I. Introduction
He subscribed, at the request of Allianz Mexico, S.A. Compaa de Seguros, formulates this
notebook setting, the claim for compensation the insured presented by partial equipment
damages and the Yacht "LANDY BEATRIZ" machinery by waywater from seawater to the engine
room. Event occurred in vicinity of Yucalpetn, Yucatan, Mexico April 25 th, 2015.

April 25th, 2015, being the 'LANDY BEATRIZ' Yacht moored at the dock in the Marina Tower 3 at
the port of Yucalpetn, Yucatan Mexico., at the end of sea trials.

IV. - Notice of the claim.


The insured fulfilled in time and form with the notice of the claim to the insurance company.

V. - The sinister
April 25, 2015 at 07.00 AM hours they sailed from the pier Tower 3 Marina Yucalpetn,
Yucatan, Mexico for the testing of sea, consisting to test the performance of the three each
propulsion machinery heat exchangers and which gave maintenance the workshop
Megamak (Cummins local dealer). And which sailed for two hours resulting in satisfactory
evidence of exchangers mentioned above to ending such tests to 09.00 AM

Later to disembark crew and two CUMMINS technicians at the end of satisfactory
evidence of the operation of three heat exchangers of each engine, they observed
that the Yacht LANDY BEATRIZ already had a little more draft aft so they reviewed
the engine room and found that it was flooded to ignore where the waterway was.
At 0930 Hrs Mr. Melchor Rafael Gamboa Leon, Captain on board spoke to the manager of
shipyard OFION so immediately received the Yacht LANDY BEATRIZ and put she in dry. To
be placed in dry but the Yacht was the need to take she to the shipyard OFION, so Mr.
Melchor Gamboa Leon tried to put in operation the two engines of the Yacht without success
in the starboard engine, since it did not start and only that of port took it with a single engine.

Then they carried out the maneuver put it dry through the slings and crane in the shipyard
staying on their blocks for review and repair, for this were already 10: 00 hrs.
At 10.30 Hrs in dry began dating lots of water over the starboard side stern tube so they
waited for it to drainage water was too much oil, ignoring because it had too much oil on the
water and immediately before to finish draining the oil that was in bilges.
At 12.00 Hrs from April 25th, 2015 and once put in dry Yacht, Mr. Melchor Gamboa noted
that the brackets that mount to the hose making watertight 2-inch-diameter shaft tunnel were
loose and that why entered sea water by two clamps have been loose and therefore ceased
to be watertight tunnel and therefore the engine room was flooded reaching a level of 70
centimeters floor of bilge water reaching the base of propulsion machinery.

VI. - Information and documents analysis related to the accident.


Some reviews of the circumstances of the accident, the documentation collected by the adjuster
who subscribes and the adjustment process are listed below.

The protest letter dated May 5 of the year two thousand and fifteen and directed to Harbor
Master of Yucalpetn, Yucatan Mexico, was drawn up by the person in charge of the Yacht
at the time of the accident, Mr. Melchor Rafael Gamboa Leon. See annex No. 1

The administrative act where the facts giving rise to the claim, settled was raised and
submitted to the Harbor Master of Yucalpetn, Yucatan Mexico the Captain on board, Mr.
Melchor Rafael Gamboa Leon, on June 11, 2015. View copy of this document in annex No.

On 28 and 29 April 2015, engineer Hugo Mendez Iturbide, damage surveyor of F. Rosas y
Asociados, S.C., carried out the initial certification of the damage while the Yacht LANDY
BEATRIZ dry in shipyard named OFION in Yucalpetn, Yucatan port, gathering also on that
occasion, the statement of facts of the Captain of the Yacht Mr. Melchor Gamboa Rafael
Leon. The damage observed during the above-mentioned preliminary certification, were
limited to damage found in the starboard side stern tube and whose cost of repair was
estimated at less than the deductible stipulated in policy, reason why, not recommended at
that time that insurers, the constitution of reserve; pending of certified damage that could
have suffered the two propulsion engines because both must be opened for evaluation. We
ask the insured a new date to certify damage that might both propulsion engines. See copy
of the preliminary report and format of declaration of crew in annex No. 2

On 15 and 29 may 2015, we issued update reports to inform insurers of the progress of the
adjustment process and ratify constitution of reserve, reiterating that it was pending
certification of damages which could have both propulsion engines. View reports in annex
No. 2

Certification both propulsion engines damage carry out once they were removed from the
Yacht and transferred to the MEGAMAK workshop in Merida, Yucatan, Mexico work carried
out by staff hired by the insured. Made the certification of damage our damage surveyor,
Eng. Naval Hugo Mendez Iturbide from 26 to 27 June 2015 in Merida Yucatan. The workshop
MEGAMAK dealer of CUMMINS engine determined that the starboard propeller engine
requires one major repair and that the port engine requires minimum repairs because it failed
to get water. June 30, 2015 we formulate the upgrade report to inform insurers
complementary damage certification and the update of the reserve. See report in annex No.
2

On 14 and 30 July 2015, we did update reports to inform insurers of the progress of the
adjustment process and ratify the recommended reserve in the upgrade of the 30 June 2015
report. View reports in annex No. 2

In the course of the month of July in the year two thousand and fifteen, the insured via his
insurance agent, referred us different documentation support of the claim, including several
quotations.

