These license terms are an agreement between you and Rimage Corporation. Please read them. They apply
to the software included on this device. The software also includes any separate media on which you
received the software.
The software on this device includes software licensed from Microsoft Corporation or its affiliate.
The terms also apply to any Microsoft
updates,
supplements,
Internet-based services, and
support services
for this software, unless other terms accompany those items. If so, those terms apply. If you obtain
updates or supplements directly from Microsoft, then Microsoft, and not Rimage Corporation, licenses those
to you.
As described below, using some features also operates as your consent to the transmission of certain
standard computer information for Internet-based services.
By using the software, you accept these terms. If you do not accept them, do not use the software.
Instead, contact Rimage Corporation to determine its return policy for a refund or credit.
If you comply with these license terms, you have the rights below.
1. USE RIGHTS.
You may use the software on the device with which you acquired the software.
Processor Limit. You may use the software with no more than two (2) processors at any one time.
2. ADDITIONAL LICENSING REQUIREMENTS AND/OR USE RIGHTS.
a. Specific Use. Rimage Corporation designed this device for a specific use. You may only use the
software for that use.
b. Other Software. You may use other programs with the software as long as the other programs
directly support the manufacturers specific use for the device, or
provide system utilities, resource management, or anti-virus or similar protection.
Software that provides consumer or business tasks or processes may not run on the device. This
includes email, word processing, spreadsheet, database, scheduling and personal finance software.
The device may use terminal services protocols to access such software running on a server.
c. Device Connections. You may not use the software as server software. In other words, more than
one device may not access, display, run, share or use the software at the same time. You may allow
up to ten other devices to access the software to use
File Services,
Print Services,
Internet Information Services, and
Internet Connection Sharing and Telephony Services.
The ten connection limit applies to devices that access the software indirectly through
multiplexing or other software or hardware that pools connections. You may use unlimited
inbound connections at any time via TCP/IP.
3. SCOPE OF LICENSE. The software is licensed, not sold. This agreement only gives you some rights to
use the software. Rimage Corporation and Microsoft reserve all other rights. Unless applicable law
gives you more rights despite this limitation, you may use the software only as expressly permitted in
this agreement. In doing so, you must comply with any technical limitations in the software that allow
you to use it only in certain ways. For more information, see the software documentation or contact
Rimage Corporation. Except and only to the extent permitted by applicable law despite these
limitations, you may not:
work around any technical limitations in the software;
reverse engineer, decompile or disassemble the software;
make more copies of the software than specified in this agreement;
publish the software for others to copy;
rent, lease or lend the software; or
use the software for commercial software hosting services.
Except as expressly provided in this agreement, rights to access the software on this device do not give
you any right to implement Microsoft patents or other Microsoft intellectual property in software or
devices that access this device.
INTERNET-BASED SERVICES. Microsoft provides Internet-based services with the software.
Microsoft may change or cancel them at any time.
a. Consent for Internet-Based Services. The software features described below connect to
Microsoft or service provider computer systems over the Internet. In some cases, you will not
receive a separate notice when they connect. You may switch off these features or not use
them. For more information about these features, visit
http://www.microsoft.com/windowsxp/downloads/updates/sp2/docs/privacy.mspx. By
using these features, you consent to the transmission of this information. Microsoft does not
use the information to identify or contact you.
b. Computer Information. The following feature uses Internet protocols, which send to the
appropriate systems computer information, such as your Internet protocol address, the type of
operating system, browser and name and version of the software you are using, and the
language code of the device where you installed the software. Microsoft uses this information
to make the Internet-based services available to you.
Web Content Features. Features in the software can retrieve related content from
Microsoft and provide it to you. To provide the content, these features send to Microsoft
the type of operating system, name and version of the software you are using, type of
browser and language code of the device where the software was installed. Examples of
these features are clip art, templates, online training, online assistance and Appshelp. You
may choose not to use these web content features.
Windows Media Digital Rights Management. Content owners use Windows Media digital
rights management technology (WMDRM) to protect their intellectual property, including
copyrights. This software and third party software use WMDRM to play and copy WMDRM-
protected content. If the software fails to protect the content, content owners may ask
Microsoft to revoke the softwares ability to use WMDRM to play or copy protected content.
Revocation does not affect other content. When you download licenses for protected
content, you agree that Microsoft may include a revocation list with the licenses. Content
owners may require you to upgrade WMDRM to access their content. Microsoft software
that includes WMDRM will ask for your consent prior to the upgrade. If you decline an
upgrade, you will not be able to access content that requires the upgrade. You may switch
off WMDRM features that access the Internet. When these features are off, you can still
play content for which you have a valid license.
c. Misuse of Internet-based Services. You may not use these services in any way that could harm
them or impair anyone elses use of them. You may not use the services to try to gain
unauthorized access to any service, data, account or network by any means.
NOTICES ABOUT THE MPEG-4 VISUAL STANDARD. The software may include MPEG-4 visual decoding
technology. This technology is a format for data compression of video information. MPEG LA, L.L.C.
requires this notice:
USE OF THIS PRODUCT IN ANY MANNER THAT COMPLIES WITH THE MPEG-4 VISUAL STANDARD IS
PROHIBITED, EXCEPT FOR USE DIRECTLY RELATED TO (A) DATA OR INFORMATION (i) GENERATED
BY AND OBTAINED WITHOUT CHARGE FROM A CONSUMER NOT THEREBY ENGAGED IN A BUSINESS
ENTERPRISE, AND (ii) FOR PERSONAL USE ONLY; AND (B) OTHER USES SPECIFICALLY AND

