--------------------------------------------------------------------1.3 Steam CLIENT INSTALLATION AND ACCOUNT CREATION

--------------------------------------------------------------------Darksiders II: Installer will check your computer
for an existing installation of the Steam Client. If it
detects that no Steam Client is installed, it will
automatically begin an installation of the Client. If it
detects an older version of the Steam Client the installer
will update that version to the most current.
Following the Steam Client installation and/or update, the
installer will prompt you for your Steam Account login
information. If you do not already have a Steam Account,
you will need to create an account at this time.
--------------------------------------------------------------------1.4 DIRECTX DETECTION & INSTALLATION
--------------------------------------------------------------------Darksiders II requires DirectX to install and play.
Darksiders II installer will check your computer
for the currently installed version of DirectX. If it
detects an older version of DirectX, it will install
DirectX 9.0c and 11 automatically. The installation of
DirectX will not harm your DirectX configuration.

--------------------------------------------------------------------A. If Darksiders II is ever uninstalled, the
launcher must be launched twice for a new install to complete.

--------------------------------------------------------------------A. Latest video drivers required. Steam provides a link for
updating video drivers in their menus if needed.
B. Some ATI cards may experience crashing if cards are set to
allow overclocking by enabling overdrive. DirectX 11 users
may see an error mentioning the device has been removed.
C. See also section 4) IMPROVING PERFORMANCE.

--------------------------------------------------------------------A. Latest sound drivers required.
--------------------------------------------------------------------2.4 OPERATING SYSTEM
--------------------------------------------------------------------A. Windows Aero may cause general slowdown or graphical
issues, disabling Windows Aero if in use can increase
performance.
B. The latest OS service pack is required for optimal play.
C. Turning off virtual memory may result in performance issues
as well as crashes.

--------------------------------------------------------------------A. Certain Windows operations may sometimes cause the
fullscreen game to minimize. Maximizing will return the game

version. In order to use the controller, plug it in at any
time. If when you switch to the controller menu screens
do not display Xbox 360 Controller button icons, backing
out of the menu and returning to it again should make the
transition complete.

/OR "ONLINE" OR ELECTRONIC DOCUMENTATION (TOGETHER CALLED THE "SOFTWARE"). BY I
NSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE (OR, IN THE EVENT YOU HAVE P
URCHASED THE SOFTWARE AS CONTAINED ON PHYSICAL MEDAI, BY OPENING THE PACKAGING M
ATERIALS THEREOF), YOU ACKNOWLEDGE THAT YOU HAVE READ THIS SOFTWARE LICENSE AGRE
EMENT AND AGREE TO BE BOUND BY ITS TERMS. THE SOFTWARE IS LICENSED, NOT SOLD, T
O YOU FOR USE ONLY UNDER THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO TH

Subject to the terms of this Agreement, THQ grants You a non-exclusive,
non-transferable license to use one copy of the Software and/or, if applicable,
to use the Software for play online in the country in which You acquired the Sof
tware for Your own personal, non-commercial use, but THQ retains all property ri
ghts in the Software and all copies thereof. All other rights are expressly res
erved by THQ or its Licensors. There is no license to download game content oth
er than what is necessary to facilitate game play. You may use the Software on
any supported computer configuration and/or console platform, provided the Softw
are is used on only one (1) such computer. You may not transfer, distribute, re
nt, sub-license, or lease the Software or documentation, except as provided here
in; or alter, modify, or adapt the Product or documentation, or any portions the
reof.
3.
You acknowledge that the Software in source code form remains a confiden
tial trade secret of THQ. You agree not to modify or attempt to reverse enginee
r, decompile, or disassemble the Software, except and only to the extent that su
ch activity is expressly permitted by applicable law notwithstanding this limita
tion. You further acknowledge that the Software contains functions for collecti
ng and tracking information related to Your use of the Software. THQ reserves
the right to compile, save and use such information within the scope of THQs busi
ness activities, and analyze any and all of Your data (online registration data,
stats, etc.). All information collected by THQ is intended to be anonymous and
to not include any identifying or personal information. However, if You includ
e personal information (such as Your real name) in data collected by THQ (such a
s Your user ID), You hereby acknowledge that said personal information will be,

