This Tenders form has two parts. Parts I is for the technical bid and Part II is for
the commercial bid.

Terms & Conditions of Rate Contract Proposal


1. The Prices should be inclusive of all taxes/VAT.
2. The prices should be FOR various Dept./Centre/Colleges University of Rajasthan, JLN Marg,
Jaipur and should be valid/firm until the last day of period of Contract.
3. Delivery is at the various Dept./Centre/Colleges University of Rajasthan, JLN Marg, Jaipur
within the stipulated time mentioned in the purchase order. In case of delivery is /are not

made in time, the University reserves the right to cancel the order without any liability of any
loss incurred in the transition/delivery.
Only in case where the situation or cause are not under the control of bidder like strike,
riot, war, fire & earthquake etc. the University may consider to take the delivery of the
purchase order at its option.
4. The University has right to defer delivery on any or every item mentioned in the purchase
order by giving oral notice to the bidder (which may be Confirmed later on in writing)
5. The bidder should ensure the good quality packing of the items mentioned in the purchase
order and safe delivery to the University.
THE UNIVERSITY WILL NOT BEAR THE LOSS/OR DAMAGE UNDER ANY
CIRCUMSTANCES DUE TO DAMAGE/BREAKAGE OF ARTICLES IN THE TRANSIT.
THE COST OF THE DAMAGE/BROKEN ARTICLES WOULD BE DEDUCTED RROM
THE BILL.
6. The University has right to amend the order and no claim will be allowed to bidder arising on
this account.
7. If the University deems fit to inspect/test the Items by its authorized person, the cost of the
same will be borne by the bidder.
8. Any item of the purchase order if found defective or not found as per the specification as per
the bidder's form, the University has right to cancel the order.
9. After the completion of the supply/purchase order, the bidder shall have to submit the bill in
triplicate duly pre-receipted to the University along with the certificate that the supply is/are
as per the bidder's form.
10. Following documents are to be attached with the bidder's form.
(a) Authorization Certificate of dealership from the manufacturer firm/company.
(b) Latest Sales Tax Clearance Certificate.
(C) Complete literature along with the catalogue, Price List and technical data must be
enclosed with the proposal to facilitate the technical expert in selection of items.
(d) Clientele list and work done list.
(e) IT clearance Certificate, Audited Balance Sheet, etc.
(f) Performance Certificates from clients.
(g) Separate DD for EMD amount Rs. 25,000/- for Rate Contract Proposal.
(h) The form of the "Terms and Conditions" should be duly filled and signed by authorised
person.
11. There are two forms - one "Technical bid" and second "Financial bid". Every bidder
should complete both the forms and seal in separate envelope and should mention on
the envelope "Technical bid" and "Financial bid". These two envelopes then further
be sealed in one big envelope which should be addressed to :Dy. Registrar (G.Ad.)
University of Rajasthan,
JNL Marg, Jaipur-302004.

and should reach in the office of the Registrar on or before 28.09.2012 up to 1:30
PM. The same will be opened on 28.09.2012 at 3:00 pm in Vice-Chancellor's
Secretariat. Any bidder wants to be present at opening of the bid may do so at his own
cost. The DD of EMD should be attached with the technical bid form. Financial bid of
those bidders who have not attached the DD of EMD will not be opened.
12. (1) The time specified for delivery in the tender form shall be deemed to be the essence of
the contract and the successful tenderer shall arrange supplies within the period on receipt
of the firm order from the Purchase Officer.
(2) Liquidated damages: In case of extension in the delivery period with liquidated
damages the recovery shall be made on the basis of following percentages of value of
Stores which the tenderer has failed to supply :(i) (a) delay up to one fourth period of the prescribed delivery period 2%
(b) delay exceeding one fourth but not exceeding half of the prescribed period 5%
(c) delay exceeding half but not exceeding three fourth of the prescribed period. 7%
(d) delay exceeding three fourth of the prescribed period. 10%
(ii) Fraction of a day in reckoning period of delay in supplies shall be eliminated if it is less
than half a day.
(iii) The maximum amount of liquidated damages shall be 10%
(iv) If the supplier requires any extension of time in completion of contractual supply on
account of occurrence of any hindrance, he shall apply in writing to the authority, which
has placed the supply order, for the same immediately on occurrence of the hindrance but
not after the stipulated date of completion of supply.
(v) Delivery period may be extended with or without liquidated damages if the delay in the
supply of goods is on account of hindrances beyond the control of the tenderer.
Recoveries : Recoveries of liquidated damages, short supply, breakage, rejected articles
shall ordinarily be made from bills. Amount may also be withheld to the extent of short supply,
breakages, rejected articles and in case of failure in satisfactory replacement by the supplier
along with amount of liquidated damages shall be recovered from his dues and security deposit
available with the department. In case recovery is not possible rescuers will be taken under Law
Revenue Act, Rajasthan PDR Act or any other laws in force.
13. The bidder will not, in any case, sublet the order placed to him.
14. The University has right to cancel any or part of the purchase order on FAX, notice to the
bidder in writing, effective when sent, provided such cancellation is done well before the
delivery period. The University has also right to cancel part or whole of the purchase order.
15. The EMD will be forfeited if the bidder fails to commence the supply of the items as per
purchase order within the stipulated time.
16. Warranty period will be one year from the date of installation of the item supplied. The
University shall have right to notify in writing a claim arising under the warranty period and
the bidder shall have to repair or replace within the warranty period.
17. After the financial bids finalization, successful parties will have to enter in to the agreement
on the Non-Judicial stamp worth Rs. 100/- with the University within 7 days.
18. All the items supplied shall be strictly conform to the specifications. Trade mark laid down in
the bid form and wherever articles have been required according to ISI specifications, those
articles should conform strictly to those specifications and should bear such mark.

19. The University is exempted from the custom duty, certificate of the same will be provided if
required.

20. The University reserves the right to accept or reject any or all tenders without assigning any
reason.
21. The successful Bidder has to deposit 5% security money of the total amount of the order
placed to him issued by various Dept./Centre/Colleges University of Rajasthan, Jaipur.
22. In case of the last day of depositing and opening of the bid observe holiday, the same will
take place on the next working day.
23. All disputes are subject to Jaipur jurisdiction.

Note:
1. Tender complete in all respects should reach to Dy. Registrar (G.Ad.), University of
Rajasthan, Jaipur by 28.09.2012 upto 1:30 p.m.
2. Only manufacturer or distributor or dealer should apply. Tenders will be opened at
28.09.2012 at 3:00 p.m. in VC Secretariat in front of the Tendering parties.
3. Commercial bid of only those Firms will be opened which qualify technically and is
accompanied with required earnest money in the form of DD.
4. Other conditions as per GF&A Rules will apply.
5. University of Rajasthan, Jaipur, reserves the right to choose/ reject any/ none quoted Item
or companies without assigning any reason.