4. PRODUCT SUPPORT. Contact Rimage Corporation for support options. Refer to the support number
provided with the device.
5. BACKUP COPY. You may make one backup copy of the software. You may use it only to reinstall the
software on the device.
6. PROOF OF LICENSE. If you acquired the software on the device, or on a disc or other media, a genuine
Certificate of Authenticity label with a genuine copy of the software identifies licensed software. To be
valid, this label must be affixed to the device, or included on or in Rimage Corporations software
packaging. If you receive the label separately, it is not valid. You should keep the label on the device
or packaging to prove that you are licensed to use the software. To identify genuine Microsoft software,
see http://www.howtotell.com.
7. TRANSFER TO A THIRD PARTY. You may transfer the software only with the device, the Certificate of
Authenticity label, and these license terms directly to a third party. Before the transfer, that party
must agree that these license terms apply to the transfer and use of the software. You may not retain
any copies of the software including the backup copy.
8. NOT FAULT TOLERANT. The software is not fault tolerant. Rimage Corporation installed the
software on the device and is responsible for how it operates on the device.
9. RESTRICTED USE. The Microsoft software was designed for systems that do not require fail-safe
performance. You may not use the Microsoft software in any device or system in which a malfunction of
the software would result in foreseeable risk of injury or death to any person. This includes operation of
nuclear facilities, aircraft navigation or communication systems and air traffic control.
10. NO WARRANTIES FOR THE SOFTWARE. The software is provided as is. You bear all risks of using
it. Microsoft gives no express warranties, guarantees or conditions. Any warranties you receive
regarding the device or the software do not originate from, and are not binding on, Microsoft or its
affiliates. When allowed by your local laws, Rimage Corporation and Microsoft exclude implied
warranties of merchantability, fitness for a particular purpose and non-infringement.
11. LIABILITY LIMITATIONS. You can recover from Microsoft and its affiliates only direct damages up to two
hundred fifty U.S. Dollars (U.S. $250.00), or equivalent in local currency. You cannot recover any other
damages, including consequential, lost profits, special, indirect or incidental damages.
This limitation applies to:
anything related to the software, services, content (including code) on third party internet sites, or
third party programs, and
claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence,
or other tort to the extent permitted by applicable law.
It also applies even if Microsoft should have been aware of the possibility of the damages. The above
limitation may not apply to you because your country may not allow the exclusion or limitation of
incidental, consequential or other damages.
12. EXPORT RESTRICTIONS. The software is subject to United States export laws and regulations. You must
comply with all domestic and international export laws and regulations that apply to the software.

Die Software auf diesem Gert enthlt Software, die von Microsoft Corporation oder ihrem verbundenen
Unternehmen lizenziert wurde.
Die Bestimmungen gelten auch fr alle von Microsoft diesbezglich angebotenen
Updates
Ergnzungen
Internetbasierten Dienste
Supportleistungen.
Liegen letztgenannten Elementen eigene Bestimmungen bei, gelten diese eigenen Bestimmungen. Wenn Sie
Updates oder Ergnzungen direkt von Microsoft erhalten, werden diese von Microsoft und nicht von Rimage
Corporation an Sie lizenziert.
Wie weiter unten beschrieben, gilt die Verwendung einiger Features auch als Ihre Zustimmung zur
bertragung bestimmter Standardcomputerinformationen fr internetbasierte Dienste.
Durch die Verwendung der Software erkennen Sie diese Bestimmungen an. Falls Sie die Bestimmungen
nicht akzeptieren, sind Sie nicht berechtigt, die Software zu verwenden. Wenden Sie sich stattdessen
an Rimage Corporation, um von diesem seine Richtlinien fr eine Rckgabe gegen Erstattung oder
Gutschrift des Kaufpreises in Erfahrung zu bringen.
Wenn Sie diese Lizenzbestimmungen einhalten, verfgen Sie ber die nachfolgend aufgefhrten Rechte.
1. NUTZUNGSRECHTE.
Sie sind berechtigt, die Software auf dem Gert zu verwenden, mit dem Sie die Software erworben haben.
Prozessorbeschrnkung. Sie drfen die Software mit nicht mehr als zwei (2) Prozessoren gleichzeitig
verwenden.
2. ZUSTZLICHE LIZENZANFORDERUNGEN UND/ODER NUTZUNGSRECHTE.
a. Bestimmte Verwendung. Rimage Corporation hat dieses Gert fr eine bestimmte Verwendung
entworfen. Sie drfen die Software nur zu dieser Verwendung nutzen.
b. Andere Software. Sie sind berechtigt, andere Programme mit der Software zu verwenden, solange
die anderen Programme
die bestimmte Verwendung des Herstellers fr das Gert direkt untersttzen oder
Systemdienstprogramme, Ressourcenverwaltung oder einen Antivirus- oder hnlichen
Schutz bereitstellen.
Software, die Verbraucher- oder Geschftstasks oder -prozesse bereitstellt, darf auf dem Gert
nicht genutzt werden. Hierzu gehrt E-Mail-, Textverarbeitungs-, Tabellenkalkulations-, Datenbank-,
Terminplanungs- und persnliche Finanzplanungssoftware. Auf dem Gert drfen
Terminaldiensteprotokolle verwendet werden, um auf solche Software zuzugreifen, die auf einem
Server ausgefhrt wird.
c. Gerteverbindungen. Sie sind nicht berechtigt, die Software als Serversoftware zu verwenden. Mit
anderen Worten, es darf nicht mehr als ein Gert gleichzeitig auf die Software zugreifen, sie
anzeigen, ausfhren, freigeben oder verwenden. Sie sind berechtigt, bis zu zehn anderen Gerten
den Zugriff auf die Software zu erlauben, um Folgendes zu verwenden:
Dateidienste
Druckdienste
Internetinformationsdienste und
Internetverbindungsfreigabe- und Telefoniedienste.
Die Grenze von zehn Verbindungen gilt fr Gerte, die ber Multiplexing- oder andere Software
oder Hardware, die Verbindungen in einem Pool zusammenfasst, indirekt auf die Software zugreifen.
Sie sind berechtigt, jederzeit eine unbegrenzte Anzahl eingehender Verbindungen ber TCP/IP zu
verwenden.
3. GLTIGKEITSBEREICH DER LIZENZ. Die Software wird lizenziert, nicht verkauft. Dieser Vertrag gibt
Ihnen nur einige Rechte zur Verwendung der Software. Rimage Corporation und Microsoft behalten sich
alle anderen Rechte vor. Sie drfen die Software nur wie in diesem Vertrag ausdrcklich gestattet
verwenden, es sei denn, das anwendbare Recht gibt Ihnen ungeachtet dieser Einschrnkung
umfassendere Rechte. Dabei sind Sie verpflichtet, alle technischen Beschrnkungen der Software
einzuhalten, die Ihnen nur spezielle Verwendungen gestatten. Weitere Informationen finden Sie in der
Dokumentation der Software, oder wenden Sie sich an Rimage Corporation. Auer wenn und nur insoweit
dies durch das anwendbare Recht ungeachtet dieser Einschrnkungen erlaubt wird, sind Sie nicht
berechtigt:
technische Beschrnkungen der Software zu umgehen
die Software zurckzuentwickeln (Reverse Engineering), zu dekompilieren oder zu disassemblieren
mehr Kopien der Software als in diesem Vertrag angegeben anzufertigen
die Software zu verffentlichen, damit andere sie kopieren knnen
die Software zu vermieten, zu verleasen oder zu verleihen
die Software fr kommerzielle Software-Hostingdienste zu verwenden.
Sofern dies nicht in diesem Vertrag ausdrcklich bestimmt wird, geben Rechte zum Zugriff auf die
Software auf diesem Gert Ihnen kein Recht, Patente von Microsoft oder anderes geistiges Eigentum von
Microsoft in Software oder Gerten zu implementieren, die auf dieses Gert zugreifen.
INTERNETBASIERTE DIENSTE. Microsoft stellt mit der Software internetbasierte Dienste bereit.
Microsoft ist berechtigt, diese jederzeit zu ndern oder zu kndigen.
a. Zustimmung fr internetbasierte Dienste. Die nachfolgend beschriebenen Features der
Software stellen ber das Internet eine Verbindung mit Computersystemen von Microsoft oder
von Serviceprovidern her. In einigen Fllen erhalten Sie keinen gesonderten Hinweis, wenn die
Verbindung hergestellt wird. Sie knnen diese Features abschalten oder nicht verwenden.