Finally and with date of August 5 of the current year, the insured sent us the letter valued
claim, as well as the final quotes underpinning it. See documentation in annex No. 3

The insured provided us with copy of the certificate of the purchase transaction sale of the
Yacht. See copy in annex No. 3

To accredit their insurable interest on the Yacht, the insured Landy Beatriz Oliver Moises, we
referred via his insurance agent, copy of a letter transfer of date August 13, 2015, to payment
of compensation corresponding to the present claim, be done to his person. Assignment of
rights that make Mr. Roberto Abimerhi Oliver and Mr. Eduardo Abimerhi Oliver, who are
signed as owners of the shares of the Corporation Seablue Inc, Corporation owns the boat
LANDY BEATRIZ, accompanying this letter transfer of documentation of Mr. Roberto
Abimerhi Oliver and Mr. Eduardo Abimerhi Oliver who sign as owners of the shares of the
Corporation Seablue Inc. see annex No. 3

The American Yacht registration certificate was valid at the time of the reported incident. See
a copy of the certificate in annex No. 4

The insured via their insurance agent provided us, copy of the permission to import temporary
of the boat, existing at the date of the accident. See copy in annex No. 4

The workshop MEGAMAK, CUMMINS marine engine dealers issued technical report of the
two propulsion engines of the Yacht on 12 June 2015. See the report in annex 5.

MEGAMAK workshop at the request of the undersigned provided us quote of a new engine
brand Cummins marine for comparison purposes, resulting in more reasonable repair to
replacement of engine starboard which resulted with very severe damage. See quotation in
annex 5.

Yacht LANDY BEATRIZ policy was current at the time of the reported incident. See copy of
the policy in the annex No. 6

The characteristics of the insured Yacht coincide with those mentioned in the policy, with the
exception of the name, as in the policy is cited as AQUARELLE, when physically in the boat
says LANDY BEATRIZ.

The sum insured for hull is: $310,000.00 USD and the deductible stipulated is of three per
cent of the amount insured, i.e. $ 9,300.00 USD

The policy covers loss or partial damage

According to the particular conditions, the policy is subject to the clause of compensable ratio,
which indicates the following: the sum insured has been determined by the insured and is
not proof or the existence or of the value of the goods, only represents the basis to limit the
maximum company liability. Unless written otherwise, if at the time of an accident occur, the
goods have altogether totaling real or reset higher or lower than the amount declared by the
insured, the company will only respond in proportion to the damage caused.

Under section XXVI of the general clauses of the policy, if in the particular conditions indicate
that it is subject to the compensable share clause, applies the same according to the
following: the insured undertakes to establish the sum insured policy based on the real value
of the vessel at the time of recruitment , including where appropriate, both the special
equipment installed, when this has been specifically covered in the policy, as well as the cost
of rights and respective import taxes. Likewise the insured shall notify the company any
change that modifies this value during the life of the policy to carry out the adjustment to the
insured amount and the corresponding premium. The liability of the company in any loss or
damage is limited to the proportion between the amount insured and the real value of the
vessel or any part thereof at the time of the accident. For purposes of this policy means real
value the sum which will require the acquisition of a vessel of the same characteristics of the
insured watercraft (brand, model, year), at the time of the accident. If not then any physical
depreciation amount, more rights, and import taxes will apply the acquisition of a new vessel
of the same characteristics of the insured watercraft, at the time of the accident, less when it
is applicable. The maximum liability for the insured watercraft, has been determined by the
insured, but isn't test value or of the existence of the same, simply determines, in case of
accident, the maximum amount that the company would be obliged to compensate.