and expressly permit such personal information to be, used as described herein.
The data collected by THQ may be posted on websites accessible to the public; s
hared with platform providers, Software developers, and/or marketing partners; o
r used by THQ for any other lawful purpose. By using this Software You consent
to THQs use of the data THQ collects, including the public display of information
such as Your user ID, Your user created content or any other gameplay data. Do
not use the Software if You do not want THQ to use Your user data in this manne
r.
4.
OWNERSHIP: All right, title and interest and intellectual property right
s in and to the Software (including but not limited to any titles, computer code
, themes, objects, characters, character names, stories, dialog, catch phrases,
locations, concepts, artwork, images, photographs, animations, video, sounds, au
dio-visual effects, music, musical compositions, text and "applets," incorporate
d into the Software), the accompanying printed materials, and any copies of the
Software, are owned by THQ or its licensors. This Agreement grants You no rights
to use such content other than as part of the Software. All rights not express
ly granted under this Agreement are reserved by THQ.
5.
This Agreement is effective upon Your installation of the Software (or i
n the case of a copy contained on a physical media, upon opening the packaging m
aterials thereof) and shall continue until revoked by THQ or until You breach an
y term hereof. Upon revocation, breach or termination, You agree to destroy and
/or delete all copies of the Software in Your possession.
6.
You agree that you shall not:
(a)
Modify, copy, reproduce or distribute, in whole or in part, by any means
, the Software;
(b)
Merge the Software into another program (except to the extent the Softwa
re is made to operate within an operating system and in connection with other pr
ograms);
(c)
Create derivative works based upon the Software;
(d)
Attempt to circumvent any technical protection measures used in connecti
on with the Software;
(e)
Make a copy of this Software or any part thereof, except as expressed in
this Agreement;
(f)
Make this Software available on any network for use or download by other
s;
(g)
Display or use this Software in a public performance;
(h)
Use or copy the Software on or to a computer at a commercial location;
(i)
Use the Software for a commercial purpose, except as expressly licensed
in writing by THQ;
(j)
Distribute, lease, license, sell, rent or otherwise transfer or assign t
his Software without the express prior written consent of THQ, or as expressed i
n this Agreement;
(k)
Remove or modify any proprietary notices, marks or labels contained on o
r within the Software or on any packaging thereof; or
(l)
Modify or attempt to reverse engineer, decompile, or disassemble the Sof
tware, except and only to the extent that such activity is expressly permitted b
y applicable law notwithstanding this limitation.
7.
The Software may not be downloaded or otherwise exported or re-exported
into (or to a national or resident of) any country to which the U.S. has embargo
ed goods or to anyone on the U.S. Treasury Department list of Specially Designat
ed Nationals or the U.S. Commerce Department s Table of Deny Orders. If You do n
ot meet these criteria or are not sure, do not install the Software and destroy
any copies in Your possession. If You live in such a country, no license is gran
ted hereunder.
8.

You are responsible for assessing Your own computer and the results to b

e obtained therefrom. YOU EXPRESSLY AGREE THAT USE OF THE SOFTWARE IS AT YOUR SO
LE RISK. THE SOFTWARE IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS, UNLESS SU
CH WARRANTIES ARE LEGALLY INCAPABLE OF EXCLUSION. THQ AND ITS LICENSORS DISCLAIM
ALL WARRANTIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, INC
LUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILIT
Y, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, AND
THOSE ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, REGARDING THE SOFTWAR
E. THQ AND ITS LICENSORS ASSUME NO RESPONSIBILITY FOR ANY DAMAGES SUFFERED BY YO
U, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, ITEMS OR OTHER MATERIALS FROM ER
RORS OR OTHER MALFUNCTIONS CAUSED BY THQ, ITS LICENSORS, LICENSEE AND/OR SUBCONT
RACTORS, OR BY YOUR OR ANY OTHER PARTICIPANT S OWN ERRORS AND/OR OMISSIONS. THQ
and its licensors make no warranty with respect to any related software or hardw
are used or provided by THQ in connection with the Software except as may be exp
ressly set forth above.
9.
LIMITED DVD-ROM WARRANTY: Notwithstanding anything to the contrary conta
ined herein, and solely with respect to Software distributed on DVD-ROM, THQ war
rants to the original consumer purchaser of this Software on DVD-ROM that the re
cording medium on which the Software is recorded will be free from defects in ma
terial and workmanship for 90 days from the date of purchase. If the recording
medium is found defective within 90 days of original purchase, THQ agrees to rep
lace, free of charge, any product discovered to be defective within such period
upon its receipt of the product, postage paid, with proof of the date of purchas
e, as long as the Software is still being manufactured by THQ. In the event tha
t the Software is no longer available, THQ retains the right to substitute a sim
ilar Software of equal or greater value. This warranty is limited to the record
ing medium containing the Software as originally provided by THQ and is not appl
icable to normal wear and tear. This warranty shall not be applicable and shall
be void if the defect has arisen through abuse, mistreatment, or neglect. Any im
plied warranties prescribed by statute are expressly limited to the 90-day perio