Ihnen verwendeten Software, Typ des Browsers sowie Sprachcode des Gerts, auf dem die
Software installiert wurde. Beispiele fr diese Features sind ClipArt, Vorlagen,
Onlineschulungen, Online Assistance und Appshelp. Sie knnen sich entscheiden, ob Sie
diese Webinhaltsfeatures verwenden mchten oder nicht.
Verwaltung digitaler Rechte von Windows Media. Rechteinhaber verwenden die
Technologie zur Verwaltung digitaler Rechte von Windows Media (WMDRM), um ihr geistiges
Eigentum, einschlielich Urheberrechte, zu schtzen. Diese Software und
Drittanbietersoftware verwenden WMDRM, um durch WMDRM geschtzten Inhalt abzuspielen
und zu kopieren. Wenn die Software den Inhalt nicht schtzt, verlangen Rechteinhaber
mglicherweise von Microsoft, die Fhigkeit der Software zur Verwendung von WMDRM zum
Abspielen oder Kopieren von geschtztem Inhalt zu widerrufen. Der Widerruf hat keinen

beeintrchtigen knnte. Sie sind nicht berechtigt, die Dienste zu verwenden, um zu versuchen,
auf irgendeine Weise nicht autorisierten Zugriff auf Dienste, Daten, Accounts oder Netzwerke zu
erlangen.
HINWEISE ZUM MPEG-4 VISUAL-STANDARD. Die Software enthlt mglicherweise die visuelle
Decodierungstechnologie MPEG-4. Bei dieser Technologie handelt es sich um ein Format fr die
Datenkomprimierung von Videoinformationen. MPEG LA, L.L.C. verlangt den folgenden Hinweis:

4. PRODUKTSUPPORT. Wenden Sie sich an Rimage Corporation, um von diesem Supportoptionen zu
erhalten. Die Telefonnummer fr den Support ist im Lieferumfang des Gerts enthalten.
5. SICHERUNGSKOPIE. Sie sind berechtigt, eine Sicherungskopie der Software anzufertigen. Sie drfen
diese nur zur erneuten Installation der Software auf dem Gert verwenden.
6. LIZENZNACHWEIS (Proof of License oder POL). Wenn Sie die Software auf dem Gert oder auf
einer CD oder anderen Medien erworben haben, ist die Originalkopie der Software durch ein originales
COA (Certificate of Authenticity) Label als lizenzierte Software gekennzeichnet. Dies gilt nur, wenn
dieses COA Label auf dem Gert angebracht oder auf bzw. in der Softwareverpackung von Rimage
Corporation enthalten ist. Wenn Sie das Etikett gesondert erhalten, ist es nicht gltig. Sie sollten das
Etikett auf dem Gert oder der Verpackung als Nachweis dafr aufbewahren, dass Sie ber eine Lizenz
zur Verwendung der Software verfgen. Informationen zum Identifizieren originaler Microsoft-Software

7. BERTRAGUNG AN DRITTE. Sie sind berechtigt, die Software lediglich mit dem Gert, dem COA Label
und diesen Lizenzbestimmungen direkt an Dritte zu bertragen. Vor der bertragung muss sich die
andere Partei damit einverstanden erklren, dass diese Lizenzbestimmungen fr die bertragung und
Verwendung der Software gelten. Sie sind nicht berechtigt, Kopien der Software zurckzubehalten,
einschlielich der Sicherungskopie.
8. KEINE FEHLERTOLERANZ. Die Software ist nicht fehlertolerant. Rimage Corporation hat die Software
auf dem Gert installiert und ist dafr verantwortlich, wie sie auf dem Gert arbeitet.
9. EINGESCHRNKTE VERWENDUNG. Die Microsoft-Software wurde fr Systeme entworfen, fr die keine
strungsfreie Leistung erforderlich ist. Sie sind nicht berechtigt, die Microsoft-Software auf einem Gert
oder in einem System zu verwenden, in dem eine Fehlfunktion der Software ein vorhersehbares Risiko
von Verletzung oder Tod einer Person zur Folge htte. Hierzu gehren nukleartechnische Einrichtungen,
Flugzeugnavigations- oder -kommunikationssysteme und die Flugsicherung.
10. KEINE GEWHRLEISTUNGEN FR DIE SOFTWARE. Die Software wird wie besehen bereitgestellt. Sie
tragen alle mit der Verwendung verbundenen Risiken. Microsoft gewhrt keine ausdrcklichen
Gewhrleistungen oder Garantien. Jegliche Gewhrleistungen, die Sie bezglich des Gerts oder der
Software erhalten, stammen nicht von Microsoft oder ihren verbundenen Unternehmen und sind fr
Microsoft oder ihre verbundenen Unternehmen nicht bindend. Im durch das rtlich anwendbare
Recht gestatteten Umfang schlieen Rimage Corporation und Microsoft konkludente
Gewhrleistungen der Handelsblichkeit, Eignung fr einen bestimmten Zweck und Nichtverletzung
von Rechten Dritter aus.
11. HAFTUNGSBESCHRNKUNGEN. Sie knnen von Microsoft und ihren verbundenen Unternehmen nur einen
Ersatz fr direkte Schden bis zu zweihundertfnfzig US-Dollar (250,00 USD) oder einen gleichwertigen
Betrag in der lokalen Whrung erhalten. Sie knnen keinen Ersatz fr andere Schden erhalten,
einschlielich Folgeschden, Schden aus entgangenem Gewinn, spezielle, indirekte oder zufllige
Schden.

anwendbare Recht gestatteten Umfang.
Sie hat auch dann Gltigkeit, wenn Microsoft von der Mglichkeit der Schden htte wissen mssen. Obige

Stattdessen gelten fr Schadenersatz oder Ersatz vergeblicher Aufwendungen, gleich aus welchem