The adjuster who subscribes the present, proceeded to review the sum insured of the Yacht
LANDY BEATRIZ stipulated in policy, to seek for this purpose, the price of a new boat similar
to the BEATRIZ LANDY, as this model is no longer manufactured it, as well as market prices
of boats used the same model and year of construction than the BEATRIZ LANDY,
concluding the undersigned, that the real value of the Yacht LANDY BEATRIZ upon the
occurrence of the accident, is congruent with the insured amount (no underinsurance). See
annex No. 6 memory calculation of the revision of the amount insured, new replacement cost
of a Yacht similar to the BEATRIZ LANDY, sheets techniques and prices for two (2) similar
to the BEATRIZ LANDY used for sale Yachts provided by the insured, technical specifications
and prices of ten (10) Yachts used for sale similar to LANDY BEATRIZ obtained on the web
by the undersigned

The policy in paragraph II of risks covered in the general conditions for small boats, shelters
subject to the exceptions specified in it, the loss or damage to the insured watercraft arising
out of the performance of the navigation and caused a result among other hazards by the
sinking of the ship. In this accident, crew members could observe damage because the ship
had a draft aft abnormal, attributed this sinking to the entry of seawater to the engine room
by sudden and unexpected rupture of the clamps of the stern tube of starboard side, clamps,
whose function is to ensure the tightness of the stern tube.

Adjuster Francisco J. Rosas maintained communication via e-mails with the insured in the
course of certification of damage and loss adjusting, adding as evidence copies thereof in
annex No. 7

VII. - Proximate accident cause and analysis of coverage of the claim


A). - Proximate accident cause
Sinking of the Yacht LANDY BEATRIZ partial flood with sea water in the engine room, this
loss of sudden and unexpected tightness of the stern tube for propeller shaft of starboard
whose clamps pulled to turn hose inch in diameter, which lubricates said stern tube through
salt water cooling and other hose of 5/8 inches in diameter that its function is to fill and empty
the oil crankcase of the propulsion engine of starboard.

B). - Coverage of the claim


Analyzed the collected documentation relating to the claim and considering:
i.

That the policy covers loss or partial damage

ii.

That the policy in paragraph II of risks covered risks covered in the General
conditions for small boats, shelters subject to the exceptions specified in it, the loss
or damage to the insured watercraft arising out of the performance of the navigation
and caused a result among other hazards by the sinking of the ship.

iii.

The certificate of registration of the Yacht LANDY BEATRIZ was current at the time
of the accident reported

iv.

and since there was no malice or bad faith by the insured in the facts that gave rise
to the incident

The undersigned recommended should be considered as covered by the policy the claim
presented by the insured for damages by sinking of the Yacht LANDY BEATRIZ, attributable
to flooding partial with seawater in the engine room, recommending its compensation, under
the determination of losses and the convention setting inserts on the following pages.

1. Agreement settlement adjustment of loss that held on the one hand Mrs. Landy Beatriz Oliver Moises on "The
insured", and moreover the Eng. Francisco Javier Rosas Gonzalez as the insurance adjuster appointed for the valuation
of losses by Allianz Mexico SA insurance company, hereinafter "The insurer".
2. This agreement settlement of loss adjustment held on the occasion of the accident occurred April 25, 2015, by partial
damage to machinery and equipment by sinking of the Yacht LANDY BEATRIZ partial flooding with seawater in the
engine room.
3.

The object of this agreement settlement of loss adjustment is the establish the amount of the loss suffered by "The
insured" in accordance with the terms and conditions set forth in the policy issued by the insurer, as well as based on
the information and documentation provided by "The insured".

4.

"The insured" under protest to say truth is that on the date in which the accident occurred and at the date of this
convention - settlement of loss adjustment, had no, no has, held any other contract of insurance with Mexican
companies or foreign, invoking his insurable interest against the same risks.

It is agreed by both parties that goods that are compensated in the incident cited do not pass to be owned by "The
insurer" in quality of salvage in terms of the provisions of article 111 of the law on insurance, making it "The insured"
no commitment to safeguard them and deliver them when "The insurer" requires them to be.

Derived from the payment of compensation, in terms of the provisions of article 111 of the law on insurance, "The
insured" agrees to help "The insurer", in accordance with the terms and conditions set forth in the insurance contract,
in all the legal actions that correspond to "The insurer" against any third party for the exercise of the right of subrogation.

This agreement settlement of loss adjustment is subject to the provisions of article 119 and other applicable articles
of the law on the insurance contract.

8.

The purpose of this agreement is to determine the payment of compensation to the insured resulting from losses
incurred, subject to the terms and conditions of the policy issued by the insurer, as well as the information and
documents provided so far by the own insured. As a result, previous authorization of insurers found grant "The insured"
compensation in the amount of $461,365.09 Mexican pesos. (Four hundred sixty-one thousand three hundred sixty
and five, 09/100 Mexican pesos).

Both parties agree that the payment is made by bank transfer; accordingly, "The insured" will provide "The insurer"
