ORDINANCE NO. 560


AN ORDINANCE REVISING THE ZONING REGULATIONS OF THE CITY OF PUERTO
PRINCESA AND PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT AND
AMENDMENT THEREOF AND FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT
THEREWITH.

WHEREAS, the implementation of Comprehensive Land Use Plans requires the
enactment of regulatory measures to translate its planning goals and objectives into reality, and
a Zoning Ordinance is one such regulatory measure which is an important tool for the
implementation of the Comprehensive Land Use Plan;
WHEREAS, the Local Government Code authorizes local government units to enact
Zoning Ordinances subject to and in accordance with existing laws;
WHEREAS, the Housing and Land Use Regulatory Board has spearheaded and now
assists and coordinates the activities of local governments in Comprehensive Land Use
Planning;
NOW THEREFORE, on unanimous decision of all the members present.
BE IT ORDAINED by the Sangguniang Panlungsod of the City of Puerto Princesa in its
regular session assembled, THAT:

Section 45.
Special Use Requirements.
For the following uses, special conditions shall be required. The uses and
conditions are:
a) Amusement use
i. Includes night establishments, motels, slot machines and other computer
game halls.
ii. Easement of not less than 100 meters from schools, churches, day care
centers and hospitals. Buffers or screens needed in the form of walls,
planting strips shall be required in cases where the 100 meter easement is
not feasible.

b) Cemetery/Memorial Park
i. They shall be located outside of and within reasonable distance from
residential zones.
ii. A buffer strip of five (5) meters or more from the perimeter fence shall be
observed.
iii. Must comply with HLURB Guidelines.
c) Cockpit
i. It shall be located outside of residential and institutional zones and
should be at least 200 meters from the nearest residential areas, schools,
churches, hospitals or similar buildings.
ii. They shall not be located along National Highway unless they observe a
setback of at least 100 meters from the centerline of the road.
iii. Along all other roads, a setback of 30 meters shall be observed.
d) Disco Houses/Sing-Along Bars.
i. They shall be located at least 200 meters from any public building,
hospital, institutional center and church or other religious premises.
ii. They shall be enclosed and semi-sound proofed.
e)

Gasoline Filling Station


i. Applicant must secure an Environmental Compliance Certificate from the
DENR.
ii. They shall not be located within 100 meters from the nearest schools,
churches, hospitals and other similar buildings.
iii. They shall be located outside of the Old CBD.

f) Funeral Parlors/Mortuary/Memorial Chapels


i. Funeral establishments shall be classified as follows:
Category 1 funeral establishments with chapels and embalming
facilities and offering funeral services. They shall be allowed within
Central Business Zone;
Category II funeral establishments with chapels and offering funeral
services without embalming facilities. They shall be allowed within
Commercial and Institutional Zones;
Category III funeral establishments offering only funeral services from
the house of the deceased to the burial place. They shall be allowed
within Residential, Commercial and Institutional Zones.
ii. Category II and III must have an existing valid contract with a Category I
establishment for embalming purposes.

iii. There shall be a minimum radial distance of least 25 meters from


restaurants, food centers and other food establishments; at least 50 meters
from markets and at least 200 meters from abbatoirs, schools and
hospitals.
iv. There shall be a minimum area requirement:
Category minimum of 600 square meters;
Category II minimum of 420 square meters;
Category III minimum of 280 square meters.
v. Applicant must secure and Environmental Compliance Certificate from
the Department of Environment and Natural Resources.
vi. Must comply with HLURB Guidelines.
g) Piggery and poultry
i. The piggery shall be located outside of the urban area.
ii. There shall be at least a distance of 300 meters from built-up areas.
iii. The piggery and poultry shall be 500 and 200 meters away from the major
roads or highways respectively and 300 meters and 100 meters away from
secondary roads respectively.
h) Shopping centers/malls
i. Free-standing shopping center or shopping mall shall be located outside
the old CBD.
ii. A Shopping Center or shopping mall shall have a minimum land area of
five (5) hectares.

Section 46.

i)

Slaughterhouse.
i. Includes associated uses such as administrative offices, stockyard, waster
treatment facilities and security installations.
ii. A 100 meter buffer from perimeter fence shall be imposed.

j)

Waste management
i.
Includes solid waste, waste water and toxic or hazardous waste
management systems.
ii. A 500 meter buffer from the perimeter fence shall be required.
Coastal Zone Regulations
Any development in coastal zones shall observe an additional twenty (20) meter
setback from the easement provided under the Water Code.

Biological fencing and barbed wire fencing with vegetative cover may be allowed
around private properties subject to the condition that such fencing shall in no
way hamper public access to the beach.
Extraction of sand, levelling or digging of sandy stretches, except for structural
foundation of buildings and swimming pool within 100 meters of the high tide
line is prohibited.
Any beachfront development shall be required to have an appropriate sewage
treatment plant so as not to pollute the sea and create odour or bacterial
contamination of the beach. The sewage treatment facility may be shared by two
or more adjoining properties.
Ambulant peddling of any type of goods along and within the beach shall not be
allowed.
The use of any motorized vehicles along the public beach is prohibited
Section 47.

Height Regulations.
The maximum height of buildings or structures shall not exceed the height
regulations of the same classification in which they may be situated, except for
penthouse or roof structures for the housing of elevators, stairways, water tanks,
church steeples and other utilities and such other structures not covered by the
height regulations of the National Building Code and Civil Aviation Authority of
the Philippines (CAAP), as well as all laws, ordinances, design standards, rules
and regulations related to land development and building construction and the
various safety codes.
In areas that may be declared by the CAAP as along air traffic route, the building
height shall govern with the CAAP regulations, provided that no building or
structure shall exceed the height limitation imposed by the regulations in the
zoning district where it is located.

Section 48. Building Coverage


The following are the maximum building coverage for each zone/district:

Exemption from Height Regulation.


Exempted from the imposition of height regulations in residential zones are the
following: towers, church, steeples, water tanks and other utilities and such other
structures not covered by the height regulations of the National Building Code
and/or the Air Transportation Office.