12. AUSFUHRBESCHRNKUNGEN. Die Software unterliegt den Exportgesetzen und -regelungen der USA
sowie des Landes, aus dem sie ausgefhrt wird. Sie sind verpflichtet, alle nationalen und internationalen
Exportgesetze und -regelungen einzuhalten, die fr die Software gelten. Zu diesen Gesetzen gehren

Les prsents termes du contrat de licence constituent un contrat entre vous et Rimage Corporation. Lisez-
les attentivement. Ils portent sur le logiciel dapplication inclus sur ce dispositif. Ce logiciel inclut
galement le support sur lequel vous lavez reu le cas chant.
Le logiciel inclus sur ce dispositif contient un logiciel concd sous licence par Microsoft Corporation ou son
affili.
Ce contrat porte galement sur les produits Microsoft suivants :
les mises jour,
les supplments,
les services Internet et
les services dassistance
de ce logiciel moins que dautres termes naccompagnent ces produits, auquel cas ces derniers prvalent.
Si vous obtenez des mises jour ou des supplments directement auprs de Microsoft, Microsoft, et non
[OEM], vous en octroie les licences.
Comme dcrit ci-dessous, en utilisant certaines fonctions, vous consentez ce que Microsoft recueille
certaines informations standard pour des services Internet.
En utilisant le logiciel, vous acceptez ces termes. Si vous ne les acceptez pas, nutilisez pas le logiciel
et contactez Rimage Corporation pour connatre sa politique de restitution afin d'obtenir un
remboursement ou un avoir.
Si vous vous conformez aux prsents termes du contrat de licence, vous disposez des droits stipuls ci-
dessous.
1. DROITS DUTILISATION.
Vous tes autoris utiliser le logiciel sur le dispositif avec lequel vous avez acquis le logiciel.
Nombre maximal de processeurs. Vous tes autoris utiliser le logiciel, au maximum, sur deux (2)
processeurs en mme temps de ce dispositif.
2. CONDITIONS DE LICENCE ET/OU DROITS DUTILISATION SUPPLMENTAIRES.
a. Utilisation spcifique. Rimage Corporation a conu ce dispositif pour une utilisation spcifique.
Vous ne pouvez utiliser le logiciel que pour cette utilisation.
b. Autre Logiciel. Vous tes autoris utiliser d'autres programmes avec le logiciel condition que ces
autres programmes
prennent directement en charge l'utilisation spcifique du dispositif sous licence du
fabricant ou
fournissent des utilitaires, des logiciels de gestion des ressources, des antivirus ou une
protection similaire.
Le logiciel qui fournit les tches ou processus clients ou mtiers ne peut pas tre excut sur le
dispositif. Citons par exemple, les logiciels de courrier lectronique, traitement de texte, tableur,
base de donnes, planification et gestion des finances personnelles. Le dispositif peut utiliser des
protocoles de services terminaux pour accder ce type de logiciel excut sur un serveur.
c. Connexion des dispositifs. Vous ntes pas autoris utiliser le logiciel en tant que logiciel
serveur. En d'autres termes, plusieurs dispositifs ne peuvent pas accder au logiciel, l'afficher,
l'excuter ou l'utiliser en mme temps. Vous pouvez autoriser jusqu' dix dispositifs accder au
logiciel pour utiliser
les services de fichiers
les services d'impression
les services d'information sur Internet et
le partage de connexion Internet et les services de tlphonie.
Le nombre maximal de dix (10) connexions sapplique aux dispositifs qui se connectent au logiciel
indirectement par le biais de logiciels ou de matriels de multiplexage ou dautres logiciels et
matriels qui concentrent les connexions. Vous pouvez utiliser un nombre illimit de connexions
entrantes via TCP/IP.
3. CHAMP DAPPLICATION DE LA LICENCE. Le logiciel nest pas vendu mais concd sous licence. Le
prsent contrat vous confre certains droits dutilisation du logiciel. Rimage Corporation et Microsoft se
rservent tous les autres droits. Sauf si la loi en vigueur vous confre dautres droits, nonobstant la
prsente limitation, vous ntes autoris utiliser le logiciel quen conformit avec les termes du
prsent contrat. cette fin, vous devez vous conformer aux restrictions techniques contenues dans le
logiciel qui vous permettent de lutiliser dune certaine faon. Pour plus dinformations, consultez la
documentation relative au logiciel ou contactez [OEM]. Sauf disposition contraire de la loi ou dordre
public nonobstant les limitations suivantes, vous n'tes pas autoris :
contourner les restrictions techniques contenues dans le logiciel ;
reconstituer la logique du logiciel, le dcompiler ou le dsassembler ;
effectuer un nombre de copies du logiciel suprieur ce qui a t spcifi en vertu du prsent
contrat ;
publier le logiciel en vue dune reproduction par autrui ;
louer ou prter le logiciel ou
utiliser le logiciel en association avec des services dhbergement commercial.
Sauf disposition contraire expresse stipule dans le prsent contrat, les droits daccs au logiciel sur ce
dispositif ne vous autorisent pas exploiter des brevets appartenant Microsoft ou tous autres droits de
proprit intellectuelle de Microsoft sur le logiciel ou tous dispositifs qui accdent au serveur ou ce
dispositif.
SERVICES INTERNET. Microsoft fournit des services Internet avec le logiciel. Microsoft peut les
modifier ou les interrompre tout moment.
a. Consentement pour les services Internet. Les fonctionnalits du logiciel dcrites ci-aprs se
connectent aux systmes informatiques de Microsoft ou de fournisseurs de services via Internet.
Dans certains cas, vous ne recevrez pas davis de connexion. Vous pouvez dsactiver ces
fonctionnalits ou ne pas les utiliser. Pour plus dinformations sur ces fonctionnalits, visitez le
site
http://www.microsoft.com/windowsxp/downloads/updates/sp2/docs/privacy.mspx. En
utilisant ces fonctionnalits, vous consentez la transmission de ces informations. Microsoft
nutilise pas ces informations afin de vous identifier ou de vous contacter.
b. Informations relatives l'ordinateur. La fonctionnalit suivante utilise des protocoles
Internet, qui transmettent aux systmes appropris des informations, telles que ladresse IP, le
type de systme dexploitation, le navigateur, le nom et la version du logiciel que vous utilisez,
ainsi que le code de langue du priphrique sur lequel vous avez install le logiciel. Microsoft
utilise ces informations pour mettre votre disposition les services Internet.
Fonctionnalits de contenu Web. Les fonctionnalits du logiciel peuvent extraire du
contenu associ de Microsoft et vous le transmettre. Pour fournir ce contenu, ces
fonctionnalits communiquent Microsoft le type de systme dexploitation, le nom et la
version du logiciel que vous utilisez, le type de navigateur et le code de langue du dispositif
sur lequel vous avez install le logiciel. Parmi ces fonctionnalits, citons le clip art, les
modles, la formation en ligne, lassistance en ligne et Appshelp. Vous pouvez dcider de
ne pas faire appel ces fonctions de contenu Web.
Gestion des droits numriques de Windows Media. Les propritaires de contenu utilisent
la technologie de gestion des droits numriques de Windows Media (WMDRM) pour protger
leurs droits de proprit intellectuelle, y compris leurs droits dauteur. Ce logiciel et des
logiciels appartenant des tiers utilisent la technologie WMDRM pour lire et copier du
contenu protg. Si le logiciel ne protge pas le contenu, les propritaires de contenu
peuvent demander Microsoft la rvocation du droit du logiciel utiliser ladite technologie
WMDRM pour lire ou copier le contenu protg. La rvocation naffecte pas dautres
contenus. Lorsque vous tlchargez des licences de contenu protg, vous reconnaissez
que Microsoft peut inclure une liste de rvocation avec lesdites licences. Les propritaires
de contenu peuvent exiger de vous que vous mettiez jour la technologie WMDRM afin
daccder leur contenu. Le logiciel Microsoft qui inclut la technologie WMDRM vous
demandera votre autorisation avant de procder la mise jour. Si vous refusez la mise
jour, vous ne pourrez plus accder au contenu qui ncessite la mise jour. Vous pouvez
dsactiver les fonctionnalits WMDRM qui accdent Internet. Une fois ces fonctionnalits
dsactives, vous pouvez lire le contenu pour lequel vous disposez dune licence valide.
c. Utilisation inapproprie des services Internet. Vous ntes pas autoris utiliser ces services
de quelque manire que ce soit qui pourrait leur porter atteinte ou perturber leur utilisation par
un autre utilisateur. Vous ntes pas autoris tenter daccder de faon non autorise aux
services, donnes, comptes ou rseaux de toute autre manire.
MENTIONS RELATIVES LA NORME VISUELLE MPEG-4. Le logiciel comprend la technologie de
dcodage visuelle MPEG-4. Cette technologie constitue un format de compression de donnes vido.
MPEG LA, L.L.C. exige la diffusion de lavis suivant :