THQ is not responsible for unauthorized returns of the Software and reserves t
he right to send such unauthorized returns back to customers. This warranty sha
ll not be applicable and shall be void if: (a) the defect in the Software has a
risen through abuse, unreasonable use, mistreatment or neglect; (b) the Software
is used with computer software and hardware not meeting the minimum systems req
uirements for the Software; (c) the Software is used for commercial purposes (in
cluding rental); (d) the Software is modified or tampered with; or (e) the Softw

LIMITATION OF LIABILITY. YOU ACKNOWLEDGE AND AGREE THAT THQ AND ITS LIC
ENSORS SHALL NOT ASSUME OR HAVE ANY LIABILITY FOR ANY ACTION BY THQ OR ITS CONTE

NT PROVIDERS, OTHER PARTICIPANTS OR OTHER LICENSORS WITH RESPECT TO CONDUCT, COM

SOFTWARE OR (B) REPAIR OR REPLACE, AT THQ S OPTION, THE SOFTWARE FREE OF CHARGE,
PROVIDED YOU RETURN THE SOFTWARE TO THQ WITH A COPY OF YOUR RECEIPT FOR THE SOF
TWARE. THE ORIGINAL PURCHASER IS ENTITLED TO THIS WARRANTY ONLY IF THE DATE OF
PURCHASE IS REGISTERED AT POINT OF SALE OR THE ORIGINAL PURCHASER CAN DEMONSTRAT
E, TO THQ S SATISFACTION THAT THE SOFTWARE WAS PURCHASED WITHIN THE LAST NINETY
(90) DAYS. YOU WILL RECEIVE THE REMEDY ELECTED BY THQ WITHOUT CHARGE, EXCEPT TH
AT YOU ARE RESPONSIBLE FOR ANY EXPENSES YOU MAY INCUR (E.G. COST OF SHIPPING THE
SOFTWARE TO THQ). SHIPPING AND HANDLING CHARGES FROM THQ TO YOU ALSO MAY APPLY
EXCEPT WHERE PROHIBITED BY APPLICABLE LAW. THQ MAY, AT ITS OPTION, USE NEW OR
REFURBISHED OR USED PARTS IN GOOD WORKING CONDITION TO REPAIR OR REPLACE THE SOF
TWARE. IN THE EVENT THAT THE SOFTWARE IS NO LONGER AVAILABLE, THQ MAY, IN ITS S
OLE DISCRETION, REPLACE THE SOFTWARE WITH SOFTWARE OF COMPARABLE VALUE. ANY REP
LACEMENT SOFTWARE WILL BE WARRANTED FOR THE REMAINDER OF THE ORIGINAL LIMITED WA
RRANTY PERIOD, OR THIRTY (30) DAYS, WHICHEVER IS LONGER OR FOR ANY ADDITIONAL PE
RIOD OF TIME THAT MAY BE APPLICABLE IN YOUR JURISDICTION. BECAUSE SOME STATES DO
NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, IN SUCH
STATES THQ S AND ITS LICENSORS LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY L
AW.
11.
INJUNCTION. Because THQ would be irreparably damaged if the terms of thi
s License Agreement were not specifically enforced, You agree that THQ shall be
entitled, without bond, other security or proof of damages, to appropriate equit
able remedies with respect to breaches of this Agreement, in addition to such ot
her remedies as THQ may otherwise have under applicable laws.
12.
INDEMNITY. At THQ s request, You agree to defend, indemnify and hold har
mless THQ, its subsidiaries, affiliates, contractors, officers, directors, emplo
yees, agents, licensors, licensees, distributors, developers, content providers,
and other users of the Software, from all damages, losses, liabilities, claims
and expenses, including attorneys fees, arising directly or indirectly from You
r acts and omissions to act in using the Software pursuant to the terms of this
License Agreement or any breach of this License Agreement by You. THQ reserves
the right, at its own expense, to assume the exclusive defense and control of an

U.S. GOVERNMENT RESTRICTED RIGHTS. The Software and documentation have b
een developed entirely at private expense and are provided as "Commercial Comput
er Software" or "restricted computer software." Use, duplication or disclosure b
y the U.S. Government or a U.S. Government subcontractor is subject to the restr
ictions set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and
Computer Software clauses in DFARS 252.227-7013 or as set forth in subparagraph
(c)(1) and (2) of the Commercial Computer Software Restricted Rights clauses at
FAR 52.227-19, as applicable. The Contractor / Manufacturer is THQ Inc., 29903

