated 07.04.1988. ***** I am to state that the O & M and Construction Staff are entitled for release of increments in the lower post and consequential refixation in the promoted post till 31.03.1981 as per Memo.No.Adm/ROC/332/G2/71-32A, dated 07.12.1971 and Regulation 5(iv) (a) of pay scales Regulations appended to B.P.Ms.No.219, dated 14.03.1977. They are not entitled for the said benefit in the revised pay scales from 01.04.1981 as the said scales do not provide for such fixation of pay based on the pay in the lower post. ANDHRA PRADESH STATE ELECTRICITY BOARD ABSTRACT Regulations APSE Board Service Regulations Part-I Fixation or pay on promotion to higher post amendment to Regulation 30-A of APSE Board service Regulations Part-I Orders Issued. B.P.(PandG.Per)Ms.No.197, 1.B.P.Ms.No.548, dated 21.08.1967. 2.B.P.Ms.No.1032, dated 19.11.1984. 3.B.P.(PandG Per) Ms.No.415, dated 11.05.1988. PROCEEDINGS:In B.P.Ms.No.1032, dated 19.11.1984 Service Regulations were amended based on certain orders of Government laying down guidelines as to the fixation of pay of an employee on promotion to a higher post. The amendment was made effective from the date of issue of the said order, namely 19.11.1984. In the said amendment, the interests of a senior promoted before the introduction of the new regulations, in relation to a junior promoted after the new regulations came into existence, were protected. The said orders do not provide for pay protection of these employees who were promoted on or after the introduction of the new regulation as in the case of Govt., Orders. In order to rectify this anomaly the Board has decided to amend the regulations suitably. NOTIFICATION In exercise of the powers conferred by clause (C) of Section 79 of the Electricity (Supply) Act, 1948 (Central Act LTV of 1948) and all other powers here unto enabling the APSEBoard hereby issues the following amendment to the APSEBoard Service Regulations Part-I issued in B.P.Ms.No.548, dated the 21st August, 1967 and published as pages 63-134 of supplement to Part-II of AP Gazette dated the 28 th March, 1968 and as subsequently amended. AMENDMENT In Regulation 30 A of the said Regulations. dated 09.07.1992. Read the following:-

-::2::1) The existing instruction (i) and (ii) shall be renumbered as instruction (ii) and (iii) and after they are so renumbered the following shall be inserted as instruction (i) namely:- (i) In order to remove the pay anomaly of a Board servant promoted or appointed to a higher post on or after the date of introduction of new regulations namely 19th Nov.,1984 and drawing a lower rate of pay in that post, than another Board servant junior to him the lower grade and promoted or appointed subsequently to another identical post, the APSEBoard has decided that in such cases, the pay of the senior Board servant should be stepped up in the higher post to a figure equal to the pay fixed for the junior Board servant in that higher post. The stepping up should be done with effect from the date of promotion or appointment of the junior and shall be subject to the continuous mentioned in instruction (ii) below . 2) In condition (f) of the renumbered instruction (ii) the following sentence shall be added at the end:In cases coming under instruction (i) the next increment of the senior officer shall be drawn on completion of the requisite qualifying service with effect from the date of refixation of pay. 3) These orders shall be deemed to have com into effect from the 19 th November, 1984, the date on which new regulation 30-A was issued.