4. SUPPORT TECHNIQUE. Contactez Rimage Corporation pour connatre les options de support technique.
Rfrez-vous au numro fourni avec le dispositif.
5. COPIE DE SAUVEGARDE. Vous tes autoris effectuer une copie de sauvegarde du logiciel. Vous ne
pouvez lutiliser que dans le but de rinstaller le logiciel sur le dispositif.
6. PREUVE DE LICENCE ( Proof of Licence ou POL ). Si vous avez acquis le logiciel sur le dispositif,
sur un disque ou sur tout autre support, une tiquette authentique de Certificat dAuthenticit
( Certificate of Authenticity ou COA ) accompagnant une copie authentique du logiciel permet
didentifier quil sagit dun logiciel sous licence. Pour tre valide, cette tiquette doit tre appose
sur le dispositif ou figurer sur lemballage du logiciel du Rimage Corporation. Si vous recevez ltiquette
sparment, elle nest pas valable. Vous devez conserver ltiquette sur le dispositif ou lemballage
pour prouver que vous tes autoris utiliser le logiciel. Pour identifier un logiciel Microsoft authentique,
visitez le site (en anglais) http://www.howtotell.com.
7. TRANSFERT UN TIERS. Vous tes autoris transfrer le logiciel directement un tiers uniquement
avec le dispositif, ltiquette de Certificat dauthenticit ( Certificate of Authenticity ou COA ) et
les termes du prsent contrat. Avant le transfert, le tiers doit reconnatre que les termes du prsent
contrat de licence sappliquent au transfert et lutilisation du logiciel. Vous n'tes autoris conserver
aucune copie du logiciel, y compris la copie de sauvegarde.
8. AUCUNE TOLRANCE DE PANNE. Le logiciel na aucune tolrance de panne. Rimage Corporation a
install le logiciel sur le dispositif et est responsable de la faon dont il fonctionne sur le dispositif.
9. UTILISATION LIMITE. Le logiciel est conu pour des systmes dont les performances ne doivent subir
aucune dfaillance. Vous n'tes pas autoris utiliser le logiciel Microsoft dans un dispositif ou systme
dans lequel un fonctionnement dfectueux du logiciel entrainerait un risque prvisible de prjudice
corporel ou de dcs. Cela inclut les installations nuclaires, la navigation arienne ou les systmes de
communication embarqus et le contrle arien.
10. AUCUNE GARANTIE POUR LE LOGICIEL. Le logiciel est fourni en ltat . Vous assumez tous les
risques lis son utilisation. Microsoft naccorde aucune garantie ou condition expresse. Les
garanties que vous avez reues en ce qui concerne soit le dispositif, soit le logiciel, ne proviennent
pas de et ne sont pas excutoires pour Microsoft ou ses affilis. Lorsque cela est autoris par le droit
local, les garanties implicites de qualit marchande, dadquation un usage particulier et
dabsence de contrefaon sont exclues par Rimage Corporation et Microsoft.
11. LIMITATION DE RESPONSABILIT. Vous pouvez obtenir de Microsoft et de ses affilis une indemnisation en
cas de dommages directs uniquement dans la limite du montant que vous avez pay pour le logiciel ou
250.00 DOLLARS U.S., la somme la plus importante tant verse. Vous ne pouvez prtendre aucune
indemnisation pour les autres dommages, y compris les dommages spciaux, indirects ou accessoires et
pertes de bnfices.
Cette limitation concerne :
toute affaire lie au logiciel, aux services ou au contenu (y compris le code) figurant sur des sites
Internet tiers ou dans des programmes tiers ; et
les rclamations pour rupture de contrat ou violation de garantie, les rclamations en cas de
responsabilit sans faute, de ngligence ou autre dlit dans la limite autorise par la loi en vigueur.
Elle sapplique galement mme si Microsoft connaissait l'ventualit d'un tel dommage. La limitation ci-
dessus peut galement ne pas vous tre applicable, car votre pays nautorise pas lexclusion ou la
limitation de responsabilit pour les dommages indirects, accessoires ou de quelque nature que ce soit.
12. RESTRICTIONS LEXPORTATION. Le logiciel est soumis la rglementation amricaine en matire
dexportation. Vous devez vous conformer toutes les rglementations nationales et internationales en
matire dexportation concernant le logiciel. Ces rglementations comprennent des restrictions sur les
pays destinataires, les utilisateurs finaux et les utilisations finales. Des informations supplmentaires

Estos trminos de licencia constituyen un contrato entre usted y Rimage Corporation. Proceda a leerlos. Se
aplican al software que se incluye en este dispositivo. El software tambin incluye cualquier otro medio en
el que recibi el software.
El software de este dispositivo incluye el software licenciado de Microsoft Corporation o sus afiliadas.
Los trminos tambin se aplican a los siguientes elementos de Microsoft:
actualizaciones,
anexos,
servicios basados en Internet,
servicios de soporte tcnico,
correspondientes a este software, a menos que haya otros trminos que acompaen a dichos elementos. Si
es as, se aplicarn dichos trminos. Si obtiene actualizaciones o anexos directamente desde Microsoft,
entonces Microsoft, y no el Rimage Corporation, le otorgar las licencias.