14.
TERMINATION. Without prejudice to any other rights of THQ, this License
Agreement and Your right to use the Software may automatically terminate without
notice from THQ if You fail to comply with any provision of this Agreement or a

ny terms and conditions associated with the Software. In such event, You must d
estroy all copies of this Software and all of its component parts.
15.
ONLINE. THQ makes no guarantees regarding the availability of online pl
ay, and may modify or discontinue online service in its discretion without notic
e, including, for example, ceasing online service for economic reasons due to a
limited number of players continuing to make use of the service over time. THQ
may deny You access, at THQs discretion, to online services, updates, or patches
to the Software, should You violate of any of the terms or provisions of this Ag
reement. You may not interfere with or attempt to disable or circumvent any onl
ine access control measures, security features, or technical protection measures
put in place by THQ. Should You use the online version of this game we will no
t ask You for any personally identifying information. You should avoid saying an
ything personally identifying in chat. You agree that THQ has no liability for
any violation of this Agreement by You or by any other player. When You play, Y
ou agree to be respectful of Your fellow players and never to engage in any beha
vior that would be abusive or offensive to other players, disruptive of the game
experience, fraudulent or otherwise illegal. This includes but is not limited t
o:
(a)
Harassing or intimidating other players while chatting or playing this g
ame online or using information obtained while chatting or playing this game to
harass or intimidate fellow players outside of the game;
(b)
Using language, selecting names or creating any other content that is ra
cially, ethnically or religiously offensive, sexually abusive, obscene or defama
tory, and any content that is commercial in nature such as advertisements, solic
itations and promotions for goods or services;
(c)
Using a player name that is the real name of any other person;
(d)
Violating any local, state or national law including but not limited to
laws related to copyright, trademark, defamation, invasion of privacy and identi
ty theft.
(e)
THQ may retrieve information about Your hardware and software for authen
tication, copy protection, account blocking, system monitoring/diagnostics rule
enforcement, game management and other purposes.
(f)
An updated version of the hardware operating system software or other fi
rmware (collectively Firmware) may be necessary in order for this game to play on
your computer. The Software on this disc may evaluate and automatically update
your Firmware. Such automatic updates may change your current operating system,
or cause a loss of data, content, functionalities, or utilities. THQ recommend
s that you regularly back up your data. Loss of data is Your responsibility.
(g)
You acknowledge that you have no expectation of privacy or confidentiali
ty in any personal or other information you may intentionally or unintentionally
disclose as part of the interactions associated with the Software. You should
avoid sharing any personally identifiable information when playing the Software
or interacting online.
16.
USER GENERATED CONTENT. This Software may include tools that give you t
he ability to communicate with other players and may allow you to create, post,
and distribute various forms of content for and in connection with the Software,
including but not limited to pictures, game-related materials and other informa
tion (individually and collectively, User Generated Content). You acknowledge tha
t THQ and the other creators of User Generated Content have rights in their resp
ective content under copyright and other applicable laws, and that except as exp
ressly described in this Agreement, such rights are not licensed or otherwise tr
ansferred to you. You accept full responsibility and liability for your use of
any User Generated Content in violation of any such rights.
(a)
You agree that you will not create, transfer, share, send, submit or upl
oad any User Generated Content that:
(i) is protected by copyright, patent, trademark, or trade secret or otherwise s
ubject to third-party proprietary rights, including but not limited to rights of
privacy and publicity (unless you are or have permission from the rightful owne

