Please find below and attached an email and media release which should be self-
explanatory.

Clearly, this news brings to a head all of the issues we have been dealing with as the
OPCC over the last three weeks. However, it also means that there is a busy period
ahead to ensure there is a smooth transition to new leadership. I ask that you
continue to support me through this unprecedented time, and that you remain
professional and committed to serving the public of South Yorkshire, as you have
done unquestionably so far.

I shall provide you with regular communication, and will hold a staff meeting at the
earliest opportunity but, in the meantime, please do not hesitate to raise any
questions, issues or concerns with the Senior Management Team in the first
instance, and with me ultimately.

Diana further to my email below, the Commissioner has now indicated his
intention to resign which will be communicated through a media release which
is embargoed until 10 am today (draft attached). Shaun intends that that release
will constitute notice to you as Appropriate Officer of his resignation under Section
61 of the Police Reform and Social Responsibility Act 2011, which will trigger a bi-
election under Section 51 of the Act and the requirement for the Panels approval of
an Acting Commissioner under Section 62(1)(a) of the Act.

We clearly now need to work together with the Police and Crime Panel and the
Home Office to ensure adequate arrangements are in place.

My recommendation is that Steve Pick, Treasurer, be immediately approved as
Acting Commissioner by the Police and Crime Panel, given the options I set out in
my original email below. Steve has now indicated his willingness to be so considered
by the Panel. I have prepared my report to the Panel to this effect ready.

We have now agreed by telephone that we shall meet here at 9.15am (the Chief
Constable will be here then too) and then I suggest we meet urgently (by telephone
conference if necessary) with the Panels Chair (Cllr Harpham) and monitoring officer
(Jacquie Collins), the Chief Constable, and probably a Home Office representative - I
can of course arrange this.

Dear

The Commissioner has publicly stated his intention not to resign, but I , the Police
and Crime Panel and the Appropriate Officer / Returning Officer Diana Terris, all
have a professional duty to consider everything that would need to be put in place
should that decision change, and I need to stress the imperative of urgent action in
that event not least because the public and the media would immediately ask, upon
any resignation decision being notified, "Who is the Commissioner now?". The post
would become immediately vacant upon receipt by the Appropriate Officer of notice
of the resignation (s61 of the 2011 Act); and the Panel immediately comes under a
duty to appoint an Acting Commissioner (s62(1)(a) of the 2011 Act).

I have been discussing options for that eventuality with the Home Office, on the
absolutely clear understanding that I wasnt seeking to pre-empt a decision that was
properly for the Commissioner to make, and it would be a decision for the Panel who
should be appointed as the Acting Commissioner (but the 2011 Act makes clear that
that person should be a person who is already a member of the Commissioners staff
at that point in time: s62(2) of the 2011 Act).

In my professional opinion, the four options for Acting Commissioner at this point
are:-

1. Tracey Cheetham (if she either withdraws her resignation or, in the event that
it is considered she should serve her notice period under her current contract
despite the PCCs resignation, that notice period is extended, given the time
required to hold a bi-election). However, the way her resignation has been
reported in the media makes this option difficult in the eyes of the public;
2. Me but I have seriously considered this option and am not putting myself
forward;
3. Steve Pick (Temporary Treasurer) has not indicated whether he would be
prepared to put himself forward; and
4. A person yet to be appointed by the PCC on a temporary contract, but who
could be so appointed in that event, I would recommend that such a person
is independent (in the apolitical sense, and in terms of the issues facing South
Yorkshire currently), to hold office in an administration/caretaker sense until
the bi-election.

Please let me know whether you wish to discuss this matter further. The Panel may
have had their own thoughts on this issue and I repeat that this email is sent so that
we may all consider these unprecedented issues as early as possible, cognisant that
the approval of an Acting Commissioner would be a matter for the Panel.