1. DERECHOS DE USO.

2. REQUISITOS DE LICENCIAS Y/O DERECHOS DE USO ADICIONALES.
a. Uso especfico. Rimage Corporation dise este dispositivo para un uso especfico. Slo puede usar
el software para dicho uso.
b. Otro software. Puede usar otros programas con el software siempre y cuando stos:
admitan directamente el uso especfico del fabricante para el dispositivo;
proporcionen utilidades de sistema, administracin de recursos, antivirus o proteccin
similar.
Es posible que el software que proporciona tareas o procesos de consumo o de negocios no se
ejecute en el dispositivo. Esto incluye el software de correo electrnico, procesamiento de textos,
hojas de clculo, bases de datos, programacin y software de finanzas. El dispositivo puede usar los
protocolos de Servicios de Terminal Server para obtener acceso a dicho software que se ejecuta en
un servidor.
c. Conexiones de dispositivos. No puede usar el software como software de servidor. En otras
palabras, ms de un dispositivo no puede obtener acceso, mostrar, ejecutar, compartir ni usar el
software a la vez. Puede permitir que hasta diez dispositivos distintos obtengan acceso al software
para usar:
servicios de archivo;
servicios de impresin;
servicios de Internet Information Server;
servicios de conexin compartida a Internet y de telefona.
El lmite de diez conexiones se aplica a los dispositivos que obtienen acceso al software de forma
indirecta mediante multiplexado u otro software o hardware que agrupe conexiones. Puede usar
conexiones de entrada ilimitadas en cualquier momento mediante TCP/IP.
3. ALCANCE DE LA LICENCIA. El software se otorga bajo licencia y no es objeto de venta. Este contrato
slo le proporciona algunos derechos de uso del software. Rimage Corporation y Microsoft se reservan
todos los otros derechos. A menos que la ley pertinente le otorgue ms derechos a pesar de esta
limitacin, slo puede usar el software tal como se permite expresamente en este contrato. Al hacerlo,

publicar el software para que otros lo copien;
alquilarlo, arrendarlo o cederlo;
usarlo para prestar servicios de hospedaje de software comercial.
Excepto por lo que se dispone expresamente en este contrato, los derechos de acceso al software en
este dispositivo no le otorgan ningn derecho para implementar las patentes de Microsoft u otra
propiedad intelectual de Microsoft en el software o los dispositivos que obtienen acceso a este
dispositivo.
SERVICIOS BASADOS EN INTERNET. Microsoft proporciona servicios basados en Internet con el
software. Microsoft puede cambiarlos o cancelarlos en cualquier momento.
a. Consentimiento para los servicios basados en Internet. Las caractersticas del software que
se describen a continuacin se conectan a sistemas informticos de Microsoft o de un proveedor
de servicios a travs de Internet. En algunos casos, no recibir ningn aviso cuando se
conecten. Puede desactivar estas caractersticas o no usarlas. Para obtener ms informacin
sobre estas caractersticas, visite

estas caractersticas, usted consiente que se transmita esta informacin. Microsoft no usa la
informacin para identificarlo o ponerse en contacto con usted.

Caractersticas de contenido web. Las caractersticas del software permiten recuperar de
Microsoft contenido relacionado y proporcionrselo a usted. Para proporcionar el
contenido, estas caractersticas envan a Microsoft el tipo de sistema operativo, el nombre y
la versin del software que usa, el tipo de explorador y el cdigo de idioma del dispositivo
en que se instal el software. Algunos ejemplos de estas caractersticas son las imgenes
prediseadas, las plantillas, los cursos en lnea, la asistencia en lnea y Appshelp. Puede
optar por no usar estas caractersticas de contenido web.
Administracin de derechos digitales de Windows Media. Los propietarios de contenido
usan la tecnologa de administracin de derechos digitales de Windows Media (WMDRM) para
proteger su propiedad intelectual, incluidos los derechos de autor. Este software y
cualquier software de terceros usan WMDRM para reproducir y copiar el contenido protegido
por WMDRM. Si el software no protege el contenido, los propietarios de contenido pueden
solicitar a Microsoft que revoque la capacidad del software de usar WMDRM para reproducir
o copiar el contenido protegido. La revocacin no afecta a otros contenidos. Cuando
descarga licencias para contenido protegido, acepta que Microsoft incluya una lista de

7. TRANSFERENCIA A TERCEROS. Puede transferir el software nicamente con el dispositivo, la etiqueta
de Certificado de autenticidad y estos trminos de licencia de forma directa a un tercero. Antes de la
transferencia, el otro usuario debe aceptar que estos trminos de licencia se aplican a la transferencia y
uso del software. No puede retener ninguna copia del software, incluida la copia de seguridad.
8. AUSENCIA DE TOLERANCIA A ERRORES. El software no es tolerante a errores. Rimage Corporation
instal el software en el dispositivo y es responsable de la forma en que funciona en el mismo.

garanta que reciba con respecto al dispositivo o el software no se origina en Microsoft ni sus

11. LIMITACIONES DE RESPONSABILIDAD. Puede recuperar de Microsoft y sus afiliadas slo daos directos por
un monto de hasta doscientos cincuenta dlares estadounidenses (US$250,00) o su equivalente en
moneda local. No puede recuperar ningn otro dao, incluidos los derivados, por prdida de beneficios,
especiales, indirectos o incidentales.

