FactsThere was a dispute regarding the shop between the respondent no. 1, 2 and the petitioners.

Petitioner was the tenant at the shop at the shop owner Rajendra Prasad.
Shop owner of the disputed shop decided to sell the shop but he was not ready to sell the same to
the petitioner no. 1, for that petitioner no. 1 borrowed Rs. 6 lacs from the petitioner no. 2 and
also advanced a loan of Rs. 12 lacs to the present Respondent no. 1 and Respondent no. 2.
Also there was an agreement between both the petitioners and Respondent no. 1, 2 that after
purchasing the original shop owner, they shall sell the shop to the Petitioners for Rs. 6 lacs and
remaining amount of 6 lacs shall be paid back to the Petitioner no. 1 by paying interest at the rate
of 2% p.m. on the loan.
And also it was agreed that after purchasing the shop the Petitioner shall remain as tenant in the
shop and can carry his business.
On 16/17.4.2013, Respondent no. 1 and 2 got the sale deed of the shop by the original owner of
the shop for the sum of 4 lacs and also gave affidavit in relation to that in favour of Petitioners.
After that, present Petitioner for the first time informed by the Respondent no. 3 that the sale
deed was executed in her favour.
Due to that petitioner caused registered notice dated 17.10.2014 to the Respondent 1, 2 asking
them to execute the sale deed in favour of petitioners