r);
(ii) contains fraudulent statements or misrepresentations that could damage THQ
or any third party;
(iii) contains any statements or materials that disparage, ridicule or scorn THQ
or any third party;
(iv) is obscene, defamatory, threatening, harassing, predatory, pornographic, ha
teful, racially or ethnically offensive, or encourages conduct that would violat
e any law or is otherwise inappropriate;
(v) is an advertisement or solicitation of business;
(vi) is an impersonation of another person; or
(vii) violates the Online section or any other terms of this Agreement, or any oth
er terms related to this game.
(b)
You agree that THQ and its Licensors are not responsible or liable for U
ser Generated Content submitted or posted by you or by others. THQ and its Lice
nsors do not claim ownership of any User Generated Content that you submit or ma
ke available as part of the game, and THQ and its Licensors expressly disclaim a
ny and all liability in connection with any User Generated Content. THQ has no
duty to pre-screen User Generated Content.
(c)
THQ has the right to edit, remove, block or refuse to post any submitted
User Generated Content from any network or Internet site for any reason without
prior notice, but assumes no obligation to do so and is not responsible for any
failure or delay in doing so. You hereby appoint THQ as your attorney-in-fact
to request from third parties removal under the Digital Millennium Copyright Act
or other applicable law or basis, in THQ s discretion, of any of your User Gene
rated Content posted on a third party network or Internet site. You agree to no
t contest THQ s request for removal of your User Generated content from such net
work or Internet site. You also agree to execute all documents, as requested by
THQ, to effect such removal.
(d)
The game and/or its associated website and/or web pages may permit you t
o share your User Generated Content with or through third party websites. THQ h
as not evaluated any third party websites through which you can share User Gener
ated Content or their terms and conditions. Any third party websites through wh
ich you can share your User Generated Content are not owned by or affiliated wit
h THQ and we have no control over and assume no responsibility for the content,
safety, privacy policies or practices of these websites. You expressly release
THQ of any and all liability arising from your use of any third party websites u
sed to share your User Generated Content.
17. THQ S LICENSE OF USER GENERATED CONTENT
(a)
By posting, transferring, sharing or sending User Generated Content in a
ny manner, you hereby grant THQ, its affiliates, licensors and distributors and
other users of the game a non-exclusive, worldwide, fully paid-up, transferrable
, irrevocable, royalty-free and perpetual license to modify, adapt, translate, c
reate derivative works from, and perform and display your User Generated Content
;
(b)
By submitting or uploading User Generated Content in any manner to THQ,
you hereby grant THQ, its affiliates, licensors and distributors a non-exclusive
, worldwide, fully paid-up, transferable, irrevocable, royalty-free and perpetua
l license to publish and distribute your User Generated Content (for free or for
profit) and to use your User Generated Content for marketing and promotional pu
rposes in conjunction with the game or any other aspect of THQ s business; and
(c)
You hereby: (i) Acknowledge that you have received good and valuable con
sideration from THQ for the license of the rights in your User Generated Content
under this Agreement; (ii) Agree that your creation or distribution of User Gen
erated Content is not in any way based upon any expectation of compensation from
THQ, its affiliates, licensors or distributors; (iii) Agree that THQ, its affil
iates, licensors and distributors may, but are not required to, use your name, u
sername, or applicable trademarks in connection with the distribution of your Us
er Generated Content; and (iv) Warrant and represent that: (A) you created your
User Generated Content; (B) you have all necessary rights to your User Generated

Content to fulfill your obligations under this Agreement; and (C) your User Gen
erated Content does not infringe on the intellectual property or other rights of
any third party and is not obscene, defamatory, offensive or an advertisement o
r solicitation of business.
18.
GENERAL PROVISIONS. You may not use, copy, modify, sublicense, rent, sel
l, assign or transfer the rights or obligations granted to You in this Agreement
, except as expressly provided in this Agreement. Any assignment in violation o
f this Agreement is void, except that You may transfer Your Software to another
person provided that person accepts the terms of this License Agreement. If any
provision of this Agreement is held to be unenforceable for any reason, such pr
ovision shall be reformed only to the extent necessary to make it enforceable, a
nd such decision shall not affect the enforceability of: (i) such provision unde
r other circumstances, or (ii) the remaining provisions hereof under all circums
tances. THQ s failure to enforce at any time any of the provisions of this Agree
ment shall in no way be construed to be a present or future waiver of such provi
sions, nor in any way affect the right of any party to enforce each and every su
ch provision thereafter. The express waiver by THQ of any provision, condition o
r requirement of this Agreement shall not constitute a waiver of any future obli
gation to comply with such provision, condition or requirement. Notwithstanding
anything else in this Agreement, no default, delay or failure to perform on the
part of THQ shall be considered a breach of this Agreement if such default, dela
y or failure to perform is shown to be due to causes beyond the reasonable contr
ol of THQ. This Agreement shall be governed by the laws of the State of Californ
ia and the United States without regard to its conflicts of laws rules and You c
onsent to the exclusive jurisdiction of the state and federal courts in Los Ange
les County, California. The United Nations Convention on Contracts for the Inter
national Sale of Goods shall not apply to this Agreement. This Agreement represe
nts the complete agreement concerning this License Agreement between You and THQ
.
19.
DOWNLOADABLE SOFTWARE ADDITIONAL LICENSE TERMS. If the Software or any
related content is provided to You through a digital download or online store (s
uch as Steam or any other method) then those additional terms and conditions app
ly. This Agreement is solely between You and THQ, and not with any third party
distributor (such as Valve). You must comply with the terms of use of any such
third party program.