Le presenti condizioni costituiscono il contratto tra il licenziatario e Rimage Corporation. Il licenziatario
deve leggerle con attenzione. Si applicano al software incluso nel presente dispositivo. Il software include
anche gli eventuali supporti di memorizzazione separati, sui quali stato ricevuto.
Il software del presente dispositivo include software concesso in licenza da Microsoft Corporation o dalla sua
consociata.
Le presenti condizioni si applicano inoltre a:
aggiornamenti
supplementi
servizi basati su Internet e
servizi di supporto tecnico
forniti da Microsoft relativi ai predetti prodotti, a meno che questi siano accompagnati da specifiche
condizioni. In tal caso queste ultime condizioni prevalgono su quelle del presente contratto. Qualora il
licenziatario riceva gli aggiornamenti o i supplementi direttamente da Microsoft, sar Microsoft, e non
Rimage Corporation, a concederli in licenza al licenziatario.
Come descritto di seguito, l'utilizzo di alcune funzionalit del software funge anche da consenso alla
raccolta di determinate informazioni standard relative al computer per i servizi basati su Internet.
Utilizzando il software, il licenziatario accetta le presenti condizioni. Qualora il licenziatario non le
accetti, non dovr utilizzare il software e dovr contattare Rimage Corporation per conoscere le
modalit di rimborso del prezzo.
Qualora il licenziatario si attenga alle presenti condizioni di licenza, disporr dei diritti di seguito indicati.
1. DIRITTI SULL'UTILIZZO.
Il licenziatario potr utilizzare il software sul dispositivo con il quale lo ha acquistato.
Limitazione del Numero dei Processori. Il licenziatario potr utilizzare il software con non pi di due (2)
processori contemporaneamente.
2. REQUISITI AGGIUNTIVI PER LE LICENZE E/O DIRITTI DI UTILIZZO.
a. Utilizzo Specifico. Rimage Corporation ha designato il presente dispositivo per un utilizzo specifico.
Il licenziatario potr utilizzare il software solo in tale ambito.
b. Altro Software. Il licenziatario potr utilizzare altri programmi con il software purch gli altri
programmi
supportino direttamente l'utilizzo specifico previsto dal produttore per il dispositivo
oppure
forniscano utilit di sistema, gestione di risorse oppure protezione antivirus o simile.
Il software che consente attivit o processi aziendali o per il consumatore non potr essere eseguito
sul dispositivo. Sono inclusi posta elettronica, elaborazione di testi, fogli di calcolo, database,
pianificazione e software per la finanza personale. Il dispositivo potr utilizzare i protocolli dei
Servizi Terminal per accedere al software in esecuzione su un server.
c. Connessioni dei Dispositivi. Il licenziatario non potr utilizzare il software come software server. In
altre parole, solo un dispositivo alla volta potr accedere, visualizzare, eseguire, condividere o
utilizzare il software. Il licenziatario potr consentire l'accesso del software fino a dieci altri
dispositivi per utilizzare:
Servizi file,
Servizi Stampa,
Internet Information Services e
Condivisione connessione Internet e Servizi di Telefonia.
Il limite di dieci connessioni si applica a dispositivi che accedono al software indirettamente
mediante "multiplexing" o qualsivoglia altro software o hardware di raggruppamento delle
connessioni. Il licenziatario potr utilizzare connessioni in entrata illimitate in qualsiasi momento
tramite il protocollo TCP/IP.
3. AMBITO DI VALIDIT DELLA LICENZA. Il software non viene venduto, ma concesso in licenza. Il
presente contratto concede al licenziatario solo alcuni diritti di utilizzo del software. Rimage
Corporation e Microsoft si riservano tutti gli altri diritti. Nel limite massimo consentito dalla legge
applicabile il licenziatario potr utilizzare il software esclusivamente nei modi espressamente concessi
nel presente contratto. Nel far ci, il licenziatario dovr attenersi a qualsiasi limitazione tecnica
presente nel software che gli consenta di utilizzarlo solo in determinati modi. Per ulteriori informazioni,
il licenziatario potr fare riferimento alla documentazione del software o contattare Rimage
Corporation. Fatta eccezione per i casi consentiti dalla legge applicabile nonostante queste limitazioni,
il licenziatario non potr:
aggirare le limitazioni tecniche presenti nel software
decodificare, decompilare o disassemblare il software
effettuare pi copie del software di quelle specificate nel presente contratto
pubblicare il software per consentire ad altri di duplicarlo
concedere il software in locazione, leasing o prestito oppure
utilizzare il software per fornire hosting di servizi commerciali.
Salvo quanto espressamente previsto nel presente contratto, i diritti per accedere al software sul
dispositivo in uso non autorizzano il licenziatario a implementare alcun brevetto Microsoft o altra
propriet intellettuale di Microsoft nel software o nei dispositivi che accedono a tale dispositivo.
SERVIZI BASATI SU INTERNET. Microsoft fornisce servizi basati su Internet insieme al software.
Microsoft potr modificare o annullare tali servizi in qualsiasi momento.
a. Consenso all'Utilizzo dei Servizi basati su Internet. Le funzionalit software descritte di
seguito si connettono ai sistemi informatici di Microsoft o del provider di servizi tramite
Internet. In alcuni casi, il licenziatario, connettendosi, potrebbe non ricevere alcuna
comunicazione. Il licenziatario potr disattivare queste funzionalit oppure non utilizzarle. Per
ulteriori informazioni su queste funzionalit, il licenziatario pu visitare la pagina
http://www.microsoft.com/windowsxp/downloads/updates/sp2/docs/privacy.mspx.
Utilizzando tali funzionalit il licenziatario acconsente alla trasmissione di queste
informazioni. Microsoft non utilizza tali informazioni per individuare o contattare il
licenziatario.
b. Informazioni relative al Computer. La seguente funzionalit utilizza protocolli Internet che
comunicano ai sistemi appropriati informazioni relative al computer, quali l'indirizzo IP, il tipo
di sistema operativo, il browser, il nome e la versione del software in uso, nonch il codice di
linguaggio del dispositivo su cui il licenziatario ha installato il software. Microsoft utilizza queste
informazioni per rendere disponibili al licenziatario i servizi basati su Internet.
Funzionalit relative al Contenuto Web. Funzionalit del software possono recuperare da
Microsoft contenuto correlato e fornirlo al licenziatario. Per fornire il contenuto, queste
funzionalit comunicano a Microsoft il tipo di sistema operativo, il nome e la versione del
software utilizzato dal licenziatario, il tipo di browser e il codice di linguaggio del
dispositivo su cui installato il software. Esempi di queste funzionalit sono le immagini
ClipArt, i modelli, l'attivit di formazione in linea, l'assistenza in linea e Appshelp. Il
licenziatario potr scegliere di non utilizzare queste funzionalit relative al contenuto Web.
Gestione Digitale dei Diritti di Windows Media. I titolari del contenuto utilizzano la
tecnologia di gestione dei diritti di Windows Media (WMDRM) per proteggere i loro diritti di
propriet intellettuale, inclusi i copyright. Questo software e il software di terzi utilizzano
la tecnologia WMDRM per riprodurre e duplicare il contenuto protetto WMDRM. Qualora il
software non riesca a proteggere il contenuto, i titolari del contenuto potranno richiedere a
Microsoft di revocare i diritti del software di utilizzare la tecnologia WMDRM per riprodurre
o duplicare il contenuto protetto. La revoca non influisce su altro contenuto. Scaricando le
licenze per il contenuto protetto, il licenziatario accetta che Microsoft possa includere un
elenco di revoca unitamente a tali licenze. I titolari del contenuto potranno richiedere al
licenziatario di aggiornare la tecnologia WMDRM per accedere al contenuto fornito. Il
software Microsoft che include la tecnologia WMDRM chieder il consenso del licenziatario
prima di procedere con l'aggiornamento. Qualora il licenziatario rifiuti un aggiornamento,
non potr accedere al contenuto che richiede l'aggiornamento stesso. Il licenziatario potr
disattivare le funzionalit WMDRM che accedono a Internet. Quando tali funzionalit sono
disattivate, il licenziatario potr ancora riprodurre il contenuto per il quale dispone di una
licenza valida.
c. Utilizzo non Consentito dei Servizi basati su Internet. Il licenziatario non potr utilizzare tali
servizi in alcun modo che possa danneggiarli o pregiudicarne l'utilizzo da parte di altri utenti. Il
licenziatario non potr utilizzare i servizi per tentare di accedere in modo non autorizzato a
servizi, dati, account o reti con qualsiasi mezzo.
COMUNICAZIONI RELATIVE ALLO STANDARD VIDEO MPEG-4. Il software potrebbe includere la
tecnologia di decodifica video MPEG-4. Tale tecnologia un formato per la compressione dei dati
delle informazioni video. MPEG LA, L.L.C. richiede la seguente comunicazione:

DI ALCUNA IMPRESA O AZIENDA ED (ii) ESCLUSIVAMENTE PER UTILIZZO PERSONALE E (B) ALTRO
UTILIZZO CONSENTITO ESPRESSAMENTE IN UNA LICENZA CONCESSA SEPARATAMENTE DA MPEG
LA, L.L.C.

4. SUPPORTO TECNICO. Per le opzioni di supporto il licenziatario potr contattare Rimage Corporation,
facendo riferimento al numero di telefono fornito insieme al dispositivo.
5. COPIA DI BACKUP. Il licenziatario potr effettuare una copia di backup del software. Il licenziatario
potr utilizzare tale copia esclusivamente per reinstallare il software sul dispositivo.
6. PROVA DELLA LICENZA ("Proof of License" o "POL"). Qualora il licenziatario abbia acquistato il
software sul dispositivo o su un CD o altro supporto, un'etichetta Microsoft originale con la scritta
"Certificato di Autenticit" ("Certificate of Authenticity" o "COA") insieme a una copia originale del
software identifica una copia con licenza del software. Per essere valida, l'etichetta dovr trovarsi
acclusa al dispositivo o sulla confezione del software di Rimage Corporation. Qualora il licenziatario
riceva l'etichetta separatamente, la copia non sar valida. Il licenziatario dovr conservare l'etichetta
sul dispositivo o la confezione per dimostrare di avere la licenza per utilizzare il software. Per

7. TRASFERIMENTO A TERZI. Il licenziatario potr trasferire il software solo con il dispositivo, l'etichetta
con la scritta "Certificato di Autenticit" e le presenti condizioni di licenza direttamente a un terzo.
Prima del trasferimento il terzo dovr accettare che le presenti condizioni di licenza si applichino al
trasferimento e all'utilizzo del software. Il licenziatario non potr pi trattenere alcuna copia del
software, inclusa la copia di backup.
8. NON A TOLLERANZA D'ERRORE. Il software non a tolleranza d'errore. Rimage Corporation ha
installato il software sul dispositivo ed responsabile del suo funzionamento.
9. UTILIZZO LIMITATO. Il software Microsoft stato progettato per sistemi che non richiedono prestazioni
di fail-safe. Il licenziatario non potr utilizzare il software Microsoft su dispositivi o sistemi, nei quali un
malfunzionamento del software comporterebbe un rischio prevedibile di danni alla persona o morte.
incluso l'utilizzo in zone operative di centrali nucleari, su sistemi di comunicazione o di navigazione di
aeromobili e di controllo del traffico aereo.
10. ESCLUSIONE DI GARANZIE PER IL SOFTWARE. Il software viene fornito "cos com'". Il licenziatario si
assume ogni rischio derivante dall'utilizzo del software. Non vengono fornite garanzie o condizioni
esplicite. Le eventuali garanzie che il licenziatario ricever relativamente al dispositivo o al
software non provengono da, e non sono vincolate a, Microsoft o alle sue consociate. Quando
consentito dalla legge locale del licenziatario, Rimage Corporation e Microsoft escludono qualsiasi
garanzia implicita di commerciabilit, idoneit per uno scopo specifico e non violazione dei diritti di
terzi.
11. LIMITAZIONI DI RESPONSABILIT. Il licenziatario avr diritto a ottenere da Microsoft e dalle sue consociate
solo il risarcimento per i danni diretti nel limite di duecentocinquanta dollari (USD 250) o di un importo
equivalente in valuta locale. Il licenziatario non potr richiedere il risarcimento per eventuali altri danni,
inclusi i danni consequenziali, speciali, indiretti o incidentali o relativi alla perdita di profitti.
Questa limitazione si applica a:
qualsiasi questione relativa al software, ai servizi, al contenuto (incluso il codice) sui siti Internet o i
programmi di terzi e
controversie relative a inadempimento contrattuale, a violazioni di garanzia, a responsabilit
oggettiva, negligenza o altra responsabilit nella misura massima consentita dalla legge applicabile.
Tale limitazione si applica anche nel caso in cui Microsoft avrebbe dovuto essere informata della
possibilit del verificarsi di tali danni. La limitazione indicata sopra potrebbe non essere applicabile nei
confronti del licenziatario nel caso in cui le leggi dello Stato di residenza del licenziatario non consentano
le esclusioni o limitazioni di responsabilit per danni incidentali, consequenziali o altri danni.
12. RESTRIZIONI ALL'ESPORTAZIONE. Il software soggetto alle leggi e alle disposizioni vigenti negli Stati
Uniti in materia di controllo dell'esportazione. Il licenziatario dovr attenersi a tutte le leggi e le
disposizioni locali e internazionali applicabili al software in materia di controllo delle esportazioni.
Queste leggi includono limitazioni circa le destinazioni, gli utenti finali e l'utilizzo finale. Per ulteriori
