On 25 October 2014, at 2250 hrs, I responded to the area of West Lineal Ave and Larch St. on Officer
Gaylord of the Roselle Park Police Departments request for an additional unit. It is to be noted that at this
time Officer Gaylord was actively working a theft prevention detail of politi al signs from the area of 140
West Lincoln Ave in an unmarked unit.
Upon arrival, I met Officer Gaylord in front of 146 West Lincoln Ave. Offi r Gaylord then advised me that
he observed Michael Yakubov remove and take the "Carl Hokanson for ayor" sign from the front lawn of
140 West Lincoln Ave. After taking the sign Officer Gaylord observed Ya ubov fold the noted sign, thus
destroying it, and throw it underneath his personal vehicle New Jersey re istration: -

According to Officer Gaylord, as he then began to approach Yakubov, akubov ran up the driveway of
144 West Lincoln Ave. This is when Officer Gaylord lost sight of Yaku ov, and requested an additional
unit.
At this time, I observed Yakubov's residence front door (146 West Linc In Ave) to be open. Yakubov's
wife, Rory Yakubov, then exited the residence and asked if everything as ok. I replied by requesting to
speak with her husband Michael , and asked if he was at home. Rory Y kubov then replied: "he was
home asleep on the couch .... but now he's not there." I then asked if sh knew where he was. Rory
Yakubov replied: "I don't know .. Let me check the house". At this point fficer Gaylord had secured the
destroyed political sign from underneath Yakubov's vehicle and began earching the perimeter around
Yakubov's residence for him. A minute later, Rory Yakubov returned o tside and stated: "he's not here, I
don't know where he is." Rory Yakubov then immediately became con erned, and began to sob, stating:
"I don't know what's going on, or where he is. He was on the couch.". t this point I observed an
individual walk out from a path at the Roselle Park High School 200 fee West of our location. As I
began to approach the individual, he began to walk away from me. At t is point I was close enough that
I could positively identify the individual as Michael Yakubov. I called ou to Yakubov and asked him to
stop. Yakubov complied. At this point I observed Yakubov to have no hoes on. Yakubov was wearing
an orange plaid shirt, black pants, and black socks. Yakubov's socks re soaking wet. Yakubov was
visibly breathing heavy, and sweating from his brow.
At this point, I introduced myself and verbally Mirandized him. Yakubo replied: "I understand. Am I
under arrest?" I replied: "No you are not under arrest, however I am co ducting a criminal investigation
of theft that you may be a part of."
With this, I asked Yakubov what he was doing, and where he was comi g from. Yakubov then stated:
"Just goin for a walk." Yakubov furthered that he was coming from his ome. I then asked Yakubov why
he didn't have any shoes on. Yakubov replied: "I just felt like going for walk, I was walking with
campaigning all day". Yakubov's speech was somewhat slurred at this oint and his mouth was
extremely dry. I then advised Yakubov that he was observed removing nd destroying a political sign
from the front lawn of 140 West Lincoln Ave. Yakubov then responded: "I am under a lot of stress right
now, and I may have made a bad decision. I just ask that you guys use your discretion with this." I then
asked Yakubov directly: "Did you take the sign Michael?". Yakubov the replied with tears in his eyes: "I
did take the sign". Yakubov then began to state that he did not want to oose his job or his wife, and
again asked me to use my discretion.
At this point, I requested Officer Hannon respond to my location to trans ort Yakubov to Police
Headquarters. Officer Hannon arrived and Yakubov was then searched by me, and placed in the rear of
Officer Hannon's patrol vehicle. Yakubov was then transported to Rose le Park Police headquarters
without incident.

I then responded to Roselle Park Police Headquarters and asked Yaku ov to provide me with the details
and circumstances of this event in a sworn statement. Yakubov agree , and I then took him to the
detective bureau interview room where I conducted a sworn video state ent.
Sworn Video statement of Michael Yakubov:
With Officer Gaylord monitoring the statement, I began by re Mirandizin Yakubov at 1159 hrs on 25
October 2014. Yakubov then waived Miranda, and. signed off accordin ly.
Yakubov stated that he took (1) political sign from 140 West Lincoln Av and left (3) others there.
Yakubov expressed extreme remorse. He stated that he did this in a m ment of weakness and made a
bad decision. Yakubov explained that he was under an extreme amou t of pressure with the upcoming
election, and had numerous personal issues that he was dealing with. akubov stated that he knew
what he was doing was wrong and that he knew that the sign did not belong to him. Yakubov disclosed
that he was upset because he thought his neighbor was supporting him in the election and found out that
this neighbor allegedly told his wife that he was in fact not supporting hi . Yakubov then asked: "Why
three signs? Why couldn't it just be one and one?". I then concluded th sworn video statement of
Michael Yakubov at 1210 Hrs 26 October 2014.
Yakubov was then escorted to the prisoner processing room where he as secured for processing.

I then charged Yakubov with Theft, and Criminal Mischief. These charg s were drafted on Roselle Park
Municipal Court summons no. 2015 S 2014 356. Officer Gaylord proce sed Yakubov. Following this I
formally served him with a copy of the complaint and advised of the ma datory court appearance date of
6 November 2014.
It is to be noted that following Yakubov's sworn video statement, while rocessing, Richard Trenk, An
attorney retained by Rory Yakubov arrived at Police Headquarters with ory Yakubov. Upon his arrival I
spoke with him directly. Trenk insisted on seeing and speaking with Ya ubov. I advised Trenk that he
could not speak with him at that moment, and that he could speak with im following him being
processed. Trenk then advised me that I was no longer to speak with h many further nor take any
statements from him. Trenk then requested that I provide him Yakubov with his business card, and
advise him that Trenk would be waiting for him.
With this I provided Yakubov with Trenk's business card, and advised hi that I could no longer speak
with him with regards to theses matters. Yakubov replied by stating: "I idn't retain this council".
Yakubov was subsequently then released from custody pending his future court date.
